11-28-17 5:45 p.m. ET Didn’t want to get so busy I forget to mention this that we heard about an hour ago in Chippewa County: A wrecker was called for an elderly gentleman whose tire was flat – a cop in Chippewa County (wish I knew his name and agency) radioed to cancel the wrecker – that he was going to fix the elderly man’s tire and save him cost of wrecker. Cops do many things each day to help people that you never hear about. So congrats to Chippewa County law enforcement – from city, county and state police agencies.

Updated: Methed Up Ride: Child molester that drove rambling wreck – a rolling three-vehicle pileup – allegedly while hauling a gun and meth through Marquette County

Update on Tuesday, Jan. 31, 2017 9 a.m. ET:

An initial hearing was held for the suspect – 39-year-old John Ramon Hauk  – in federal court in Marquette on Monday.

U.S. Magistrate Timothy P. Greeley ordered Hauk held without bond until a future hearing.

Hauk “appeared before the undersigned on January 30, 2017, for an initial appearance on the criminal com plaint dated January 27, 2017.”

The government moved for a detention supported by pretrial services. Hauk was advised of the charges, his rights – including a probable cause hearing – and a detention hearing set for later this week

(Marquette, MI) – A convicted Wisconsin child molester – who was driving the epitome of a rolling wreck through the Upper Peninsula while allegedly hauling meth and a gun – has been charged in federal court at Marquette, MI with being a felony in possession of a firearm.

john-ramon-hauk-2This morning 39-year-old John Ramon Hauk, whose last known address is 3rd Avenue in Ashland, WI is lodged in the Marquette County Jail for U.S. Marshals. Hauk was busted by a Michigan State Police Motor Carrier Division Trooper Wells, who pulled over his pickup truck in Ishpeming Township on Nov. 10, 2016

Hauk has has been charged by the feds in the Upper Peninsula of Michigan with being a convicted felon in possession of a firearm.

“The pickup was towing a car dolly which was towing/hauling a 2005 Chevrolet Malibu, 4-door (dark blue) sedan,” the federal felony complaint states. “Officer Wells conducted this traffic stop” because the vehicles were “not configured with the proper brake lights.”

Police also questioned two passengers in the pickup truck: Tracy Patrick Tungate (front) and Lacey Lynn Eliason (rear seat).

The truck, dolly and Malibu were towed by police request and inventoried.

“Small amounts of suspected loose marijuana was found on the seats and floor area inside the pickup truck,” the complaint states. Police found “a loaded (.40 caliber) pistol with six rounds of ammunition in a black holster in the console between the front driver and passenger seats.”

“Officers found a locked container on the rear floor of the vehicle behind the front seats,” the complaint alleges. “The locked container was forced open to reveal approximately 20 grams of suspected methamphetamine.”

The two passengers “denied knowledge” of the drugs and gun, the complaint states.

However, all three were taken into custody that day – and ultimately state narcotics charges were filed against the passengers and now this federal charge against the driver.

The gun is a .40 caliber – Kahr, Model CW 40.

The complaint alleges that Hauk denied ownership of the vehicle and weapon – saying they belonged to his “girlfriend” Kaycie Noel Offutt.

Hauk claimed he did not know anything about the alleged meth.

Hauk is a “multi-convicted felon and registered sex offender” after a 1998 conviction for felony 2nd degree sexual assault of a child in Milwaukee County, WI. Plus Hauk has a 2013 conviction for bail-jumping in Ashland County, WI. He also did not have a valid driver’s license.

A confidential source told federal agents that he gave Hauk even more .40 caliber ammunition while the suspect was visiting a residence on Brookwood Lane in Chocolay Township. A federal search warrant on the vehicle turned up a 100-round box of Remington .40 caliber ammo.

The felony criminal complaint against Hauk was filed on Thurs. Jan. 27, 2017 by veteran U.S. Bureau of Alcohol Tobacco and Firearms (ATF) Special Agent Raymond Petschke.

A Sault Ste. Marie man – whose explosives case made international headlines and sent him to prison – has now tossed a legal bomb charging bosses and deputies at the Marquette County Jail of violating his civil rights including withholding all his important legal mail.

He is seeking $75 million dollars minimum in actual and punitive damages.

This unsatisfied inmate had his case compared in international stories with having more than the Oklahoma City bomber.

John Francis Lechner was arrested by federal agents including the Bureau of Alcohol, Tobacco and Firearms (ATF) on On Sept. 21, 2011 “for alleged felony violations” including “illegal possession, storage and transfer of explosives,” the suit states.

A jury convicted John Francis Lechner of multiple counts of explosive related offenses, and he was sentenced to four years and three months in prison – aka 51 months incarceration – followed by three years supervised release.

He is suing the bosses and unknown turnkeys at the Marquette County Jail – but because of the way the legal system works – the suit also names the entire Marquette County Board of Commissioners – and the U.S. Marshals Service

John Francis Lechner federal civil lawsuit filed on Jan. 9, 2017: Entered into court records this week on Thurs., Jan 26, 2017 and released publicly Saturday.

“The defendants overall conduct” was “so outrageous that it shocks the moral and legal conscience of the community,” the lawsuit states. “This outrageous conduct resulted in’ Lechner’s “shameless and brazen denial” of his civil rights and resulting in his “malfeasant incarceration in a federal prison.”

“The manner, method and design” of those employed in the Marquette County Jail “amounted to cold, callous and premeditated abuse of legal authority,” the suit alleges.

The “defendants regularly acted maliciously, unjustifiably, vindictively and deliberately designed to cause” Lechner “mental and emotional harm, humiliation and denial of effective assistance from counsel, denial of a fair trial and knowingly withholding exculpatory evidence” from Lechner and his attorneys.”

The lawsuit states that there have “been previous incidents” involving other inmates who are also alleged victims of the non-delivery of legal mail.

Lechner alleges that Marquette County officials “committed a conspiracy” to not deliver his legal male, states the lawsuit under the “facts and allegations.”

The federal lawsuit says those name allegedly violated Lechner’s rights under the First, Fifth, Sixth, Eighth, and Fourteen Amendment amendments to the U.S. Constitution.

Lechner alleges he suffered “immediate and irreparable injury” and “ultimately causing wrongful incarceration in federal prison.”

Lechner “experienced extreme emotional distress, mental anguish, humiliation, degradation and severe emotional anguish.”

While in the Marquette County Jail, Lechner states he was housed in an “eight (8) man cell block” where he ate three times daily, laundry was cleaned three times a week, and he was allowed to use the commissary once a week.

However, Lechner was not happy with mail delivery – or lack thereof – no delivery of legal papers, the lawsuit alleges. The lawsuits accused jail officials of “sporadic, random, erratic and inconsistent delivery of inmate male by the staff of the Marquette County Jail.”

The lawsuits alleges the non-delivery of the legal correspondence from Lechner’s attorneys amounts to a violation of his constitutional rights. Marquette County jail officials “regularly, deliberately, unjustifiably and maliciously” interfered with Lechner’s First and Fourteenth Amendment Rights.

The undelivered mail involves legal paperwork from defense attorneys, that the suit describes as “intended for delivery on the same day.” Lechner alleges he did not find out about numerous legal mailings from his attorneys – all addressed to the Marquette County Jail – for 10 months beginning in Oct. 2011.

SAULT STE. MARIE, MICHIGAN MAN CHARGED WITH UNLAWFUL TRANSPORTATION AND POSSESSION OF EXPLOSIVES

MARQUETTE, MICHIGAN — U.S. Attorney Donald A. Davis announced today that Kenneth Ageed Kassab, age 53, a resident of Sault Ste. Marie, Michigan, was arraigned on April 19 in U.S. District Court in Marquette on charges of unlawful transportation of explosives and possession of explosives by a convicted felon. The superseding indictment (Link) alleges that these offenses took place in November 2010. Both charges carry a maximum penalty of up to 10 years in federal prison.

Kassab was listed in the superseding indictment (Link) as a co-defendant with John Francis Lechner, age 65, also a resident of Sault Ste. Marie. Lechner was originally the sole defendant in an explosives case stemming from the discovery of 4,200 pounds of a mixture of ammonium nitrate and fuel oil, commonly known as “ANFO,” and various other explosive materials, in September 2011. The superseding indictment, which replaces the original charges, repeats Lechner’s original charges and also adds charges relating to his possession of ANFO with Kassab in November 2010.

Lechner had been set to be tried on the original charges on May 21, 2012. With the addition of Kassab as a co-defendant, the trial date is likely to be rescheduled for later in the summer.

An indictment is merely an instrument to put the defendant on notice of the charges against him. The defendant is presumed innocent unless and until found guilty by a jury of his peers.

Second Michigan man arrested in explosives investigation

Suspected of possessing more than two tons of bomb-making materials

SAULT STE. MARIE, Mich. – A second man suspected to be involved in an explosives investigation was arrested Thursday by special agents with U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI), the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and deputies with the Chippewa County Sherriff’s Department.

Kenneth Kassab, 53, of Sault Ste. Marie, Mich., was taken into custody without incident Thursday on charges related to the unlawful transportation of explosives and possession of explosives by a convicted felon.

Both charges carry a maximum penalty of up to 10 years in federal prison.

Donald Davis, U.S. Attorney for the Western District of Michigan; David McCain, ATF special agent in charge in Detroit; and Brian M. Moskowitz, special agent in charge for HSI Michigan and Ohio, announced the arrest.

Feds indict third suspect – making point about Michigan out of control gun violence – Holland Hookah Lounge Murder – as two downstate shooting sprees affect the same family – victims in both unrelated cases including Uber driver

(Grand Rapids, MI) – The feds have filed felony charges against one of three suspects allegedly connected to a violent altercation that led to a murder at the Hookah Lounge in Holland, MI.

23-year-old Demetrius William Viney, Jr. of Grand Rapids, MI was named Tuesday, Jan. 17, 2017 in a two page federal complaint filed by the federal Bureau of Alcohol, Tobacco and Firearms (ATF).

Viney was first arrested on similar state charges – and was the third arrest in the Sept. 11 shooting death  involving the murder of 22-year-old Anthony Lamb outside the Hookah Lounge in Holland, MI.

Lamb’s family were also victims in last year’s widely publicized Uber driver shooting spree in Kalamazoo.

In fact, Viney was considered a second victim in the Holland shooting – and was arrested after being treated for a leg wound.

Viney allegedly had a weapon – but was not charged with the murder. 25-year-old Aaron Young (above left)  is charged with open murder, open manslaughter, carrying a concealed weapon. Meanwhile Adam Rene Young, 27, of Fennville, MI (above right) is accused of lying to police.

The complaint (scroll down to read it) states Viney allegedly committed “violations of, among other things”  the federal law against a “felon in possession of a firearm”

“Approximately 3:00 a.m. on September 12, 2016, Viney got into an altercation that resulted in the exchange of gunfire outside the Hookah Lounge in Holland, MI, ” states the felony criminal complaint filed by ATF Special Agent Geoffrey Yandl. “Detectives responded to the scene of the exchange of gunfire, and located a SCCY, model CPX-2, 9mm semiautomatic pistol under a rock at a nearby residence” and a “Michigan State Lab report determined that Viney’s DNA was present on the SCCY 9mm pistol.”

Gun violence has affected this family before.  murder victim’s half-sister, Tiana Carruthers,was shot during the February 2016 shooting rampage in the Kalamazoo area – and was one of only two survivors – as six others were murdered.

Lamb is survived by a 9-month-old daughter and a fund has been set up in her name.

CONTINUATION OF COMPLAINT
1. I, ATF Special Agent Geoffrey Yandl, have been employed as a Special Agent with the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) since 2007. I completed twelve weeks of Criminal Investigative Training and fourteen weeks of Special Agent Basic Training. My responsibilities include the investigation of criminal violations of Titles 18 and 21 of the United States Code. I am currently assigned to the ATF Field Office in Grand Rapids, Michigan.
2. The information in this criminal complaint is based on my personal knowledge gained from this investigation and other law enforcement agents. The information outlined below is provided for the limited purpose of establishing probable cause and does not contain all details or all facts of which I am aware relating to this investigation.
3. I am currently conducting an investigation of DEMETRIUS WILLIAM VINEY, JR., date of birth XX/XX/1993 (hereafter referred to as VINEY), for violations of, among other things, Title 18, United States Code, Section 922(g)(1) – felon in possession of a firearm.
4. I queried VINEY through the Law Enforcement Information Network (LEIN), which revealed MI SID number 4234035J, and the following Michigan felony convictions: December 9, 2013—Felony Police Officer Assaulting/Resisting/Obstructing (20th Circuit Court 13-037130-FH); May 13, 2015—Felony Possession of a Controlled Substance (20th Circuit Court 15-039034-FH).
5. At approximately 5:00 p.m. on September 11, 2016, VINEY was at the home of an acquaintance and displayed a handgun to that individual. The acquaintance disclosed this information to detectives.
6. At approximately 3:00 a.m. on September 12, 2016, VINEY got into an altercation that resulted in the exchange of gunfire outside the Hookah Lounge in Holland, Michigan. According to witnesses, VINEY pulled a handgun and shot it during that altercation.
7. Detectives responded to the scene of the exchange of gunfire, and located a SCCY, model CPX-2, 9mm semiautomatic pistol under a rock at a nearby residence. A Michigan State Lab report determined that VINEY’s DNA was present on the SCCY 9mm pistol. The SCCY, model CPX-2, 9mm semiautomatic pistol is consistent with the descriptions given by witnesses.
8. Based on my training and experience in determining how firearms travel through interstate commerce, the SCCY firearm was manufactured in the state of Florida. Therefore, it traveled through interstate commerce prior to its possession by VINEY.
9. The foregoing is provided in support of this complaint charging that DEMETRIUS WILLIAM VINEY, JR., a convicted felon, did knowingly and intentionally possess a firearm in violation of 18 U.S.C. § 922(g)(1).
