Grand Rapids Man To Spend Five Years In Prison For Trafficking Firearms

GRAND RAPIDS, MICHIGAN – Donte Timothy Bacon, 31, of Grand Rapids, was sentenced to 60 months’ imprisonment, Acting U.S. Attorney Andrew Birge announced today.

In August, Bacon pled guilty to selling a firearm to a prohibited person and possession of a firearm with an obliterated serial number. Charles Lee Samuels, 28, earlier was sentenced to 18 months in prison for his lesser role in the crimes.

On five different occasions in August and September 2014, Bacon sold a firearm to a person who was not permitted to possess it under federal law. One of the firearms was sold with a high-capacity magazine. Two of those firearms had been purchased by Bacon and Samuels and were sold after Bacon removed the serial numbers. During the final transaction, Bacon and Samuels used a hand-grinder to remove the serial number at the time of sale.

In his final sentencing before retiring from the bench, U.S. District Judge Robert Holmes Bell observed the seriousness of trafficking firearms. Judge Bell ordered Bacon to serve three years of supervised release following his term of custody and expressed his hope that Bacon will return as a productive member to his community.

“The diversion of firearms for unlawful purposes or to those who cannot legally possess them endangers each and every member of our society,” said Acting U.S. Attorney Birge. “The U.S. Attorney’s Office will prosecute those who willfully circumvent federal firearms laws designed to protect the public.”

“Selling firearms to prohibited individuals contributes to the cycle of gun violence plaguing our neighborhoods,” said Special Agent in Charge Robin Shoemaker of the Bureau of Alcohol, Tobacco, Firearms, and Explosives. “ATF will continue to use all available resources to put a stop to illegal gun sales. Let this conviction stand as a warning to others willing to put profit before public safety.”

The ATF conducted the investigation, with assistance from the Grand Rapids Police Department. Assistant U.S. Attorneys Justin M. Presant and Alexis M. Sanford prosecuted the case.

A longtime Albion, Michigan couple – who want to get married in federal slammer – are headed to federal prison for a long time after pleaded guilty in connection with shocking case in Calhoun County involving child porn and exploitation of children for getting three underage girls to pose for naked photos that he posted on the internet.

For the next 30 plus years the feds to keep an eye on the man – mostly in federal prison and has been ordered to pay over $20,000 to his minor victim plus restitution for his prosecution in a series of fees/fines.

Normann Robert Pittelkow of Albion, MI will spend over 22 years (265 months) in federal prison for sexual exploitation children and and possession of child pornography.

Pittelkow and his long-time girlfriend, coerced young three sisters to pose for nude and lingerie photos The girls were aged 13, 14, and 16. The crimes committed in September 2013.

In an incredible letter to the judge, Pittelkow said he seeks to “repair the damage” his crimes have caused and “figure out why my thought process broke down and get it mended.”

Saying he has lost all friends, co-workers and family, who are apparently not interested in his apologies.

Pittelkow was sentenced this week (Nov. 30, 2016) by a disgusted U.S. District Judge Robert Holmes Bell in Grand Rapids, MI.

His girlfriend, Nicole Renee Jacob, will spend over 15 years (180 months) in prison after a plea agreement with federal prosecutors. She was sentenced on Oct. 27, 2016 by Judge Bell.

In a five page letter to the judge, Pikkelkow even claims to want to marry his partner of 14-years – even though they were involved in a child porn plot.

Pittelkow was represented by attorney Helen Nieuwenhuis.

After serving the 22 years, he will be placed on ten years of supervised release.

Pittelkow was indicted with numerous felonies including four counts of “sexual exploitation of children; sexual exploitation of a child and attempted sexual exploitation of a child and one count of material constituting/containing child porno; possession of child pornography

McLeod was indicted on Tuesday, August 12, 2014 for possession and distribution of child pornography – involving preteen boys – during 2012 in Osceola County.

34-year-old Douglas Emil Kugler, Jr. of Vilas County, Wisconsin on Wednesday, July 13, 2014 agreed to a plea bargain and pleaded guilty to one count of abusive sexual contact with a child under the age of 12.

Kugler signed the plea agreement on August 7 before his defense attorney Derek G. Swajanen and assistant U.S. Attorney Paul D. Lockner.

The maximum penalty if Kugler pleads guilty is 20 years in jail, a $250,000 fine and five years probation.

Kugler must file as a sexual offender in Wisconsin.

A non-native Kugler allegedly had sexual contact with a young Native American boy- about 3 and a half years old – while visiting a family member at the Keweenaw Bay Indian Community in Baraga, Michigan.

61-year-old Tommy Alan Cain, formerly of Kincheloe, was arrested in Grand Rapids on July 24, 2014 after his indictment by a federal grand jury on multiple sexual abuse laws involving a minor:

Five counts of Sexual Abuse by Threat (Max life sentence if convicted)

One count of Abusive Sexual Contact by Threat (Max 3 years if convicted)

Six counts of Sexual Abuse of a Minor. (Max 6 years per count – or 36 years total – if convicted

The indictment alleges Cain engaged in sexual acts with a minor victim over a four-year period beginning in 2007 on trust lands of the Sault Ste. Marie Tribe of Chippewa Indians.

John Richard Balyo of Kalamazoo was indicted on July 23, 2014 by a federal grand jury in Grand Rapids on felony charges of sexual exploitation of a child and possession of child pornography.

Balyo allegedly “produced photographs of a boy” about 12 years old and then “engaged in sexually explicit conduct” on April 19, 2014 in Kalamazoo County, Michigan.

(Kinross, MI) – An ongoing investigation by U.P. Breaking News into reports of abuse of inmates – and of real danger to state corrections officers – has numerous sources reporting a state of fear, danger and retaliation at controversial prison in the eastern part of Michigan’s Upper Peninsula.

First the guy who died yesterday was no saint – a long record of crimes – but he was not sentenced to death by the jury. Yet he died yesterday under mysterious circumstances that may include lack of hydration.

Yesterday (Mon., 10-10-16), U.P. Breaking News reported that emergency medical officials were called to the prison to treat an inmate who was not responsive. Well, that inmate, Charles Lee Anderson, is dead.

He recently celebrated his 51st birthday.

His crimes are long and terrible, but sources familiar with the case say he should not have died yesterday.

Numerous sources report a state of fear and danger – that is felt by both inmates and corrections officers at Kinross. Recently state budget cuts in the Upper Peninsula have put lives at danger – and even led to numerous deaths, an investigation by U.P. Breaking News shows.

Without even hearing from state officials, U.P. Breaking News believes the state would deny the budget cuts have lead to deaths in the U.P. – so we are putting up their generic denial as a courtesy.

Remember while fires were set and a massive riot was underway, MDOC officials lied to reporters about how serious the recent riot was at Kinross. U.P. One source said the state is legally obliged to provide and strive for an environment that is safe to both inmates and corrections officers – which by the way – we have heard there are many good COs at Kinross who are also disgusted with how the prison has devolved into danger to staff and inmates.

Out investigation shows, we believe, that federal authorities need to raid Kinross asap before more deaths occur.

(Marquette, MI) – A Menominee area Native American had not even been free for a year when he screwed up his probation after being part of a Heroin ring – and again was accused of drugs and associating with druggies – now he’s going back to prison for 7 months and then three months in a drug treatment program at a halfway house.

43-year-old Michael D. Peak has lived in the Menominee, MI/Marinette, WI area and was among nine busted for distributing piles of heroin from Green Bay to the southern U.P. Back in 2013.

Peak is accused by the feds of using “alcohol, abuse of buprenorphine, and use of heroin and Percocet.”

peak-mugshot-2On Monday, Sept. 12, 32016, Peak was sentenced to 10 months in prison “with 3 of the 10 months to be in a half-way house with substance abuse treatment, preferably an in-patient treatment program” by United States District Judge Paul L. Maloney.

There will be “no term of supervised release to follow,” the judge ordered.

On Sept. 9, 2015, Peak was released from federal prison.

On Oct. 29, 2015, Judge Maloney approved Peak’s transfer of probation from the northern Wisconsin to the Upper Peninsula of Michigan.

Peak was accused on August 2, 2016 of violations of probation only 11 months (Sept. 9, 2015) from his release from federal prison for his part in a heroin ring that operated from Green Bay to the Upper Peninsula.

The violation order was filed by U.S. Probation Officer Joshua J. Hechtman in Marquette – and approved by his boss Supervising U.S. Probation Officer Mark A. Trowbridge, Sr.

One interesting detail in that report includes that on June 30, 2016 a “report on offender” was issued and the “court agreed to take no action as a result of Mr. Peak’s arrest on an outstanding warrant, use of alcohol, abuse of buprenorphine, and use of heroin and Percocet.

In the warrant, Peak was accused of four violations of his probation that do not allow him to use or deal illegal drugs and can not associate with felons especially fellow druggies.

Violation 1:

“The defendant shall not commit another federal, state or local crime.”

Violation 2:

“The defendant shall not unlawfully possess a controlled substance. The defendant shall refrain from any unlawful use of a controlled substance…”

Violation 3:

“The defendant shall refrain from the use of all alcoholic beverages and shall not purchase, possess, use, distribute, or administer any controlled substance or any paraphernalia related to any controlled substances, except as prescribed by a physician.”

Violation 4:

“The defendant shall not associate with persons engaged in criminal activity and shall not associate with any person convicted of a felony, unless granted permission to do so by the probation officer.”

In the U.S. Probation officer warrant, the “supporting evidence and information for violations 1 and 2” stated:

On July 28, 2016, this officer made contact with MDOC Agent Matt Vanni, who was meeting with several law enforcement officers from the Menominee area during our telephone conversation.

Information from that conference revealed Mr. Peak was allegedly allowing Kelly LaCanne and her boyfriend Jesse Brayley to live with him. Mr. Brayley was recently arrested for possession of methamphetamine and Ms. LaCanne was alleged to be involved in methamphetamine use. Both were also alleged to be convicted felons.

On August 3, 2016, Mr. Peak was confronted about these associations by this officer. He admitted Mr. LaCanne was living with him until approximately a month ago and he admitted her involvement in the abuse of multiple controlled substances. He denied Mr. Brayley lived with him, but admitted allowing him to stay at his home for several days. He advised this officer he did not know if they were felons.

An NCIC/LEIN inquiry reflected Ms. LaCanne was convicted of the following felonies:

Possession of Schedule I and II Narcotic Drugs on August 13, 2009, in Marinette County, Wisconsin, Circuit Court; and Controlled Substance-Delivery/Manufacture (Cocaine, Heroin, or another Narcotic) Less Than 50 Grams and Maintaining a Drug House on May 4, 2009, in 41st Circuit Court, Menominee.

This officer was not able to locate information regarding felony convictions on the part of Mr. Brayley, but his involvement in methamphetamine use constitutes involvement in criminal activity.

In the probation warrant, the “supporting evidence and information for violations 1 through 3” states:

On July 27, 2016, U.S. Probation Officer Matthew J. Luce and Supervising U.S. Probation Officer Mark W. Restum made contact with Mr. Peak at his home. He advised he would be unable to produce a urine specimen because he just used the bathroom. Arrangements were made for Mr. Peak to report to the Menominee County Michigan Department of Corrections (MDOC) office, Menominee, to submit a urine sample on July 28, 2016.

Mr. Peak reported as instructed and provided a sample that tested presumptively positive for opiates, but he denied use of any controlled substances to the agent collecting the sample. He also sent an email to this officer on July 29, 2016, contesting the presumptive results of the sample.

On August 3, 2016, Mr. Peak contacted this officer by telephone. He admitted he tested positive for controlled substances because he has been abusing Percocet each weekend for the last month and a half. He admitted obtaining the substance illegally because he cannot be prescribed it by a physician.

The offender also reported he uses the substance on the weekends because he presumes this or another officer will not attempt contact with him during those times. He claimed he uses the substance for pain management, but then described struggling with the “demons” of substance abuse for much of his life and explained his plan to access substance abuse services through his Employment Assistance Program at work.

On July 27, 2016, U.S. Probation Officer Matthew J. Luce and Supervising U.S. Probation Officer Mark W. Restum made contact with Mr. Peak at his home. He advised he would be unable to produce a urine specimen because he just used the bathroom.

Michael D. Peak arrested on the new charges at the Menominee Police Department.

While on supervised release, Peak was found guilty of violating its terms even though Peak denied being guilty of some of the violations – and under an agreement three of the charges were dismissed.

An amended judgment in a criminal case “for revocation of probation or supervised release” was filed on Sept. 12, 2016 in the Marquette federal courthouse, officially the United States District Court for the Western District Of Michigan.

“The defendant shall not commit another federal, state or local crime,” while on release and the judge ruled Peak possessed and used of the painkiller thus was in violation of the supervised release condition.

Judge Maloney on Monday approved a recommendation and ruling by U.S. Magistrate Judge Timothy P. Greeley.

Federal prosecutors say Peak violated his release terms ” on multiple occasions between” June 14 and July 30, 2016, by possessing and using Percocet, a schedule II controlled substance, without a prescription and is “punishable by imprisonment for not less than 90 days but not more than 3 years and a minimum fine of $5,000 based upon Mr. Peak’s prior drug convictions.”

Federal prosecutors say Peak was in violation of additional crimes violation of “possessing a “narcotic/cocaine less than 25 grams, which is punishable by imprisonment for not more than 4 years or a fine of not more than $25,000.00, or both.”

However, the additional charges were dismissed based on a motion from federal prosecutors.

The sentence is imposed pursuant to the Sentencing Reform Act of 1984, according to federal court documents.

“Violations of two, three, and four are dismissed upon motion by the government” and Peak’s “term of supervised release is revoked and the defendant is hereby committed to the custody of the United States Bureau of Prisons to be imprisoned,” the documents state.

On May 7, 2014, Peak was sentenced to 2 years in prison and one years supervised release on a federal charge with eight others in northeast Wisconsin for “use of a communication device to facilitate distribution of heroin” from Green Bay to the U.P.

Special conditions of his release included substance abuse testing and treatment with co-pay, no alcoholic beverages; submit to search of person, property, house, residence, vehicle, officer, papers, computers, and other electronics or data storage devices

As happens in a vast majority of cases Peak was ordered to pay a special assessment $100.

When Peak was arrested as part of nine charged in a heroin ring, federal prosecutors issued the following press release:

Nine Defendants Charged in Connection with Heroin Distribution in Marinette County, Brown County and Menominee, Michigan

United States Attorney James L. Santelle of the Eastern District of Wisconsin, announced the filing of a criminal complaint alleging that nine people were involved with the distribution of heroin in Marinette County, Brown County and Menominee, Michigan. Brian L. King (age: 55) of Chicago was charged with Distribution of Heroin in violation of Title 21 United States Code, Section 841(a)(1), (b)(1)(B).

The other eight defendants listed in the table below are charged with conspiracy to distribution heroin in violation Title 21 United States Code, Sections 841(a)(1), (b)(1)(B), and Title 18 United States Code, Section 2.

According to charging documents it is alleged that King is responsible for the distribution of over 500 grams of heroin in the Marinette, Wisconsin, Green Bay, Wisconsin, and Menominee, Michigan areas. The others charged in the complaint are alleged to have conspired to fund, purchase, transport, distribute, and sell large amounts of heroin in northeast Wisconsin and Menominee, Michigan.

If convicted each defendant, faces a maximum penalty of between 5 and 40 years imprisonment, a maximum fine of $5,000,000, a $100 special assessment, and between 4 years to life on supervised release.

This case was a joint investigation by the Drug Enforcement Administration and the Wisconsin Department of Justice Division of Criminal Investigation with assistance from the Milwaukee and Chicago High Intensity Drug Trafficking Area programs, the Marinette County Sheriff’s Department, the Brown County Sheriff’s Department, the Marinette Police Department, the Menominee County Michigan Sheriff’s Department and the Menominee Michigan Police Department. It will be prosecuted by Assistant United States Attorney Daniel R. Humble.

A criminal complaint is only a charge and is not evidence of guilt. The defendants are presumed innocent and are entitled to a fair trial at which the government must prove each of them guilty beyond a reasonable doubt.
