(Marquette, MI) – Two snowmobilers were rushed to the trauma center in Marquette, MI late today after separate crashes in Baraga and Keweenaw counties – and one sledder was in critical condition.

The worst crash was reported tonight in Keweenaw County.

An out-of-state woman was critically injured when she lost control of her sled in a curve and crashed into trees. The snowmobile received relatively light damage, however the sledder received multiple trauma-related injuries.

The crash happened on snowmobile Trail Number 134 near Madan Location.

The 28-year-old female victim was rushed to Aspirus-Keweenaw Hospital, and transferred a short while ago to U.P. Health System-Marquette suffering from multiple critical trauma-related injuries – and troubling vitals.

Those officials assisting on the scene included the Keweenaw County Sheriff’s department, Ahmeek Search and Rescue and Peninsula Auto Repair Towing and Recovery.

The crash is a tragic example of how a sledder can receive horrible injuries – and the snowmobile itself is barely scratched. female victim has “major trauma, multiple injuries.”

Meanwhile in Baraga County:

A rescue lasting almost two hours occurred in Baraga County this afternoon to get an injured snowmobiler off the trail.

The snowmobile crash was dispatched at 2:12 p.m. this afternoon, Wed., Jan. 17, 2018. The Bay Ambulance Service paramedics transported the victim to the Baraga hospital – and some EMS officials reportedly used snowmobiles to get on the trail.

The crash was reported on snowmobile Trail Number 15 near 14488 Arnheim Road near Pelkie, MI in Baraga Township.

While transporting the victim to U.P. Health System-Marquette, paramedics told doctors via radio that the victim suffered a shoulder fracture and a dislocated right ankle. All painful but not life-threatening injuries.

There have been five snowmobile fatalities in the past month across the Upper Peninsula. The latest victim – a 51-year-old Saginaw, MI man, was killed yesterday Tues., Jan. 16, 2018 in Chippewa County when he lost control in a curve and hit a tree in the eastern U.P. just south of famed White Fish Point.

(Upper Peninsula of Michigan) – An accident that heavily damaged three vehicles in Negaunee was one of this morning’s accidents across northern Michigan as treacherous roads are expected from a storm that is walloping the Upper Peninsula.

About a dozen motor vehicle rollovers have been reported since Saturday across the U.P. plus numerous snowmobile accidents and even a burned sled.

Only minor injuries were reported in the wreck that happened at abut 7:30 this morning at U.S.-41 and Baldwin Avenue in Negaunee, MI causing airbags t0o deploy – often resulting in a painful chest bruising – as airbags save your life (I know) but can cause also neck and spinal injuries.

The wreck caused a major morning commute traffic jam as did other accidents in Ishpeming and on M-94 in Marquette County and on the famous but slippery Quincy Hill in Hancock, MI in the Copper Country where cars were sliding this morning and a semi tractor trailer truck jackknifed.

There have been numerous snowmobile accidents across the U.P. in past three days including one in Alger County on Monday, Feb. 6, 2017 that sent a man to Marquette General Hospital with a broken armed and other injuries. The victim crashed his sled reportedly traveling about 55 to 60 miles per hour and hit a bad spot on the trail throwing the victim. His injuries were serious but not life-threatening.

Meanwhile, trail groomers in the Copper Country this morning are reporting a snowmobile burned to a crisp and the sled skeleton was left along the trail.

“There is nothing left,” said one groomer this morning. “Looks like a rental.”

Blinding snow caused numerous accidents on Saturday, Feb. 4, 2017 after the snowmobile races in the Soo area. Chippewa County law enforcement was kept busy by at least two snowmobile accidents and other wrecks – including a woman who rolled her sled on top of her – and was taken to War Memorial Hospital with painful injuries including possible seriously broken bones

It was one of several accidents that occurred in whiteout conditions in the eastern U.P. on Saturday, Feb. 4, 2017. Another involved a man who was taken to the hospital after his vehicle flipped several times in Chippewa County during the storm.

The blinding whiteout conditions were in so bad that police had to drive a woman and her children back to Sault Ste. Maire, MI after the driver had a panic attack and did the smart ting – pulled over and called for help.

Several groomers in the Houghton/Keweenaw trail system reported that it was mainly rental sleds on Monday describing as all looking the same.

This weekend, near Boot Jack an accident involving a snowmobile trailer caused a mess but no serious injuries. Not clear if the sled inside the trailer were also destroyed.

Meanwhile early yesterday morning (Mon., Jan. 6, 2017) ) a 54-year-old Escanaba women was transferred to a Marquette MI hospital after being seriously injured in a two-vehicle crash near the Highland Golf Club and railroad tracks on U.S.-2 in Ford River Township – that saw her SUV flip into numerous trees.

The Jaws of Life was used to extricate the woman and she was later transferred to U.P. Heath System in Marquette with numerous serious injuries. Police say the woman was eastbound when her SUV crossed the center line and struck an oncoming vehicle driven by a 21-year-old Bark River Man – who was fortunate to escape with only minor injuries.

The accident at about 11 p.m. Sunday night caused a major traffic jam. While authorities were extricating the victim – another rollover accident was reported nearby on one of the side streets. No one was found in that vehicle.

U.P. Breaking News has been contacted by dozens of current and former corrections officers plus the families of inmates about the short-staffing, a real concern of another riot and COs being killed, plus numerous unexplained and suspicious deaths of young inmates.

Two attacks at the Marquette Branch prison – in the finals months of 2016 – injured three corrections officers. The state has refused to confirm the second attack reported exclusively by U.P. Breaking News on New Year’s Eve just hours before 2017.

Having said that, U.P. Breaking News has been contacted about suspicious numerous deaths in the past two years at the Marquette Branch Prison. U.P. Breaking News documented the death of a 30-year-old Saginaw inmate in Marquette Branch.

Our investigation shows that the Marquette Branch Prison corrections officers did not even call ambulance for the young man in a segregation cells – claimed to perform CPR for 45 minutes, apparently re-positioned the body and lied to Michigan State Police investigators.

Then an officer tried to get a U.P. Health System doctor to declare the inmate dead over the radio sight unseen.

That inmate is 30-year-old Derrick Siminski of Saginaw, MI – who would have been paroled soon and was in prison on marijuana charges.

Our investigation shows that MSP should consider arresting some of the corrections officers involved in the incident.

A federal lawsuit was just filed in the 2014 hanging of a Marquette inmate was allegedly met without concern or care by corrections officers.

Below read the 14-page, three-count federal court civil suit filed by the estate of an inmate who hung himself – while corrections officers allegedly did little or nothing to help him – and allegedly encouraged the man to kill himself.

This lawsuit had been filed earlier in Marquette County Circuit Court, however the U.P. media never asks about what is happening in the clerk’s offices across the U.P. – where public records cost 100 times more than the charge by the feds for public records. In a normal area, the lawsuit would have been printed in the local newspaper.

U.P. Breaking News has battled the U.P. county court system – and in addition to high fees – they delay delay delay. Many counties actually use public records to boost their general fund – in violation of state law.

Another shocking fact, after reviewing literally dozens and dozens of federal lawsuits – it seems that U.P. prisoners – never – ever – ever win – not even once. Federal judges never side with U.P. prisoners.

The suit was filed on Wednesday, Jan. 25, 2017 on behalf of the estate of inmate Jeremy Alan Garza.

The lawsuit names the warden, two deputy wardens and three corrections officers (scroll down to read the shocking allegations). Named are MBP Warden Robert Napel, Deputy Warden Alexander, Deputy Warden Shane Place, and corrections officers Daniel Kessler and Yvonne Whitney.

The suit alleges that corrections officers taunted the psychiatric inmate to kill himself – and he did on April 10, 2014.

The suit states:

Garza “was found hanging in his cell around 11:05 a.m. … That at 11:55 a.m. Garza was pronounced dead.”

” Jeremy Garza died as a result of Defendants” refusal “to respond to Garza’s safety complaints.”

Many questions are being raised tonight by those shock about the deaths of at least two U.P. prison inmates over the past week in the eastern U.P. The events occurred at the Chippewa Correctional facility and the riot-torn Kinross correctional Facility.

U.P. Breaking News has learned that inmates are being accused of causing the Kinross Riot – even though the state went to great lengths to say it was not a riot.

Plus three inmates were down in one night at the two state prisons in Chippewa County – including one who took a unknown amount of pills (that alone is alarming).

NOW COMES Plaintiff, DARREN FINDLING, as Personal Representative for the Estate of JEREMY ALAN GARZA, deceased, by and through his attorneys, JOHNSON LAW, PLC and for his Complaint against the above-named defendants, states as follows

JURISDICTION
1. That this action arises under the United Sates Constitution, particularly under the provisions of the Fourteenth, Fourth and Eighth Amendments of the United States Constitution and under the laws of the United States, particularly under the Civil Rights Act, Title 42 of the United States Code, Sections 1983 and 1988.
2. That this court has jurisdiction of this cause under the provisions of Title 28 of the United States Code, sections 1331 and 1343 and pendant jurisdiction over state claims which arise out of the nucleus of operative facts common to Plaintiff’s federal claims.

3. That Plaintiff brings suit against each and every Defendant in both their individual and official capacities.
4. That each and all of the acts of the Defendants set forth, MICHIGAN DEPARTMENT OF CORRECTIONS, WARDEN ROBERT NAPEL, DEPUTY WARDEN ALEXANDER, DEPUTY WARDEN SHANE PLACE, CO WAGNER, CO AARON VITALA, CO YVONNE WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, were done by the Defendants under the color and pretense of the statutes, ordinances, regulations, laws, customs, and usages of the State of Michigan, and by virtue of and under the authority of the Defendants’ employment with the State of Michigan.

5. That the MICHIGAN DEPARTMENT OF CORRECTIONS, is responsible for, and does in fact, hire train, supervise, and instruct wardens, deputy wardens, sergeants and correctional officers of all grades in the performance of their duties.
6. The amount in controversy exceeds $75,000.00, exclusive of Plaintiff’s claims for costs, attorney fees, interest and punitive damages.
PARTIES

7. Plaintiff’s decedent, JEREMY ALAN GARZA (“GARZA”), was a citizen and resident of Alma, County of Gratiot, State of Michigan and of the United States and is entitled to all rights, privileges, and immunities accorded to all citizens of the United States.
8. That Defendant MICHIGAN DEPARTMENT OF CORRECTIONS (“MDOC”) is formed pursuant to the laws of Michigan, and one of the functions of the MDOC is to organize, train, operate and staff correctional officer personnel in correctional facilities.
9. That Defendant WARDEN ROBERT NAPEL (“NAPEL”) , based on information and belief, is or was employed by the Michigan Department of Corrections as warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
10. That Defendant DEPUTY WARDEN ALEXANDER (“ALEXANDER”), based on information and belief, is or was employed by the Michigan Department of Corrections as deputy warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
11. That Defendant DEPUTY WARDEN SHANE PLACE (“PLACE”), based on information and belief, is or was employed by the Michigan Department of Corrections as deputy warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
12. That Defendant CO WAGNER (“WAGNER”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

13. That Defendant CO AARON VITALA (“VITALA”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
14. That Defendant CO YVONNE WHITNEY(“WHITNEY”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

15. That Defendant CO ROBERT LAFOREST(“LAFOREST”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, Case 217-cv-00018-GJQ-TPG ECF No. 1 filed 012517 the State of Michigan, and the United States.
16. That Defendant CO CUCCHI (“CUCCHI”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

17. That Defendant SGT. BUSH (“BUSH”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
COMMON FACTUAL ALLEGATIONS
18. Plaintiff hereby re-alleges each and every allegation in paragraphs 1 through 16 of this Complaint as if fully stated herein.
19. That GARZA was incarcerated at the Marquette Branch Prison, Level V.
20. That GARZA suffered from a psychiatric condition that Defendants failed to treat properly.
21. On April 10, 2014, the Michigan Department of Corrections records indicate that GARZA had a visitation with his mother Barbara Garza around 830 a.m. and that the visitation concluded at approximately 1030 a.m.
22. That after returning to his cell, GARZA observed Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, removing personal items from his cell for no apparent reason.
23. That GARZA complained to the Defendants, that they should leave his personal belongings alone, but they refused and gave no explanation as to why they were removing his belongings.
24. That as a result of the Defendants behavior, GARZA told the Defendants that he was going to kill himself.
25. That Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, started to laugh at GARZA and told him to “go ahead and do it”.

26. That on April 10, 2014, the Michigan Department of Corrections records indicate that GARZA was found hanging in his cell around 1105 a.m.
27. That at 1155 a.m. GARZA was pronounced dead.
28. Jeremy Garza died as a result of Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, refusal to respond to GARZA’s safety complaints.

COUNT I 42 USC 1983 CONSTITUTIONAL DEPRIVATIONS

29. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 27 of this Complaint as if fully stated herein.

30. That the action and omission of acts by the Defendants under 42 USC Section 1983 was unreasonable and performed knowingly, deliberately, intentionally, maliciously, with gross negligence, callousness, and reckless indifference to Plaintiff’s well-being and in disregard of Plaintiff’s safety, with wanton intent for Plaintiff to suffer the unnecessary and intentional infliction of pain, failure to obtain timely medical treatment, and failure to properly train, supervise, develop and implement policies providing adequate medical and psychiatric treatment to an inmate and by reason of which Plaintiff is entitled to compensatory and punitive damages.

31. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, deprived Plaintiff’s decedent, GARZA, of his clearly established rights, privileges and immunities in violation of the Fourth, Eighth and Fourteenth Amendments of the Constitution of the United States, and of 42 USC Section 1983.
32. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, exhibited a deliberate indifference by intentional acts, gross negligence andor engaging in omissions to breach Plaintiff’s public safety and causing constitutional deprivation of his individual rights to wit

a. Failure to properly prescribe and monitor the appropriate medications for a mentally ill prisoner;
b. Failure to render the proper medical attention to a prisoner who was mentally ill;
c. Failure to properly train correction officers in the evaluation of whether a inmate needs medical treatment;
d. Failure to transfer Plaintiff’s decedent to a hospital to receive the necessary medical care;
e. A reasonable correction officer in Defendants’ position at the time of this incident prior to the decedent’s death, would have known that in light of the pre-existing law, that the unlawfulness of ignoring Plaintiff’s suicidal ideation statement was apparent and to ignore it under those circumstances would be a violation of that clearly established law;
f. Any and all other breaches as they become known throughout the course of this litigation.
33. That as a direct and proximate result of the aforementioned conduct and omissions of Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State Case 217-cv-00018-GJQ-TPG ECF No. 1 filed 012517 PageID.7 Page 7 of 14
of Michigan, Plaintiff’s decedent, GARZA, suffered pain, anguish, and ultimately death.
WHEREFORE, Plaintiff requests the following relief
a. Reasonable medical, funeral and burial expenses;
b. Conscious pain and suffering between the time of his injury and his death;
c. Loss of financial support;
d. Loss of service;
e. Loss of gifts or other valuable gratuities;
f. Loss of comfort, society and companionship;
g. Compensatory and punitive damages; and
h. Any and all other damages otherwise recoverable under USC Section 1983 and Section 1988.
COUNT II FAILURE TO TRAIN, INADEQUATE POLICIES ANDOR PROCEDURES, CUSTOMS AND PRACTICES AND FAILURE TO SUPERVISE- DELIBERATE INDIFFERENCE- MICHIGAN DEPARTMENT OF CORRECTIONS

34. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 33 of this Complaint as if fully stated herein.
35. Pursuant to 42 USC § 1983, as well as the Fourth and Fourteenth Amendments to the United States Constitution, Defendant MDOC owed GARZA certain duties to properly supervise, monitor and train its correctional officers and staff so as to monitor and supervise the jail’s prisoners so that they would detect serious medical conditions and facilitate prompt and immediate medical attention and/or transport to a hospital ER.
36. That Defendant, in its representative and official capacity, has maintained a custom and policy of improper training and supervision of its employees. Defendant is not protected by governmental immunity when following a policy that deprives individuals of their constitutional rights. Monell v N.Y. City Dep’t of Soc. Servs., 436 658, 690-91, 692 (1978).

37. That Defendant MDOC, was aware of previous incidents where individuals who were incarcerated at the Marquette Branch Prison were not afforded proper medical treatment, specifically as to mental health referrals and observations.

38. That Defendant MDOC was aware of the custom and practice of corrections officerswardens, deputy wardens andor staff ignoring suicidal ideation statements, similar to the actions of Defendants, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH.
39. The Defendant owed GARZA the following duties and obligations

a. To use due care and caution;
b. To adequately and properly promulgate guidelines and policies that comply with the requirements of 42 U.S.C. § 1983 regarding the incarceration of prisoners and the supervision of prisoners, especially those who are mentally and emotionally and physically unstable and especially those who are diagnosed as having psychiatric or psychological problems;
c. To adequately and properly train and supervise correction officers and employees of the Marquette Branch Prison under their supervision on the proper method of supervising prisoners and providing for their medical needs and on effectively controlling prisoners who have or are suspected to have psychological or psychiatric problems;
d. To avoid hiring or selecting individuals who it knows or should know are incapable of performing their responsibilities or who are likely to misuse or abuse the power conferred on them as employees of the Marquette Branch Prison.
40. MDOC breached these duties via its policies, procedures, regulations, customs andor lack of training and thus exhibited a reckless indifference toward its prisoners, and GARZA specifically, in the following ways, including but not limited to

a. MDOC’s failure to staff the jail with competent medical personnel so that a mental health professional;

b. MDOC’s failure to monitor their correctional officers and medical personnel to ensure that they adequately monitor and supervise inmates who have serious medical needs;
c. MDOC’s failure to have proper policies and procedures, and training to deal with inmates in the observation cell and ensure that the policies andor procedures are followed, which include serial examinations by competent and licensed medical and mental health personnel like RNs , Psychologists andor Doctors as well as its failure to ensure the correctional officers conduct timely and adequate rounds and record their observations of the inmates every 15 minutes as required by their own policies andor procedures;
d. MDOC’s failure to require that an RN, Doctor or Mental Health Professional perform a full and complete examination of a prison held in a medical observation cell, at least once per day;
e. MDOC’s failure to have proper policies and procedures in place to deal with jail overcrowding in the high observation units of the facility;
f. MDOC’s failure to fully investigate and discipline its correctional officers andor medicalmental health personnel who do not abide by its policies and procedures relative to providing medical care for serious conditions; and,
g. All other breaches learned through the course of discovery.
41. That Defendant MDOC trained their officials andor employees and agents in such a reckless and grossly negligent matter, that it was inevitable that the officials would place a suicidal prisoner in a cell where she would not be supervised when it was obvious that such a prisoner needed constant supervision. Notwithstanding GARZA’s contemplation of suicide, Defendant repeated and acquiesced in the continued practice of not placing potentially suicidal prisoners, such as GARZA, under close supervision and acquiesced in the repeated and continued practice of not adequately treating suicidal inmates in obvious need of treatment.

42. The failure of the Defendant to provide training and supervision regarding the prevention of suicides amounts to deliberate indifference to the safety and lives of the inmates of the Marquette Branch Prison and particularly GARZA.

43. Defendant MDOC is a supervisory official who knew or in the exercise of reasonable care should have known that individual prison officials had engaged in misconduct and other violations of the constitutional rights of prison inmates at the Marquette Branch Prison, more specifically of GARZA.
44. Despite knowledge of its aforesaid pattern and practice, the Defendant failed to properly investigate the improper practices and to supervise and train the prison officials at the MDOC.

45. Defendant MDOC developed a “hands off” policy or custom with regard to the omissions of individual prison officials which encouraged the individual officials to believe they could violate the constitutional rights of GARZA with the explicit or tacit approval of the Defendant herein.
46. As a direct and proximate result of the above cited violations of GARZA’s civil rights by Defendant, GARZA died and thus his estate, through Darren Findling, has and will continue to suffer damages in the future, including, but not limited to

a. Reasonable medical, hospital, funeral and burial expenses;
b. Reasonable compensation for the pain and suffering undergone by GARZA while he was conscious during the time between his first psychiatric symptoms and his death;
c. Loss of financial support;
d. Loss of service;
e. Loss of gifts or other valuable gratuities;
f. Loss of comfort, society and companionship;
g. Compensatory and punitive damages; and
h. Any and all other damages otherwise recoverable under USC Section 1983
and Section 1988.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter judgment in his favor and against Defendant, including punitive damages under 42 U.S.C. § 42, in excess of $75,000.00 together with interest, costs and attorney’s fees.

COUNT III NEGLIGENCE AND GROSS NEGLIGENCE

47. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 46 of this Complaint as if fully stated herein.
48. That acts and conduct of Defendants alleged in the above stated cause of action when considered under the laws of the State of Michigan, constitute gross negligence and the Defendants are not entitled to the immunity of MCL 600.1407(2) because they were grossly negligent.
49. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, exhibited a deliberate indifference by intentional acts andor omissions amounting to gross negligence.

50. At all relevant times, Defendants, were grossly negligent in one or more of the following ways

a. Failure to properly prescribe and monitor the appropriate medications for a mentally ill prisoner;
b. Failure to render the proper medical attention to a prisoner who was mentally ill;
c. Failure to properly train correction officers in the evaluation of whether a inmate needs medical treatment;
d. Failure to transfer Plaintiff’s decedent to a hospital to receive the necessary medical care;
e. A reasonable correction officer in Defendants’ position at the time of this incident prior to the decedent’s death, would have known that in light of the pre-existing law, that the unlawfulness of ignoring Plaintiff’s suicidal ideation statement was apparent and to ignore it under those circumstances would be a violation of that clearly established law.
e. Any and all other acts of gross negligence as they become known throughout the course of this litigation.

51. That as a direct and proximate result of the aforementioned conduct and omissions of Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, Plaintiff’s decedent, GARZA, suffered pain, anguish, and ultimately, death.

WHEREFORE, Plaintiff, Darren Findling, as Personal Representative of the Estate of Jeremy Alan Garza, deceased, respectfully requests this Honorable Court enter Judgment in their favor and against Defendants jointly and severally, an amount in excess of $75,000, pursuant to 42 U.S.C. § 1983, exclusive of costs, interest, attorney fees, and punitive damages.

General  

 Marquette Branch Prison  was authorized by the Michigan State Legislature in 1885. The prison was subsequently built on the shores of Lake Superior on property that was a gift to the State from the Marquette Businessmen’s Association. The prison was completed in 1889 at a cost of less than $200,000.
The Level V portion of the prison has three General Population housing units and three Administrative Segregation housing units. There are four Level I housing units which are located just outside the Level V portion of the facility. 

Programming


 Adult Basic Education and General Education Development completion are offered.  Other programs include substance abuse treatment and religious services.  Available activities include law library, general library and hobbycraft.  Many program resources are expanded through participation by community volunteers, such as local clergy and lay people, which gives prisoners increased opportunities to participate in programs.
Prisoners are provided with on-site routine medical and dental care. Serious problems are treated at the department’s Duane L. Waters Health Care in Jackson. Emergencies can be referred to a local hospital.

Security  


 The Level V perimeter is protected with a concrete wall, razor-ribbon wire, electronic detection systems, and eight gun towers. Level I is surrounded by two chain link fences and an electronic detection system.

Currently the Mackinac Bridge is closed to all traffic. We are experiencing falling ice from the cables and towers on the bridge.

Motorists are advised to reduce their speed to 20 miles per hour as they approach the bridge and be prepared to stop. Bridge personnel are stationed at both ends of the structure to provide instructions.

The Mackinac Bridge Authority is monitoring the conditions at various points along the structure. When conditions improve, the bridge will be reopened to traffic. If you are planning to travel to the Straits area, please tune to AM 530 or 1610.

Update 7:25 a.m. CT/8:25 a.m. ET – URGENT IRONWOOD TOWNSHIP, MICHIGAN – AND WATERSMEET, MI US-2 CRASH

Officials are at the scene of a rollover accident on U.S. Highway 2 just – one mile west of Highway 45 – just outside of Watersmeet, MI.

One male (a big gentleman) and one female with a head injury were able to get out of the overturned vehicle.
The roads in Gogebic County and elsewhere “are terrible,” according to a dispatcher sending Watersmeet Rescue units

There is a big icy mess everywhere across the U.P. now – as trees fall and powerlines droop.
There is lots of police traffic about trees and powerlines down on Sunset Dr.
“There are lots of police, ambulance and fire trucks around, and they are sliding all over the place,” said a snowplow driver attempting to help at one of the aftermath locations in Gogebic County.

Flooding of low lying areas also said to be an issue.

Currently we are experiencing winds of sufficient force in the Straits area to issue a warning to all motorists preparing to cross the Mackinac Bridge.

(Upper Peninsula of Michigan) – After Christmas traffic accidents – and vehicles sliding into snowbanks – were being reported as a deadly wintry mix of ice, sleet and snow was slamming the highways and roads across the Upper Peninsula of Michigan.

Plus – the storm behind this storm – and the one behind that – are on their way here. All are winter storms that will eventually reach the U.P.

Just as snowplow drivers were reporting heavy blowing snow – minutes later it was turning to rain – then ice.

Snowplows were reporting heavy snow in some areas – while in others it is sleeting a deadly ice/rain mix. Ice is covering trees, roads and everything in some areas. Delay all travel. Don’t drive.

But – law enforcement, snowplow drivers, EMTs, paramedics, firefighters and others have to drive to keep you safe – and incredibly a “transplant” team was reported leaving U.P. Health System –  Marquette via a plane. So even doctors, nurses and all support staff had to be there for the unknown transplant.

In fact, it appears the U.P. will get hit with several severe winter storms over next few days – what’s happening to the west – like Minnesota and Wisconsin – is headed to the U.P.

But the immediate threat is the roads are too slippery for travel. Period. Additional plows are being called-in to help, but the driving is treacherous.

A two-vehicle accident involving an off-duty Northern Michigan University police officer was reported about 10:30 p.m. Christmas night at the intersection of 7th Street and College Street in Marquette, MI.

Fortunately no injuries, and the complete identity of the NMU Public Safety Officer was not known to U.P. Breaking News, we are told that due to holiday – and for another reason – his friend’s will understand why we call him “St. Nick.”

Audio tapes of Michigan State Police, Chippewa County Sheriffs department, Chippewa EMS and fire during dramatic high speed chase and chainsaw vs gun battle that played out yesterday in western Chippewa County in Michigan’s Upper Peninsula. been a strange year as cops almost never shoot anybody up here but have shot three this fall/winter including two men in their homes during well-being check.

This MSP trooper was apparently threatened with a chainsaw as chase ended with 100 MPH crash. on M-28.

The story picks up as Josh exits parents home to talk with police but instead – chase is on.

PREAMBLE before chase:

At approximately Chippewa County Sheriff’s Department and MSP were dispatched to an address on Hungry Hollow Road for a guy named Josh that had recently been released from rehab where he had undergone treatment for meth.

He had smashed into several cars with his white Dodge truck. There was a weapon involved, as he was highly agitated and unstable. Dispatch was attempting to get further information.

Before police arrived it was determined, suspect Josh, was at his parents house and had smashed into their vehicles with his truck.

The weapon involved was a gun that his father was threatening him with, to leave the property.

Josh have smashed some windows on the home. Josh left before the police arrived and the father put his gun away.

But allegedly he was armed with a running chainsaw at end of high speed chase.

Above is the nerve-racking audio tape of the high speed chase, ramming, shooting, and EMS – all in Chippewa County, Michigan.

The tapes will be released in next half an hour or less.

Trust me – you haven’t heard anything like it – cops do a great job – and this poor man – not sure his problem and his future is bleak.

Earlier in the day – he had been involved in several hit and run accidents – and ended up at his parents home on Hungry Hollow Road.

The tape picks up about the time police think the suspect “Josh” is about to come out of the home and talk with them.

Then the chase is on – first slow – then fast – then crazy apparently with a chainsaw.

Message to Michigan State Police Detectives: Please don’t issue sterile press releases – diminishing the importance of the lives of these two men – like officials did earlier this year after the first of several questionable deaths at the hands of U.P. law enforcement

An Eastern Upper Peninsula man in sleeping in his bed – before he knows it – cops are in his bedroom. He is gunned down. Did the Michigan State Police and other officers want to kill him – of course not. It was handled badly.

Handled badly – just like the fatal police shooting months earlier of an Ishpeming Township man they knew was suicidal.

Now the third Upper Peninsula death in front of government employees – this time its Corrections Officers with the Michigan Department of Corrections assigned to the rough Marquette Branch Maximum Security prison.

We have a few questions in case the issue a press release – remember these are human beings who died at the hands of – or in front of – government employees:

These are only a few of the basic questions the public and angry families have a right to know (I could submit a dozen or more questions on each death:

Was 51-year-old Dean Bruning also tazered/shocked before, during or after he was shot twice by at least one trooper.

Was he killed on his bedroom floor?

Were all Michigan State Police procedures followed as taught in your trooper schools or during ongoing training. – and if not – why!

Now – the deaths of several Michigan Department of Corrections inmates who are not receiving proper medical care like 30-year-old inmate Derrik Siminski of Saginaw was found in apparent cardiac arrest about 5 p.m. on Oct. 1, 2016 in front of Marquette Branch Prison officials.

Why did Marquette Branch Prison professionals ask a doctor over the radio to pronounced an inmate dead about 50 minutes after he was found in cell?

Why was he not already at the hospital?

Why was his medication not properly followed when he had issues with at least one of his meds?

Were all procedures followed after an inmate is found unconscious – like calling 911?

Did U.P. Breaking News call 911 before the state did? Release the audio tapes to prove it either way.

We already know this year’s death of another U.P. inmate – Charles Lee Anderson  was not properly handled. Anderson died because his medical condition was mishandled by officials at the Kinross Correctional Facility – yeah where prisoners rioted this fall and the state blatantly lied.

Oh yeah – why was the state officials allowed to blatantly lie about the “emergency” drill – that wasn’t – the day after the death this month in Marquette.  These are not small fibs.

And – if ya had any guts – how about putting that governor of ours behind bars – if ya have the time.

As other Yoopers argued over who to vote for on Monday, an Eastern Upper Peninsula Dug Team swooped down on meth labs allegedly located in a home, an adjoining abandoned building – and even an old church – all on 10 mile Road – and found toxic waste sludge that contaminated the Meth Lab areas.

In addition to arresting three and shutting down the meth labs, Tri-Dent Drug Team officers say they made controlled buys of ecstasy – a longtime party drug.

The Tri-Dent Drug Team was assisted in busting the meth and ecstasy ‘ring’ by the Chippewa County Sheriff’s Department, Michigan State Police, the Upper Peninsula Substance Enforcement Team (UPSET) – known for its own crackdown on meth labs in the central U.P.

Below is a Tri-Dent news release sent out by Chippewa County Under Sheriff Michael D. Bitnar. Ongoing Tri-Dent drug investigations include three eastern U.P. sheriff’s departments rooting out meth and other dangerous drugs in three counties – Luce, Chippewa and Chippewa. Plus the Sault Tribe Police Department, the U.S. Border Patrol, U.S. Customs and Border Protection and the Sault Ste. Marie Police Department.

Michigan Correction’s officials stonewall mother one week after her son’s questionable death at the Marquette Branch Prison: Where are the audio tapes between the prison and the U.P. Health System-Marquette Doctor?

(Marquette, MI) – Michigan’s prison officials are stonewalling the mother of a young Marquette maximum security inmate who died a week ago today under questionable circumstances – one of a growing number of Michigan prison deaths under accusations of improper medical care and worse.

Meanwhile a letter from her dead son arrived today like a ghost reaching out for justice. U.P. Breaking News will be posting portions of the letter – as it turns out the last letter to his mom.

mdoc-dead-prisoner-derrik-joseph-siminski-430-year-old inmate Derrik Siminski of Saginaw was found in apparent cardiac arrest about 5 p.m. on Oct. 1, 2016, in the highest level of security at the state’s toughest maximum security prison on the shores of Lake Superior. However, prison officials are treating the mom colder than a winter’s gale on Lake Superior – refusing to answer even the smallest questions under the guise of the ongoing investigation by Michigan State Police detectives.

It’s not clear what MSP detectives are up to, however they have not contacted the family for information nor have they reached out to U.P. Breaking News. Freedom of Information Act requests for audio recordings, prisoner and Corrections officer statements – are going to be sent by U.P. Breaking News and other members of the media.

“I want to know when they called 911 and for what reason – and they won’t even tell me that,” said Serena Daniels, Siminksi’s mother, who says her son was due to be released soon and loved life – something he made apparent in the letter.

“Who was giving orders about the drugs they were giving my son after he was found unconscious in his cell,” said the distraught mother who is upset that the Michigan department of Corrections told her she would have to filed mountains of paperwork t5o learn more about her son’s death.

“They gave him Narcan – and we wonder why,” Daniels said. “We also heard they are trying to claim he died from an overdose of a relatively harmless drug he took daily and require testing every six weeks.”

Daniels sad her son took Effexor (venlafaxine) that online medical sites describe as an antidepressant in a group of drugs called selective serotonin and norepinephrine re-uptake inhibitors (SSNRIs). She said prison officials knew he had suffered side effects of the medicine but did not take him for testing. Daniels said there is no way her son would save up the pills in a suicide plot.

“My son made some mistakes but many people loved him and was looking forward to coming home,” Daniels told U.P. Breaking News adding “Derrik loved himself too much to commit suicide.”

Because prison officials seem to be covering their butts, Daniels has been put in touch with a Marquette attorney through a prisoner rights group member.

Like many Marquette Branch Prison inmates, Derrik was not thrilled about enduring the cold winters here in northern Michigan and was absolutely was crazy about his home town of Saginaw.

“My son loved Saginaw – it was his home,” Daniels said.

In fact, one of the odds things is why Derrik asked to be put in a single cell – when was always desperate to communicate with others people to talk and share time with.

U.P. Breaking News is standing by our report that appears to show – at the very best – improper medical care, not following protocols and likely there was some type of breach in security if drugs are found in his system.

Officials at Michigan’s toughest prison did not call for an ambulance when they found the young inmate in cardiac arrest in his cell – and a doctor was asked to declare the prisoner dead without seeing the inmate some 45 to 50 minutes after he was found.

In fact, U.P. Breaking News knows that somewhere an audio tapes exists of the “excited utterances” of a prison employee who blindsided a doctor over the radio more about 45 to 50 minutes after the victim was found – and those transmissions had better not be destroyed. U.P. Breaking News know that all audio is recorded by MSP/911 on all important frequencies – so the tapes must exist either at Central Dispatch 911, U.P. Health System – Marquette, or at the prison itself.

Without that tape, U.P. Breaking News and others believe there is no way the investigation can be legitimately be declared finished. Via radio, a Marquette doctor was asked to pronounce the prisoner dead at approximately 5:47 p.m. – sight unseen and with little knowledge about the dead prisoner.

The inmate was found unconscious in his cell at approximately 5 p.m.

Prison officials were providing CPR and asked for a doctor from U.P. health System Marquette to pronounce the prisoner dead “approximately 34 minutes into the code.”

At least six Michigan prisoners have died in the past six weeks during unusual medical events or because of neglect, according to numerous sources.

Prison officials administered epinephrine – or “an epi” – six times.

Prison officials in Marquette have refused to let Daniels speak to the warden. She said the family is hearing many scary reports about what happened to her son.

Siminski’s family are desperately hoping people will help per her son to rest by donating to a  gofundme page to raise money for his funeral expenses.

A local funeral home won’t release her son’s body until she pays several thousand dollars – and she says even a one-dollar donation from those who read about of her son’s death would be enough.

(Saginaw, MI) – A grieving mother is begging state of Michigan officials to give her more time to raise money and make final arrangements for her son’s body – and she fears there is a rush to whitewash the death of her son at the Marquette Branch Prison.

30-year-old inmate Derrik Siminski of Saginaw was found in apparent cardiac arrest about 5 p.m. on Oct. 1, 2016, in the highest level of security at the state’s toughest prison on the shores of Lake Superior. Siminski’s family have set up a gofundme page to raise money for his burial – and they are desperate because of a looming state deadline to burn his body.

“I feel my son was taken from me,” said Serena Daniels, Siminksi’s mother, who dismissed any thoughts her son would commit suicide.

“I talked to him every day and he sounded fine,” Daniels said, adding the entire event is made even more painful because her daughter Katrina – the inmate’s sister – is suffering from a terminal kidney disease. “And now he is dead.”

The MDOC is rushing her son’s investigation, Daniels said.

“They want to rush this,” Daniels said about the quick investigation, immediate autopsy and now the state wants to burn her son’s body.
Yet state officials told the inmate’s mother that her won’t know autopsy results for “six to eight weeks.”

bridgeport-patchAt 8 p.m. (Last night, Tues., Nov. 1, 2016) a Bridgeport Police Department car pulled up to her home and an officer relayed the message her son was dead in Marquette – over 350 miles from Saginaw.
The officer provided a number to call officials with the Michigan Department of Corrections (MDOC).

The inmate’s mother is literally begging state officials to extend tomorrow’s deadline (Thurs., Nov. 3, 2016) that the state has set to make final funeral arrangements for her son. A Saginaw funeral home is offering a low income special price of $3,500. The other option offered by the state is to bury Siminski on prison property in the Cherry Hill Cemetery in Jackson, Michigan.

“They said they would burn him and send me his ashes,” said Daniels, who feels rushed into making final arrangements as money needs to be raised and only to options were given.

Daniels granted an interview to U.P. Breaking News tonight from her home in Saginaw, Michigan where family has gathered to try to make sense of the unexpected death and now feels it is being rushed into funeral arrangements by state officials.

Siminksi was being held in the Level 5 Maximum Security Unit at the Marquette Branch Prison.

Today’s “emergency” at the Marquette Branch Prison was a monthly drill not connected to last night’s death of young maximum security prisoner at Michigan’s toughest prison, according to MDOC Spokesperson Chris Gautz.

Gautz claims today’s emergency message on the prison’s main telephone line was only a drill.

When pressed why police stated they had not been informed about a drill – Gautz said prison officials never notify Michigan State Police or any police agency prior to the monthly drills.

Meanwhile – he refused to release the name of a 30-year-old maximum security inmate who apparently died in his cell last night. We now know the victim’s identity because the family is begging the state to not burn the man’s body because a decision by tomorrow is impossible.

“Michigan State Police were on the scene last night,” Gautz said.

Officials say they are awaiting the results of an autopsy that was performed this afternoon (Nov. 2, 2016) on the prisoner – who was assigned to the highest security – Level 5 – which has nothing to do with a person’s crime but rather how they have behaved while in prison.

The dead Marquette Branch inmate was convicted of larceny, plus the production and distribution of marijuana in downstate Ogemaw County – near the Lower Peninsula towns of Rose City and West Branch.

U.P. Breaking News has been reporting that no ambulance was called – and after about 50 minutes of allegedly conducting CPR – prison officials asked a U.P. Health System-Marquette doctor to pronounce the inmate dead via radio – sight unseen.

When informed of these facts, Gautz declined comment saying the matter is now a Michigan State Police investigation.

(Marquette Branch Prison, Michigan) – Officials at Michigan’s toughest prison did not call for an ambulance when they found a young inmate in cardiac arrest in his cell last night – and a doctor was asked to declare the prisoner dead without seeing the inmate some 50 minutes after he was found.

Officials found the inmate unresponsive and in apparent cardiac arrest in his cell. An ambulance was never called for the 30 year old inmate – even 50 minutes after he was found.

About 10 minutes after U.P. Breaking News first reported the story we notified Central Dispatch in Negaunee that – because it apparently had not been reported – we would be the official complainant in the death “if the prison was slow reporting” the death

(Marquette Branch Prison, Michigan) – Officials at Michigan’s toughest prison did not call for an ambulance when they found a young inmate in cardiac arrest in his cell last night – and a doctor was asked to declare the prisoner dead without seeing the inmate some 50 minutes after he was found.

Officials found the inmate unresponsive and in apparent cardiac arrest in his cell. An ambulance was never called for the 30 year old inmate – even 50 minutes after he was found.

About 10 minutes after U.p. Breaking News first reported the story we notified Central Dispatch in Negaunee that – because it apparently had not been reported – we would be the official complainant in the death “if the prison was slow reporting” the death

(Marquette Branch Prison, Michigan) – Another Upper Peninsula prison inmate is dead – as northern Michigan’s dead prisoners starts to get attention across the country.

The incident happened just before 6 p.m. Tues., Nov. 1, 2016. in Marquette, Michigan.

The latest death involves a 30-year-old inmate who was pronounced dead tonight at the Marquette Branch Prison – a maximum security prison along Lake Superior in Marquette, U.P. Breaking News has learned.

It is unclear if prison officials have notified Michigan State Police for an investigation.

Via radio, a Marquette doctor was asked to pronounce the prisoner dead at approximately 5:47 p.m.

The inmate was found unconscious in his cell at approximately 5 p.m.
Prison officials were providing CPR and asked for a doctor from U.P. health System Marquette to pronounce the prisoner dead “approximately 34 minutes into the code.”

At least six Michigan prisoners have died in the past six weeks during unusual medical events or because of neglect, according to numerous sources.

Prison officials administered epinephrine – or “an epi” – six times.

Narcan was administered one time

He was administered “D-50” one time – several people contacted U.P. Breaking News to state that the D-50 was presumably “dextrose, in case he had low blood sugar.” However it was not stated as D5W or Lactated Ringers – as we have heard for years in medical calls. This is only one of many questions in this man’s death.

Types of glucose/dextrose include:

  • D5W (5% dextrose in water), which consists of 278 mmol/L dextrose

  • D5NS (5% dextrose in normal saline), which, in addition, contains normal saline (0.90% w/v of NaCl).

    • D5 1/2NS 5% dextrose in half amount of normal saline (0.45% w/v of NaCl).[1]
  • D5LR (5% dextrose in lactated Ringer solution)

However the prisoner remained in flat-line aka “asystole.”

The identity of the prisoner is not known – nor are the crimes for which he was serving time.

Marquette Branch Prison was authorized by the Michigan State Legislature in 1885. The prison was subsequently built on the shores of Lake Superior on property that was a gift to the State from the Marquette Businessmen’s Association. The prison was completed in 1889 at a cost of less than $200,000.
The Level V portion of the prison has three General Population housing units and three Administrative Segregation housing units. There are four Level I housing units which are located just outside the Level V portion of the facility.

Programming


Adult Basic Education and General Education Development completion are offered. Other programs include substance abuse treatment and religious services. Available activities include law library, general library and hobbycraft. Many program resources are expanded through participation by community volunteers, such as local clergy and lay people, which gives prisoners increased opportunities to participate in programs.
Prisoners are provided with on-site routine medical and dental care. Serious problems are treated at the department’s Duane L. Waters Health Care in Jackson. Emergencies can be referred to a local hospital.

The Level V perimeter is protected with a concrete wall, razor-ribbon wire, electronic detection systems, and eight gun towers. Level I is surrounded by two chain link fences and an electronic detection system.

This afternoon, Col. Kriste Kibbey Etue, director of the Michigan State Police (MSP), administered the Oath of Office to 58 new Michigan State Police (MSP) troopers at the graduation ceremony of the 130th Trooper Recruit School at the Lansing Center.

“I commend these new troopers for their hard work and dedication in proving they have what it takes to join the ranks of the elite Michigan Department of State Police,” stated graduation keynote speaker, Governor Rick Snyder. “We wish them safe and rewarding careers as they stand on the front lines to serve and protect the residents of our great state.”

In her address to the graduates, MSP Director Col. Kriste Kibbey Etue said:

“As you accept the honor today of becoming Michigan State troopers, the department demands, and the public deserves, nothing less than your very best performance every day. In all things you do, do what’s right, do your best, and treat others the way you want to be treated. Strive each day to Provide ‘Service With a Purpose’ to those who break the law and to those who choose not to break the law.”

Tpr. Dennis Meek, who was elected Class Orator by his fellow recruits spoke on behalf of the graduating class at Friday’s ceremony.

Other award recipients included Tpr. Dylan Neill who received the Team Building Award, Tpr. Vincent Modjeski who received the Marksmanship Award,

Tpr. Heather Svoboda who received the Academic Achievement Award and Tpr. Eric Morrow who received the Outstanding Performance Award.

The 130th Trooper Recruit School began on June 5, when 70 prospective troopers reported to the MSP Training Academy in Lansing.

For the past 22 weeks, recruits received training in firearms, water safety, defensive tactics, patrol techniques, report writing, ethics, first aid, criminal law, crime scene processing and precision driving.

In order to be selected to attend the academy, all applicants had to pass a stringent selection process that included a physical fitness test, background investigation and hiring interview.

As part of the department’s commitment to “Providing Service With A Purpose,” the recruits participated in a community outreach project in which they helped build a playground at Wacousta Elementary School.

The 130th Trooper Recruit School is the second of four trooper recruit schools this year, as well as a motor carrier officer recruit school:

  • 131st Trooper Recruit School started July 17, 2016; will graduate December 22, 2016
  • 21st Motor Carrier Officer Recruit School started August 28, 2016; will graduate January 6, 2017
  • 132nd Trooper Recruit School started August 28, 2016; will graduate February 3. 2017

(Saginaw, MI) – A grieving mother is begging state of Michigan officials to give her more time to raise money and make final arrangements for her son’s body – and she fears there is a rush to whitewash the death of her son at the Marquette Branch Prison.

30-year-old inmate Derrik Siminski of Saginaw was found in apparent cardiac arrest about 5 p.m. on Oct. 1, 2016, in the highest level of security at the state’s toughest prison on the shores of Lake Superior. Siminski’s family have set up a gofundme page to raise money for his burial – and they are desperate because of a looming state deadline to burn his body.

“I feel my son was taken from me,” said Serena Daniels, Siminksi’s mother, who dismissed any thoughts her son would commit suicide.

“I talked to him every day and he sounded fine,” Daniels said, adding the entire event is made even more painful because her daughter Katrina – the inmate’s sister – is suffering from a terminal kidney disease. “And now he is dead.”

The MDOC is rushing her son’s investigation, Daniels said.

“They want to rush this,” Daniels said about the quick investigation, immediate autopsy and now the state wants to burn her son’s body.
Yet state officials told the inmate’s mother that her won’t know autopsy results for “six to eight weeks.”

bridgeport-patchAt 8 p.m. (Last night, Tues., Nov. 1, 2016) a Bridgeport Police Department car pulled up to her home and an officer relayed the message her son was dead in Marquette – over 350 miles from Saginaw.
The officer provided a number to call officials with the Michigan Department of Corrections (MDOC).

The inmate’s mother is literally begging state officials to extend tomorrow’s deadline (Thurs., Nov. 3, 2016) that the state has set to make final funeral arrangements for her son. A Saginaw funeral home is offering a low income special price of $3,500.  The other option offered by the state is to bury Siminski on prison property in the Cherry Hill Cemetery in Jackson, Michigan.

“They said they would burn him and send me his ashes,” said Daniels, who feels rushed into making final arrangements as money needs to be raised and only to options were given.

Daniels granted an interview to U.P. Breaking News tonight from her home in Saginaw, Michigan where family has gathered to try to make sense of the unexpected death and now feels it is being rushed into funeral arrangements by state officials.

Siminksi was being held in the Level 5 Maximum Security Unit at the Marquette Branch Prison.

Last night’s death of an inmate where the state sends their worst prisoners – is the latest in a series of questionable deaths in the past year involving the lack of proper medical care of Michigan inmates

Today’s “emergency” at the Marquette Branch Prison was a monthly drill not connected to last night’s death of young maximum security prisoner at Michigan’s toughest prison, according to MDOC Spokesperson Chris Gautz.

Gautz claims today’s emergency message on the prison’s main telephone line was only a drill.

When pressed why police stated they had not been informed about a drill – Gautz said prison officials never notify Michigan State Police or any police agency prior to the monthly drills.

Meanwhile – he refused to release the name of a 30-year-old maximum security inmate who apparently died in his cell last night. We now know the victim’s identity because the family is begging the state to not burn the man’s body because a decision by tomorrow is impossible.

“Michigan State Police were on the scene last night,” Gautz said.

Officials say they are awaiting the results of an autopsy that was performed this afternoon (Nov. 2, 2016) on the prisoner – who was assigned to the highest security – Level 5 – which has nothing to do with a person’s crime but rather how they have behaved while in prison.

The dead Marquette Branch inmate was convicted of larceny, plus the production and distribution of marijuana in downstate Ogemaw County – near the Lower Peninsula towns of Rose City and West Branch.

U.P. Breaking News has been reporting that no ambulance was called – and after about 50 minutes of allegedly conducting CPR – prison officials asked a U.P. Health System-Marquette doctor to pronounce the inmate dead via radio – sight unseen.

When informed of these facts, Gautz declined comment saying the matter is now a Michigan State Police investigation.

MDOC says Marquette Branch Prison ’emergency’ was a drill – not related to inmate death

(Marquette Branch Prison, Michigan) – Last night’s death of an inmate where the state sends their worst prisoners – is the latest in a series of questionable deaths in the past year involving the lack of proper medical care of Michigan inmates

Today’s “emergency” at the Marquette Branch Prison was a monthly drill not connected to last night’s death of young maximum security prisoner at Michigan’s toughest prison, according to MDOC Spokesperson Chris Gautz.

Gautz claims today’s emergency message on the prison’s main telephone line was only a drill.

When pressed why police stated they had not been informed about a drill – Gautz said prison officials never notify Michigan State Police or any police agency prior to the monthly drills.

Meanwhile – he refused to release the name of a 30-year-old maximum security inmate who apparently died in his cell last night.

“Michigan State Police were on the scene last night,” Gautz said.

Officials say they are awaiting the results of an autopsy that was performed this afternoon (Nov. 2, 2016) on the prisoner – who was assigned to the highest security – Level 5 – which has nothing to do with a person’s crime but rather how they have behaved while in prison.

The dead Marquette Branch inmate was convicted of larceny, plus the production and distribution of marijuana in downstate Ogemaw County – near the Lower Peninsula towns of Rose City and West Branch.

U.P. Breaking News has been reporting that no ambulance was called – and after about 50 minutes of allegedly conducting CPR – prison officials asked a U.P. Health System-Marquette doctor to pronounced the inmate dead via radio – sight unseen.

When informed of these facts, Gautz declined comment saying the matter is now a Michigan State Police investigation.

(Marquette Branch Prison, Michigan) – Officials at Michigan’s toughest prison did not call for an ambulance when they found a young inmate in cardiac arrest in his cell last night – and a doctor was asked to declare the prisoner dead without seeing the inmate some 50 minutes after he was found.

Officials found the inmate unresponsive and in apparent cardiac arrest in his cell. An ambulance was never called for the 30 year old inmate – even 50 minutes after he was found.

About 10 minutes after U.p. Breaking News first reported the story we notified Central Dispatch in Negaunee that – because it apparently had not been reported – we would be the official complainant in the death “if the prison was slow reporting” the death

(Marquette Branch Prison, Michigan) – Another Upper Peninsula prison inmate is dead – as northern Michigan’s dead prisoners starts to get attention across the country.

The incident happened just before 6 p.m. Tues., Nov. 1, 2016. in Marquette, Michigan.

The latest death involves a 30-year-old inmate who was pronounced dead tonight at the Marquette Branch Prison – a maximum security prison along Lake Superior in Marquette, U.P. Breaking News has learned.

It is unclear if prison officials have notified Michigan State Police for an investigation.

Via radio, a Marquette doctor was asked to pronounce the prisoner dead at approximately 5:47 p.m.

The inmate was found unconscious in his cell at approximately 5 p.m.
Prison officials were providing CPR and asked for a doctor from U.P. health System Marquette to pronounce the prisoner dead “approximately 34 minutes into the code.”

At least six Michigan prisoners have died in the past six weeks during unusual medical events or because of neglect, according to numerous sources.

Prison officials administered epinephrine – or “an epi” – six times.

Narcan was administered one time

He was administered “D-50” one time – several people contacted U.P. Breaking News to state that the D-50 was presumably “dextrose, in case he had low blood sugar.” However it was not stated as D5W or Lactated Ringers – as we have heard for years in medical calls. This is only one of many questions in this man’s death.

Types of glucose/dextrose include:

  • D5W (5% dextrose in water), which consists of 278 mmol/L dextrose

  • D5NS (5% dextrose in normal saline), which, in addition, contains normal saline (0.90% w/v of NaCl).

    • D5 1/2NS 5% dextrose in half amount of normal saline (0.45% w/v of NaCl).[1]
  • D5LR (5% dextrose in lactated Ringer solution)

However the prisoner remained in flat-line aka “asystole.”

The identity of the prisoner is not known – nor are the crimes for which he was serving time.

General


Marquette Branch Prison was authorized by the Michigan State Legislature in 1885. The prison was subsequently built on the shores of Lake Superior on property that was a gift to the State from the Marquette Businessmen’s Association. The prison was completed in 1889 at a cost of less than $200,000.
The Level V portion of the prison has three General Population housing units and three Administrative Segregation housing units. There are four Level I housing units which are located just outside the Level V portion of the facility.

Programming


Adult Basic Education and General Education Development completion are offered. Other programs include substance abuse treatment and religious services. Available activities include law library, general library and hobbycraft. Many program resources are expanded through participation by community volunteers, such as local clergy and lay people, which gives prisoners increased opportunities to participate in programs.
Prisoners are provided with on-site routine medical and dental care. Serious problems are treated at the department’s Duane L. Waters Health Care in Jackson. Emergencies can be referred to a local hospital.

Security


The Level V perimeter is protected with a concrete wall, razor-ribbon wire, electronic detection systems, and eight gun towers. Level I is surrounded by two chain link fences and an electronic detection system.
