(Marquette, MI) – In a house-cleaning said to be targeting her enemies and whistle-blowers, the Warden at the Marquette Branch Prison has been firing and banning COs from the property, disciplined many others, and is claimed to have ordered the alleged falsification of official state reports to keep control of the Michigan’s toughest maximum security prison.

The COs say its the latest round of alleged corruption, intimidation, and malfeasance in office. Sources have said the COs, and others she doesn’t suspect, are willing to testify before a federal grand jury, if it is convened by federal prosecutors. The grand jury topics could include alleged corruption by Warden Huss and criminal malfeasance at other U.P. state prisons. Often touted as nearly escape proof, the Marquette prison faces the rocky and unforgiving shores of Lake Superior.

The spartan, aging prison is infamous with the public for housing some of Michigan’s most vicious, cold-blooded, maniacal and hated killers plus sadistic torture-loving rapists, yet it is also infamous with inmates because of the harsh winter weather, cold cells, and the thick, swampy and bug-infested perimeters that stretch on seemingly forever if you are mired in its grip. However, its also houses inmates with short records and non-violent charges like burglary and drugs – and that description matches that 30-year-old MBP inmate who inexplicably died in  segregation about a year and a half ago.

Here are just some of the allegations at the Marquette Branch Prison made in a communique by corrections officers and obtained by U.P. Breaking News:

Corrections officers not allowed to inspect kitchen areas where inmates and kitchen staff have sex, would-be “nightmare scenario” involving a MDOC Sargent, warden allegedly threatens her under-bosses to influence official reports including an incident during which pepper spray used by a CO to stop an inmate hanging are among numerous allegations that have surfaced in an all-out war between the COs, administration and inmates at the scandal-plagued Marquette Branch Prison.

And all that is just the tip of the iron iceberg.

U.P. Breaking News has long-reported that understaffing in U.P. state prisons is such a critical problems it adds to extreme inmate abuse, plus CO and staff turnover, and a fear by all sides that a bloody inmate takeover could breakout at any second that would make the devastating Kinross riot look like a day in the park (see Part 3 for details).

MBP officers are not “allowed to enter certain areas of the Level 5 (maximum security) kitchen” including the offices, commissary and coolers. However, while the COs are banned, the prisoners and Trinity food service employees were allowed to frequent those places. The Trinity Food Services Group was finally fired by the Governor in the past month – years after he first learned of the company’s twisted reputation, and its cruel and unusual food complete with maggots.

What mystery lurks where the mystery meat is made? The answer: Sex. Then kitchen staff naïve enough to fall for the inmate’s lies – find themselves blackmailed by prisoners – and that leads to smuggling contraband into the prison.

“Normally custody staff have access to every area inside the (prison) facility to ensure safety and security,” states the communique from current, former and retired COs. “The only way officers are allowed to gain entry” to conduct a “shakedown” of the area is with prior “shift command approval.” Afraid of the warden, MBP shift command never allows those shakedowns – where the inmates and Trinity workers did their business.

MBP shift commanders walked around terrified about possible “backlash by the warden” – and not unlike U.P. reporters – have been taught absolute obedience or suffer swift retribution due to corruption.

For some reason the Warden doesn’t care if the Trinity Food Service employees and the inmates are playing footsie. Oh yeah, maybe it is because she married an inmate rapist.

COs fear that food service employees not only have sex with inmates –  canoodling is widely-known to be rampant across the MDOC – as Trinity workers fall for the fake sweet-talk from prisoners.

Then, if one food worker gets mad at the prison or has been completely duped by a con-artist inmate – that’s when a weapon could be smuggled in. Especially now that Trinity workers are being let go – and some already have secrets that that make them putty in the greedy hands of inmates – who threaten to tell if the worker doesn’t do even more illegals things for their one-time inmate lovers.

The COs list numerous acts of alleged “intimidation and corruption” by Warden Huss just this year including “major incidents” that were “mishandled.”

The COs say one of the worst was “covering up a sergeants potentially deadly mistake.”
The COs claim that a MBP sergeant ordered a CO to put himself into a “nightmare scenario” that is feared by law enforcement officers – and banned at all prisons – no ifs, ands or buts.

In fact, its unspeakable when you think what could have happened – inmates get gun, kill the COs in prison vehicle, and go on armed rampage though Marquette County.

There is a reason that no guns are allowed behind the prison doors or in prison vans/vehicles – because studies show that the guns are often taken from officers/guards by inmates looking for their chance – and that’s the nightmare scenario.

Nevertheless, the CO and sergeant sat with inmates in a moving prison vehicle – with pile of guns and ammo near convicts.

“A sergeant gave an order for an officer to sit in the back of a (prison) transportation vehicle with an inmate while having .45 caliber rounds, a handgun, and a can of pepper spray during a transportation run back to the prison,” said the COs communique obtained by U.P. Breaking News.

“This was potentially a ‘worst case scenario” for the officers, the sergeant and the public,” the COs state.

“The inmate was in a truck with two loaded guns, and 90 (.45 cal.) rounds at his disposal at an arms reach,” the COs stated. “The other officer had .45 caliber rounds, a gun, and pepper spray while the sergeant has a taser and pepper spray.”

And if the inmates took the vehicle they would be dressed and ready to cause horror and grief in many places. The prisoner would have “three uniforms and a state vehicle to run away with.”

Then Warden Huss allegedly covered up the incident for the sergeant but makes examples out of the corrections officers, the COs claim.

“The entire state is lucky nobody was hurt or killed,” the COs stated. “The warden dusts this incident under the rug for the sergeant with no write-up, demotion, suspension, or termination.”

“But one officer (the driver) has been disciplined and the other “ is/was under investigation, the communique states.

MBP MDOC 1Ironically, those punished corrections officers were the same COs who questioned the sergeant when he made the potentially catastrophic decision before the ride back to MBP, the COs state.

Remember prisons are run in a military-like structure, so questioning the sergeant’s decision at the time took guts even if it fell on deaf ears.

“The corrections officers involved even questioned the supervisor’s decision-making at the scene,” the COs stated.

And in another incident this year, a corrections officer used pepper spray to stop an inmate from hanging himself.

The MBP corrections officer “used his chemical agent (pepper spray) to stop a prisoner from hanging himself in his cell,” the COs said. “Immediately after the incident took place – video footage of the incidence was reviewed in the MBP Control Center.”

Present during the video viewing was an assistant deputy warden, who said that the incident was handled appropriately and there was no need for a report or investigation regarding the matter.”

The COs said Warden Huss hit the roof – and disciplined a CO – while keeping her officers and administration happy by not filing a charge higher up the prison food chain.

“Days later Warden Huss went to the shift commander that was on duty when the assistant deputy warden addressed the situation,” the communique reads. “”She told him (shift commander) she wanted a full investigation and incident report.”

The COs claim that’s when Warden Huss allegedly threatened one of her Lieutenants – the shift commander – with his job if he did not participate in an alleged coverup.
“She threatened the Lieutenant, saying that he needed to leave the assistant deputy warden’s name and what they said – out of the report, – or he would be disciplined for failure to report the incident and his career would be in jeopardy,” the statement reads.

“The officer who did his job the way he was trained has since been placed on a Stop Order and isn’t allowed on the property,” the COs stated. Meanwhile sources say its just one of 50 Stop Orders she has issued.

Warden Huss “has been using her position of power to threaten staff with their jobs and income to get certain ‘Critical Incidents’ written a certain way,” the COs said.

U.P. Breaking News believes that prison officials have the duty to release the footage – so the public can decide. And we mean without the usual unnecessary delays and hassles of filing a Freedom of Information Act request. After all, they charged a CO a half million dollars ($500,000) for requesting a few emails involving the MBP top brass. MDOC and MBP hired him – but completely dislike yours truly for exposing scandal after scandal at the Marquette prison – maybe that tape would cost us $1 Million Dollars.

 

Just this week, a prisoner at MBP as taken to the hospital for undisclosed reasons.

In the past week, U.P. prison inmate have been taken to the hospital by ambulances for reasons that included “chest pains,” seizures and one suspected drug overdose in the eastern U.P.

He was born on June 7, 1971, a daughter of George and Nancy Gruber. He graduated from Lake Linden-Hubbell Schools. He worked as a residential painter.

Leo liked to fish and play the guitar. He loved his daughters and the outdoors more than anything and he had a witty sense of humor.

His daughter, Kelley says “Dad called me his flower and made me feel like a one-of-a-kind person. I will never forget his kindness he shared with those he loved most.”

He is survived by: 3 daughters – Brandy (Jeremy) Hilss, Kelley Gruber, and Hannah Gruber; and sisters – Billie Jo and Pattie Jo.

A Memorial Service is planned for the summer of 2018. The Pearce Funeral Home in Lake Linden is in charge of arrangements.

(Calumet, MI) – Investigators are probing a fatal fire Saturday night in an old three-story brick building near famed Calumet Theater.
The building has been turned into apartments and the fire has claimed the life of one of its residents.
The smoky furnace-related fire was reported about 7:17 p.m. Saturday night, Jan. 27, 2018. at 333 Fifth Street in Calumet, MI.
The Michigan State Police Fire Marshal is investigating the blaze that killed a man – and his beloved dog- said to be a Yorky (Yorkshire terrier).

Fatal fire 1The three-story building – including the upstairs apartments – were filled with smoke The furnace-related fire was battled by the Calumet Village Fire Department.

“The furnace is on the second-floor next to apartment two,” the dispatcher told responding firefighters.

The building shares an alley – behind each other – with the famed Calumet Theatre.

The identity of the victim has not been released. Immediately after arriving on the scene, law enforcement and firefighters evacuated several apartments.

One resident told police she barely survived. The woman said she did not have time to check the other apartments because she was choking on the smoke.

(Upper Peninsula of Michigan) – You don’t often hear the police call for firefighters at the cop HQ or 911 – but it happened twice almost simultaneously this morning in the U.P. of Michigan.

Marquette firefighters are on the scene of an apparent electrical fire at the Marquette Police Headquarters.

Meanwhile – same thing was just reported at the Enhanced 911 Dickinson County Dispatch Center – located in the county building in Iron Mountain, MI.

A dispatcher in Iron Mountain said their entire system went down. Dickinson County 911 was filled with smoke – plus electronics are fried from computers to LEIN.

Marquette PD reported its problem about two minutes before Iron Mountain PD but could have been simultaneously.

Are they related due to timing and/or weather. If they are not related to either – then its a coincidence involving lotto type odds.

“The fire department is headed your way,” said a 911 dispatcher to a police official at the Marquette Police Headquarters.

The problem is “smoke coming out of their main frame computer room,” a dispatcher told firefighters in Marquette.

Not clear if its weather-related. No injuries reported.

Only two days ago firefighters rushed to a U.P. hospital hecause of an active electrical fire.

Iron Mountain firefighters were called Saturday night to the Dickinson County Memorial Hospital.
An “active electrical fire” was found in the rear of the hospital. No Injuries reported.

Meanwhile – the raging snowstorm has made driving inadvisable through at least tomorrow (Tuesday) afternoon. The storm has already caused several rollovers/accidents. Plus power outages reported in some areas.

(Kincheloe, MI) – An ambulance was sent to an Upper Peninsula prison a short while ago due to a reported stabbing.

An inmate was apparently stabbed this morning at the Chippewa Regional Correctional Facility (CRCF)  in at 4289 W. M-80 in Kincheloe, MI.

The stabbing was reported just before 8 a.m. today, Saturday, Jan. 13, 2018 at the CRCF, which is one of two state prisons in Chippewa County in the eastern Upper Peninsula. Details of the stabbing have not been released.

The Kinross EMS ambulance was called to help treat the male victim.

The stabbed inmate is being rushed to the War Memorial Hospital in the Sault Ste, Marie, MI.

The CRCF warden is Connie Horton – no word if she has been called to the prison due to the stabbing.

(Marquette, MI) – A man was at least critically injured this morning when he was struck by a car on Wright Street in Marquette, MI.
Few details have been released by police, however U.P. Breaking News has pieced together some of what happened by reviewing the emergency tapes.

The incident is “a car versus pedestrian – the subject is not moving,” the dispatcher told responding emergency personnel. The investigation dictated the street to be closed – and that closure lasted for about two hours.

The situation made all that more serious because paramedics and the ambulance were in Harvey. After a few minutes, it was suggested to dispatch Marquette Township that received a new ambulance this past summer. More on that later in story.

The crash was reported at near top of the Wright Street hill about 6:30 a.m. on New Year’s Day 2018. It was just inside the city limits of Marquette – and Wright Street was closed so cars coming down the hill at dawn were not surprised when the accident suddenly appear in a curve.

“It’s on the top of the (Wright St.) hill – and around the bend on the top,” said the first officer to find the crash.

While en-route, Marquette Police received reports that CPR was underway on the man – and an off-duty officer was on the scene.

“The subject is unresponsive,” the dispatcher reported.

“The victim is a black male – they’re starting CPR – the male subject is with an off duty police officer,” the dispatcher told police responding to the crash.

Then a bit of possible good news – compared to CPR underway.
“Just got a callback from the driver – the subject is breathing,” the dispatcher said adding the man was still unconscious.

With the U.P. Heath System – Marquette ambulance was still miles away – that’s when officials decided the victim would be transported by the Marquette Township ambulance instead of lying in the street.

If there was ever a need for the Marquette Township ambulance it was New Year’s Day. The ambulance has been used on other emergency medical runs sine July – but was in the right place when other paramedics were still trying to rush to the scene from over 10 miles out – without crashing their rig on slippery roads.

Ironically the Marquette Township Fire chief said in July they were identifying “a need” for the ambulance within the current system. They proved the need again today.

“Marquette Township EMS is transporting that patient with two medics from the Marquette City Fire department,” said one of the EMTs on the scene.

One problem – there did not seem to be the immediate ability for the township ambulance to talk via radio to the paramedics in the ambulance or the ER. It issue was brought up by paramedics. It may all be explained considering things were a bit stressed but medics never stopped giving medical care to the critical patient.

The details on how the man was struck have not been released. Police confirmed numerous warrants for a possible passenger in the car – and warrants on a driver who ignored the road closed barricades.

No details of the accident or names of those involved have been released by police.

(Rock/McFarland, MI) – Police are investigating a criminal sexual conduct complaint that is said to have occurred at the Upper Peninsula’s only strip club.

A female, in her late teens, arrived at U.P. Health System – Marquette about 3 a.m. to report she had been raped.  The complaint was filed early today, Sat., Dec. 16, 2017.

A rape kit was delivered to the Marquette hospital about an hour later by the Marquette County Sheriff’s Department.

A novelty in the U.P., strip clubs are spread across many other areas of Michigan.

It is said that deer hunters flock to the business, according to a 2015 story in the Detroit newspapers.

U.P. Breaking News reached out to management at the topless club, but have not heard back from them.
The club is only open two nights per week – from 9 p.m. to 5 a.m. on Friday and Saturday.

It’s not clear if the investigation will effect things at the club tonight.

Police and prosecutors have been unavailable for comment. The investigation has just started and will likely take days if not longer to investigate.

Arrest made: Sunday night double stabbing with kitchen knife reported in Negaunee, MI

Charges filed against one suspect in connection with Negaunee stabbing probe

31-year-old Tyler Scott Yelle of 777 Pioneer Mobile Home Park Lot 198 in Marquette, MI has been arrested in connection with the reported double stabbing Sunday night in Negaunee, MI.

Yelle was booked into the Marquette County Jail at 10:38 p.m. Sunday night, Dec. 10, 2017 on two felony charges – Assault and battery and third degree home invasion. Bond was not set.

Yelle is also charged with attempted resisting arrest and obstructing police.
On March 2, 2017, Yelle was sentenced in Marquette County District Court Judge Roger W. Kangas to a jail term for second offense operating while impaired. Yelle was sentenced to 300 days jail with credit for 164 days served plus he was ordered to pay a nearly $1,400 fine.

Double stabbing probe in Negaunee, MI

(Negaunee, MI) – An altercation resulting in a double stabbing with large kitchen knife was reported Sunday night inside an apartment in Negaunee, MI in a chaotic situation that left police with two stabbing victims at different locations.

The double stabbing was reported about 9:22 p.m. on Sunday, Dec. 10, 2017.

Both victims are male.

Two ambulances have been called from U.P. Health System – Ishpeming. The case is being investigated by Negaunee Police with assistance from other agencies including Ishpeming Police Department. Both victims have been rushed to the hospital.

One male victim with a reported stab wound to the left forearm was located in an upstairs apartment at 317 N. Brown Ave. in Negaunee. The other victim and a male friend, called 911 from the Super One Foods a few blocks away. That male victim has a stab wound to the left side of his chest.

A neighbor first called police reporting an argument in an upstairs apartment followed by someone screaming “there is blood everywhere.”

That’s when a female called from the apartment at 317 N. Brown Ave. to report the stabbing.
It is not clear who stabbed who. But police are not searching for a suspect on the loose. It is believed of the four people involved – at least one did the stabbing – and possibly more.

(Marquette, MI) – A Marquette County man is tonight charged with filing a bogus assault complaint with Marquette Police and wasting police officers time who issued a statewide look out for the people he unjustly fingered.

37-year-old Joseph John Manning of Marquette, MI is charged with making a false police report. Marquette Police and officers statewide expended lots of effort on the investigation.

Manning has posted bond and is out of the Marquette County Jail on a felony charge of lying to police.
Manning is charged with falsely accusing two people of an assault on Sun. night, Nov. 19, 2017.

54-year-old Jack J. Robideau of Grayling, Michigan.

26-year-old Aimee Renee Kunzler of Marquette and Grayling, MI

Kunzler tells U.P. Breaking News she and Robideau were mortified be the subject of a statewide manhunt on the false assault allegation. She said the suspect – Manning – is an ex-boyfriend. Kunzler and Robideau are friends.

Kunzler said its especially upsetting because she has never been in trouble in her life.

The ordeal “has been awful,” she said.

Kunzler said she was stunned to find out that police wanted to question her – adding she wasn’t even in the Upper Peninsula the night of the false assault allegation. Police had to take the report seriously until holes were poked in Manning’s stories.

The alleged false report of a crime happened in Marquette at approximately 11:20 p.m. on Sunday, Nov. 19, 2017.

Manning was lodged in the Marquette County Jail at about 8:20 p.m. on Tues., Nov. 28, 2017 and released on bond Tuesday morning.

A Big Bay Native, Manning is reportedly now working at Checker Cab in Marquette.

Manning is free on a $5,000 bond.

(Baraga, MI) – Federal prosecutors in Marquette have put a Keweenaw Bay Indian Community Police officer on notice that he is the target of a federal criminal investigation.

Marhshall Thomas 2Numerous sources tell U.P. Breaking News that 41-year-old Marshall Dion Thomas of L’Anse, Michigan is a KBIC tribal cop, but it is not clear if he has been suspended or fired. U.P. Breaking News still working our sources to nail down what the nature of the criminal investigation.

Last week, at least one other Baraga County resident lawyered-up last week – at the same time as Thomas – and even before federal criminal charges were filed. It is not clear if that case is related to this investigation.

(Marquette, MI) – Shocking paperwork was filed in federal court in Marquette today that indicates an “investigating officer” in the U.P. is about to be charged with a felony crime by federal prosecutors.

In fact, the federal paperwork already describes the officer s a defendant – although no formal charges have been released publicly.

41-year-old Marshall Dion Thomas of L’Anse, Michigan appears to be the target of a federal investigation. U.P. Breaking News is compiling information on other possible targets of the case.

In a rare move today, Wed., Nov. 15, 2017, the U.S. Public Defenders Office today officially requested to no longer represent Thomas “in a pre-charged” federal criminal case. Thomas has listed past addresses in Pelkie, MI; Cincinnati, OH; and Williston, ND, according to several websites.

In asking to no longer represent Thomas, the top federal court-appointed defense attorney in northern Michigan filed a motion to allow Assistant Federal Public Defender Elizabeth A. LaCosse to withdraw from the case. The motion is not being opposed by federal prosecutors.

Today, Asst. U.S,. Attorney Maarten Vermaat filed paperwork with the court to confirm his office has no opposition to the federal public defenders office pulling from the criminal case. U.P. Breaking News first learned of the case last week but have been unable to confirm the nature of the pending criminal charges.

Public defender LaCosse “was recently appointed to represent Mr. Thomas’ interests in a pre-charged matter,” the motion to withdraw as defense attorney states. U.. Magistrate Judge Timothy P. Greeley has been hearing arguments in the matter.

It was filed on behalf of LaCosse by Sharon A. Turek – the Federal Public Defender for the Western District of Michigan – that encompasses all of the U.P. and half of the lower Peninsula.
“Since being appointed, counsel’s only contact with Mr. Thomas has been a meeting
to discuss the issue of her office’s conflict in representing him,” the motion states. “An attorney/client relationship has not been established.”

“Because Mr. Thomas is an investigating officer in a case where Ms. LaCosse is
appointed as counsel, she has good reason to believe that a conflict of interest exists in her continuing representation of Mr. Thomas and that it would be in his best interest for a substitute attorney to be appointed to represent his interests in this matter.”
“Assistant Federal Public Defender Elizabeth A. LaCosse, respectfully
requests that this Honorable Court enter an order granting her permission to withdraw as counsel in this matter and appoint substitute counsel from the CJA Panel in Grand Rapids for the Defendant.”

(Marquette, MI) –It appears a little fish is the first charged in a four-year federal undercover probe into illegal fishing and packing practices across the Upper Peninsula of Michigan.

At least one man has been charged – and other arrests are expected – in a fishing fraud case in Michigan’s Upper Peninsula that is a joint state and federal probe into illegally labeling of fish in an investigation dating back four years.

The case is receiving the attention from the justice department’s top levels in Washington, D.C.

And FLOP! That’s the sound of a large undercover probe into illegal fishing and distribution operations in Michigan’s Upper Peninsula – including Lake Superior.

One of the country’s top U.S. Justice Department fishing crimes attorneys filed the case. Federal charges have been filed again Christopher James Peterson, who is named in a four-court Class A Misdemeanor Information.

By the feds in recent years – as a federal sting operations led to charges of people across northern Michigan and northeast Wisconsin in the winter of 2015. It included long-term informants, wires and the closing of businesses.

The charges involve the alleged false labeling of fish in Marquette County, MI during Dec. 2012 and March 2013.

This is the kind of case that – based on history – is more than than charging of this one little fish – as it date backs to events in the winter of 2012 and 2013. Plus the top state and federal prosecutors are part of the case – not likely if only misdemeanor charges were planned.

The feds allege Peterson in 2012 and 2013 “knowingly made and submitted a false record and label for, and false identification of, fish that were intended to be transported in interstate commerce.”
