Update on Tuesday, Jan. 31, 2017 9 a.m. ET:

An initial hearing was held for the suspect – 39-year-old John Ramon Hauk  – in federal court in Marquette on Monday.

U.S. Magistrate Timothy P. Greeley ordered Hauk held without bond until a future hearing.

Hauk “appeared before the undersigned on January 30, 2017, for an initial appearance on the criminal com plaint dated January 27, 2017.”

The government moved for a detention supported by pretrial services. Hauk was advised of the charges, his rights – including a probable cause hearing – and a detention hearing set for later this week

(Marquette, MI) – A convicted Wisconsin child molester – who was driving the epitome of a rolling wreck through the Upper Peninsula while allegedly hauling meth and a gun – has been charged in federal court at Marquette, MI with being a felony in possession of a firearm.

john-ramon-hauk-2This morning 39-year-old John Ramon Hauk, whose last known address is 3rd Avenue in Ashland, WI is lodged in the Marquette County Jail for U.S. Marshals. Hauk was busted by a Michigan State Police Motor Carrier Division Trooper Wells, who pulled over his pickup truck in Ishpeming Township on Nov. 10, 2016

Hauk has has been charged by the feds in the Upper Peninsula of Michigan with being a convicted felon in possession of a firearm.

“The pickup was towing a car dolly which was towing/hauling a 2005 Chevrolet Malibu, 4-door (dark blue) sedan,” the federal felony complaint states. “Officer Wells conducted this traffic stop” because the vehicles were “not configured with the proper brake lights.”

Police also questioned two passengers in the pickup truck: Tracy Patrick Tungate (front) and Lacey Lynn Eliason (rear seat).

The truck, dolly and Malibu were towed by police request and inventoried.

“Small amounts of suspected loose marijuana was found on the seats and floor area inside the pickup truck,” the complaint states. Police found “a loaded (.40 caliber) pistol with six rounds of ammunition in a black holster in the console between the front driver and passenger seats.”

“Officers found a locked container on the rear floor of the vehicle behind the front seats,” the complaint alleges. “The locked container was forced open to reveal approximately 20 grams of suspected methamphetamine.”

The two passengers “denied knowledge” of the drugs and gun, the complaint states.

However, all three were taken into custody that day – and ultimately state narcotics charges were filed against the passengers and now this federal charge against the driver.

The gun is a .40 caliber – Kahr, Model CW 40.

The complaint alleges that Hauk denied ownership of the vehicle and weapon – saying they belonged to his “girlfriend” Kaycie Noel Offutt.

Hauk claimed he did not know anything about the alleged meth.

Hauk is a “multi-convicted felon and registered sex offender” after a 1998 conviction for felony 2nd degree sexual assault of a child in Milwaukee County, WI. Plus Hauk has a 2013 conviction for bail-jumping in Ashland County, WI. He also did not have a valid driver’s license.

A confidential source told federal agents that he gave Hauk even more .40 caliber ammunition while the suspect was visiting a residence on Brookwood Lane in Chocolay Township. A federal search warrant on the vehicle turned up a 100-round box of Remington .40 caliber ammo.

The felony criminal complaint against Hauk was filed on Thurs. Jan. 27, 2017 by veteran U.S. Bureau of Alcohol Tobacco and Firearms (ATF) Special Agent Raymond Petschke.

More exclusive information is coming out this weekend on that federal gun case filed this week – and that sources now say involved shooting up a home next to a day care center in Marquette Township.

With children reportedly present, 35-year-old Derrick Scott Jones  allegedly “shot up” his girlfriend’s house with that AK type weapon, sources say.

The AK-pistol incident allegedly happened on Nov. 18, 2016 at a Badger Street home in Trowbridge Park.

The shooting allegedly included dozens of bullets flying across the home including destroying a 70-inch LCD television set with nine rounds, a whirlpool hot tub; four walls and three doors, sources say

UPSET detectives arrived on the scene and took Jones into custody, sources say.

UPSET searched the home.

The suspect allegedly “shot up his safe” that allegedly contained mason jars used to allegedly store marijuana, sources say.

A single mom, with children home at the time, was said to have been terrified by the entire incident.

Feds Confiscate Semi-Automatic AK-47 Style Assault Pistol and 170 rounds of ammo

A Marquette County man who the feds say had no business with guns – has been indicted for allegedly having an AK-47 style pistol and 170 rounds of ammunition.

35-year-old Derrick Scott Jones was indicted by a federal grand jury in Marquette. MI

A check indicates he lives in Trowbridge Park, however his name is so common even Facebook has dozens of profiles under his name.

Jones is being held today at the Marquette County Jail under a contract with U.S. Marshals.

The indictment also includes a forfeiture demand of the weapon plus 170 rounds of ammo.

The feds want to a seize the gun confiscated – described as an AK-47 style assault pistol – specifically: a semi-automatic C.N. Romarm/Cugir, Model Draco, 7.62x39mm caliber pistol

The feds also seized approximately 170 rounds of 7.62x39mm caliber ammunition, the indictment states.

I think it was likely “Suicide by Cop” yesterday in west Ishpeming.

But there are many very serious questions in the aftermath of the shooting of a despondent elderly west Ishpeming man in chronic pain.

Mqt_Cnty_Sherriff_LogoThe shooting by a Marquette County Sheriff’s Dept. deputy painfully shows the Upper Peninsula – like access to U.P. public records – is light years behind the rest of the nation when it comes to readily available non-lethal force.

Officers should be trained to defuse and back off – call in experts. That obviously was not done – every cop should have backed out.

Why did it take 30 minutes to rush the victim to the hospital?

There is an old saying in the paramedic game – yes you do CPR, yes to shock (defibrillator) if needed but you always “scoop and run.”

Why are Upper Peninsula law officers not better trained in non-lethal force – and to back out – not increase the drama?

With all of today’s non-lethal force avenues – those who fund – or do not fund – nonlethal force in the Upper Peninsula should be ashamed. Again money over people.

The first media on the scene, Upper Peninsula Breaking News had been on the shooting location roughly five minutes or longer when – all of a sudden – out of the blue – a somewhat grumpy Michigan State Trooper began shouting at me.

The bristly trooper shouted that cops were going to cordon off the scene. While the tape shows the trooper used the proper polite words – he then started giving me a “count to five” or I presume he would have arrested me.

I get it – there is a syndrome called Suicide by Cop – especially if there is a sadness, poverty, loneliness and chronic pain (today little is done to help those who legitimately need pain relief due to the epidemic of pill heads).

Over the past two years, the rash of suicides across the Upper Peninsula and in Marquette County is stunning.

Now all but completely inept Pathways Community Mental Health has little funding or tools to do much about it. I believe Pathways employees care – and the administration plays the cards they are dealt from Lansing – but the system is a joke.

So I can believe that this elderly guy may have wanted to be shot by the cops – not sure – but it is certainly plausible.

U.P. Breaking News has been conducting an investigation of how Pathways is letting the public down through fewer services, lack of funding (budget cuts) and mismanagement.

U.P. Health System logoUpper Peninsula Health System Marquette is benefiting greatly from financial-clumsiness of Pathways.

For example, for just one client/patient it is costing the state hundreds of thousands of dollars.


U.P. Health System Marquette paramedics (ambulance runs cost $1,400 or so per incident) – have responded to an estimated/roughly 100 calls over past two years for this one client.

U.P. Health System Marquette – a Duke LifePoint Hospital that has saved lives in the U.P. – also stands to make hundreds of thousands of dollars on this patient alone.

At issue is weekly calls to the same residence on the 8th floor of Pine Ridge Apartments in Marquette because of a male Pathways client in his early 20’s who suffers from chronic panic attacks and other issues – and yet it housed near the top of Pine Ridge Apartments.

Why hasn’t the Marquette Housing Commission – which oversees Pine Ridge – addressed this and other issues.

Pine Ridge Apartments used to be for the low income elderly – now it is a dumping ground for Pathways clients.

U.P Breaking News calls for the state of Michigan and U.P. Health System Marquette (Duke LifePoint) to account for this improperly handled situation – one of many.

By not addressing the needs of this client, Pathways has also wasted the resources of the city of Marquette Fire department and the city of Marquette Police Department – who often are sent to the call.

Its actually a painful joke at 911 Central Dispatch because this reporter has heard many dispatchers put out the call on the radio in a somewhat sarcastic way – and who can blame the !!!

They care at Marquette County Central Dispatch – but Pathways is asleep at the wheel thanks to the Snyder Administration that shows little care for those with mental health and poverty issues.

Remember the Snyder Administration poisoned a generation of low income kids in Flint and elsewhere. A state scapegoat or two have been arrested – but its common knowledge among Snyder Administration employees know you do not dissent or challenge their boss’s political ideas. Plus the U.S. EPA should be ashamed at the very least.

Numerous friends and relatives of suicide victims have told U.P. Breaking News that Pathways is letting down the public.

There are many horror stories at Pathways since budget cuts under the Snyder Administration.

This is just one terrible, sick incident:

Did you know – a Pathways contracted home for clients in Ishpeming where the woman in charge was feeding moldy sandwiches to blind pathways patients in her case – many thought that was oddly ironic since she was extremely morbidly obese at the time – and this reporter has dealt with weight issues.

We mention the obesity because she was repeatedly feeding the MOLDY SANDWICHES. I dare the state to deny the moldy sandwiches as a half-hearted state probe was conducted.

The investigation is being handled by Michigan State Police and will be reviewed by the Marquette County Prosecutor’s office.

U.P. Breaking News strongly urges these officials to not simply state the shooting was justified – but rather identify and investigate the system problems with non lethal force, inept and wasteful Pathways services to those with depression, and how those in the entire top to bottom mental health response system not only allows it to happen but profits from it.

In fact – if there was ever a time to form a grand jury it is now – to find out what happening to those who need our help the mostbut are being failed by the system.

This is why we need a regular Grand Jury system in Michigan – in other states state and local grand juries make findings and demand probes – when local bureaucrats and politicians do not have the courage.

The poster child for misuse of grand juries is said to be the Upper Peninsula:

In fact, the infamous and violent 1913 copper miners strike and related uprisings in the U.P. is being credited with starting the use of grand juries for political revenge with politically powerful company bosses vs miners in Michigan, according to a newsweek story.

The forces that ran the local government, who were almost unanimously pro-management, evaded justice for the bulk of their crimes. They did this by manipulating the legal process. Of particular note: They rigged a grand jury into failing to indict for some very public and obvious crimes.

If political bosses and officials do not do their job – someone has to.

Charles Lee Turner pleaded guilty on Wed., August 6, 2014 at U.S. District Court in Marquette to a superseding indictment of felon in possession of a firearm including a Luger-style pistol similar to the leftovers of WWI and WWII.

U.S. Magistrate Judge Timothy P. Greeley accepted the guilty plea by Martin, that is expected to be formalized by a U.S. District Court Judge.

A federal grand jury in Marquette returned the indictment in June of 2014 that states the incident happened on or about April 23, 2014 in Dickson County.

Turner claims to have “found” two handguns that he sold this past spring.

The Indictment mentions a Walther Model PPK 7.65 MM caliber semiautomatic pistol and a Mauser model S/42, 9 mm caliber, (German) Luger-type pistol.

Martin “has a criminal history in five different states,” said Asst. U.S. Attorney Maarten Vermaat.

Martin’s criminal history includes “a violent felony drug offense,” Vermaat said.

“A man called the Dickinson County Sheriff’s Department and said he bought two handguns from Mr. Turner,” Vermaat said.

Martin told authorities “he found the handguns” and was “short of cash” so he “sold” the guns in Dickinson County during April 2014, Vermaat said.

Previous Martin felony convictions include possession and distribution of LSD in Minnesota during 1988 and breaking and entering, assault, larceny unlawfully driving away an automobile (auto theft), and being a habitual offender in Delta County during 2004.

Greeley scheduled the Martin’s sentencing for 1 p.m. on Nov. 5.

Charles Turner, gun, Dickinson Cnty 8-6-14 Indictment Scan #1At issue, is how Martin’s previous convictions will affect his time in prison – because those convictions will affect his offense level involving federal sentencing guidelines.

U.S. Assistant Public Defender Elizabeth “Beth” LaCosse, the prosecutor and judge briefly discussed ways that the point system – used to calculate proposed prison time under federal sentencing guidelines – can be calculated in several ways.

Federal judges often use the guidelines but can hand down a stronger or lesser jail sentence plus supervised release, fine and related costs.

It appears those federal guidelines could fall anywhere between 1 year and 10 to 15 years – including 15 to life. The guidelines will be included in a pre-sentence report being drawn up by the Michigan Western Probation Office Marquette Divisional Office (federal probation office).

Because Martin’s ultimate sentence will decided by a federal judge – Magistrate Judge Greeley reminded the man before accepting his plea – that he was still “presumed innocent” and was about to “give up his rights” including to a jury trial, plus will “be bound by his (guilty) plea.”

Martin cannot “withdraw his plea if a harsher or longer sentence” is handed out by a federal judge,” Judge Greeley said.

Martin entered into a nine-page plea agreement with federal prosecutors signed on August 4.

Under the agreement, the government is willing to agree to the low-end of sentencing guidelines brought forth in the pre-sentence report, Vermaat said.
