U.P. Breaking News has been contacted by dozens of current and former corrections officers plus the families of inmates about the short-staffing, a real concern of another riot and COs being killed, plus numerous unexplained and suspicious deaths of young inmates.

Two attacks at the Marquette Branch prison – in the finals months of 2016 – injured three corrections officers. The state has refused to confirm the second attack reported exclusively by U.P. Breaking News on New Year’s Eve just hours before 2017.

Having said that, U.P. Breaking News has been contacted about suspicious numerous deaths in the past two years at the Marquette Branch Prison. U.P. Breaking News documented the death of a 30-year-old Saginaw inmate in Marquette Branch.

Our investigation shows that the Marquette Branch Prison corrections officers did not even call ambulance for the young man in a segregation cells – claimed to perform CPR for 45 minutes, apparently re-positioned the body and lied to Michigan State Police investigators.

Then an officer tried to get a U.P. Health System doctor to declare the inmate dead over the radio sight unseen.

That inmate is 30-year-old Derrick Siminski of Saginaw, MI – who would have been paroled soon and was in prison on marijuana charges.

Our investigation shows that MSP should consider arresting some of the corrections officers involved in the incident.

A federal lawsuit was just filed in the 2014 hanging of a Marquette inmate was allegedly met without concern or care by corrections officers.

Below read the 14-page, three-count federal court civil suit filed by the estate of an inmate who hung himself – while corrections officers allegedly did little or nothing to help him – and allegedly encouraged the man to kill himself.

This lawsuit had been filed earlier in Marquette County Circuit Court, however the U.P. media never asks about what is happening in the clerk’s offices across the U.P. – where public records cost 100 times more than the charge by the feds for public records. In a normal area, the lawsuit would have been printed in the local newspaper.

U.P. Breaking News has battled the U.P. county court system – and in addition to high fees – they delay delay delay. Many counties actually use public records to boost their general fund – in violation of state law.

Another shocking fact, after reviewing literally dozens and dozens of federal lawsuits – it seems that U.P. prisoners – never – ever – ever win – not even once. Federal judges never side with U.P. prisoners.

The suit was filed on Wednesday, Jan. 25, 2017 on behalf of the estate of inmate Jeremy Alan Garza.

The lawsuit names the warden, two deputy wardens and three corrections officers (scroll down to read the shocking allegations). Named are MBP Warden Robert Napel, Deputy Warden Alexander, Deputy Warden Shane Place, and corrections officers Daniel Kessler and Yvonne Whitney.

The suit alleges that corrections officers taunted the psychiatric inmate to kill himself – and he did on April 10, 2014.

The suit states:

Garza “was found hanging in his cell around 11:05 a.m. … That at 11:55 a.m. Garza was pronounced dead.”

” Jeremy Garza died as a result of Defendants” refusal “to respond to Garza’s safety complaints.”

Many questions are being raised tonight by those shock about the deaths of at least two U.P. prison inmates over the past week in the eastern U.P. The events occurred at the Chippewa Correctional facility and the riot-torn Kinross correctional Facility.

U.P. Breaking News has learned that inmates are being accused of causing the Kinross Riot – even though the state went to great lengths to say it was not a riot.

Plus three inmates were down in one night at the two state prisons in Chippewa County – including one who took a unknown amount of pills (that alone is alarming).

NOW COMES Plaintiff, DARREN FINDLING, as Personal Representative for the Estate of JEREMY ALAN GARZA, deceased, by and through his attorneys, JOHNSON LAW, PLC and for his Complaint against the above-named defendants, states as follows

JURISDICTION
1. That this action arises under the United Sates Constitution, particularly under the provisions of the Fourteenth, Fourth and Eighth Amendments of the United States Constitution and under the laws of the United States, particularly under the Civil Rights Act, Title 42 of the United States Code, Sections 1983 and 1988.
2. That this court has jurisdiction of this cause under the provisions of Title 28 of the United States Code, sections 1331 and 1343 and pendant jurisdiction over state claims which arise out of the nucleus of operative facts common to Plaintiff’s federal claims.

3. That Plaintiff brings suit against each and every Defendant in both their individual and official capacities.
4. That each and all of the acts of the Defendants set forth, MICHIGAN DEPARTMENT OF CORRECTIONS, WARDEN ROBERT NAPEL, DEPUTY WARDEN ALEXANDER, DEPUTY WARDEN SHANE PLACE, CO WAGNER, CO AARON VITALA, CO YVONNE WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, were done by the Defendants under the color and pretense of the statutes, ordinances, regulations, laws, customs, and usages of the State of Michigan, and by virtue of and under the authority of the Defendants’ employment with the State of Michigan.

5. That the MICHIGAN DEPARTMENT OF CORRECTIONS, is responsible for, and does in fact, hire train, supervise, and instruct wardens, deputy wardens, sergeants and correctional officers of all grades in the performance of their duties.
6. The amount in controversy exceeds $75,000.00, exclusive of Plaintiff’s claims for costs, attorney fees, interest and punitive damages.
PARTIES

7. Plaintiff’s decedent, JEREMY ALAN GARZA (“GARZA”), was a citizen and resident of Alma, County of Gratiot, State of Michigan and of the United States and is entitled to all rights, privileges, and immunities accorded to all citizens of the United States.
8. That Defendant MICHIGAN DEPARTMENT OF CORRECTIONS (“MDOC”) is formed pursuant to the laws of Michigan, and one of the functions of the MDOC is to organize, train, operate and staff correctional officer personnel in correctional facilities.
9. That Defendant WARDEN ROBERT NAPEL (“NAPEL”) , based on information and belief, is or was employed by the Michigan Department of Corrections as warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
10. That Defendant DEPUTY WARDEN ALEXANDER (“ALEXANDER”), based on information and belief, is or was employed by the Michigan Department of Corrections as deputy warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
11. That Defendant DEPUTY WARDEN SHANE PLACE (“PLACE”), based on information and belief, is or was employed by the Michigan Department of Corrections as deputy warden of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
12. That Defendant CO WAGNER (“WAGNER”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

13. That Defendant CO AARON VITALA (“VITALA”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
14. That Defendant CO YVONNE WHITNEY(“WHITNEY”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

15. That Defendant CO ROBERT LAFOREST(“LAFOREST”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, Case 217-cv-00018-GJQ-TPG ECF No. 1 filed 012517 the State of Michigan, and the United States.
16. That Defendant CO CUCCHI (“CUCCHI”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.

17. That Defendant SGT. BUSH (“BUSH”), based on information and belief, is or was employed by the Michigan Department of Corrections as a correction officer of the Marquette Branch Prison and was responsible for ensuring that Defendants enforced and abided by the policies and regulations of the MICHIGAN DEPARTMENT OF CORRECTIONS, the State of Michigan, and the United States.
COMMON FACTUAL ALLEGATIONS
18. Plaintiff hereby re-alleges each and every allegation in paragraphs 1 through 16 of this Complaint as if fully stated herein.
19. That GARZA was incarcerated at the Marquette Branch Prison, Level V.
20. That GARZA suffered from a psychiatric condition that Defendants failed to treat properly.
21. On April 10, 2014, the Michigan Department of Corrections records indicate that GARZA had a visitation with his mother Barbara Garza around 830 a.m. and that the visitation concluded at approximately 1030 a.m.
22. That after returning to his cell, GARZA observed Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, removing personal items from his cell for no apparent reason.
23. That GARZA complained to the Defendants, that they should leave his personal belongings alone, but they refused and gave no explanation as to why they were removing his belongings.
24. That as a result of the Defendants behavior, GARZA told the Defendants that he was going to kill himself.
25. That Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, started to laugh at GARZA and told him to “go ahead and do it”.

26. That on April 10, 2014, the Michigan Department of Corrections records indicate that GARZA was found hanging in his cell around 1105 a.m.
27. That at 1155 a.m. GARZA was pronounced dead.
28. Jeremy Garza died as a result of Defendants WAGNER, VITALA, WHITNEY, LAFOREST, andor CUCCHI, refusal to respond to GARZA’s safety complaints.

COUNT I 42 USC 1983 CONSTITUTIONAL DEPRIVATIONS

29. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 27 of this Complaint as if fully stated herein.

30. That the action and omission of acts by the Defendants under 42 USC Section 1983 was unreasonable and performed knowingly, deliberately, intentionally, maliciously, with gross negligence, callousness, and reckless indifference to Plaintiff’s well-being and in disregard of Plaintiff’s safety, with wanton intent for Plaintiff to suffer the unnecessary and intentional infliction of pain, failure to obtain timely medical treatment, and failure to properly train, supervise, develop and implement policies providing adequate medical and psychiatric treatment to an inmate and by reason of which Plaintiff is entitled to compensatory and punitive damages.

31. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, deprived Plaintiff’s decedent, GARZA, of his clearly established rights, privileges and immunities in violation of the Fourth, Eighth and Fourteenth Amendments of the Constitution of the United States, and of 42 USC Section 1983.
32. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, exhibited a deliberate indifference by intentional acts, gross negligence andor engaging in omissions to breach Plaintiff’s public safety and causing constitutional deprivation of his individual rights to wit

a. Failure to properly prescribe and monitor the appropriate medications for a mentally ill prisoner;
b. Failure to render the proper medical attention to a prisoner who was mentally ill;
c. Failure to properly train correction officers in the evaluation of whether a inmate needs medical treatment;
d. Failure to transfer Plaintiff’s decedent to a hospital to receive the necessary medical care;
e. A reasonable correction officer in Defendants’ position at the time of this incident prior to the decedent’s death, would have known that in light of the pre-existing law, that the unlawfulness of ignoring Plaintiff’s suicidal ideation statement was apparent and to ignore it under those circumstances would be a violation of that clearly established law;
f. Any and all other breaches as they become known throughout the course of this litigation.
33. That as a direct and proximate result of the aforementioned conduct and omissions of Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. of Michigan, Plaintiff’s decedent, GARZA, suffered pain, anguish, and ultimately death.
WHEREFORE, Plaintiff requests the following relief
a. Reasonable medical, funeral and burial expenses;
b. Conscious pain and suffering between the time of his injury and his death;
c. Loss of financial support;
d. Loss of service;
e. Loss of gifts or other valuable gratuities;
f. Loss of comfort, society and companionship;
g. Compensatory and punitive damages; and
h. Any and all other damages otherwise recoverable under USC Section 1983 and Section 1988.
COUNT II FAILURE TO TRAIN, INADEQUATE POLICIES ANDOR PROCEDURES, CUSTOMS AND PRACTICES AND FAILURE TO SUPERVISE- DELIBERATE INDIFFERENCE- MICHIGAN DEPARTMENT OF CORRECTIONS

34. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 33 of this Complaint as if fully stated herein.
35. Pursuant to 42 USC § 1983, as well as the Fourth and Fourteenth Amendments to the United States Constitution, Defendant MDOC owed GARZA certain duties to properly supervise, monitor and train its correctional officers and staff so as to monitor and supervise the jail’s prisoners so that they would detect serious medical conditions and facilitate prompt and immediate medical attention and/or transport to a hospital ER.
36. That Defendant, in its representative and official capacity, has maintained a custom and policy of improper training and supervision of its employees. Defendant is not protected by governmental immunity when following a policy that deprives individuals of their constitutional rights. Monell v N.Y. City Dep’t of Soc. Servs., 436 658, 690-91, 692 (1978).

37. That Defendant MDOC, was aware of previous incidents where individuals who were incarcerated at the Marquette Branch Prison were not afforded proper medical treatment, specifically as to mental health referrals and observations.

38. That Defendant MDOC was aware of the custom and practice of corrections officerswardens, deputy wardens andor staff ignoring suicidal ideation statements, similar to the actions of Defendants, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH.
39. The Defendant owed GARZA the following duties and obligations

a. To use due care and caution;
b. To adequately and properly promulgate guidelines and policies that comply with the requirements of 42 U.S.C. § 1983 regarding the incarceration of prisoners and the supervision of prisoners, especially those who are mentally and emotionally and physically unstable and especially those who are diagnosed as having psychiatric or psychological problems;
c. To adequately and properly train and supervise correction officers and employees of the Marquette Branch Prison under their supervision on the proper method of supervising prisoners and providing for their medical needs and on effectively controlling prisoners who have or are suspected to have psychological or psychiatric problems;
d. To avoid hiring or selecting individuals who it knows or should know are incapable of performing their responsibilities or who are likely to misuse or abuse the power conferred on them as employees of the Marquette Branch Prison.
40. MDOC breached these duties via its policies, procedures, regulations, customs andor lack of training and thus exhibited a reckless indifference toward its prisoners, and GARZA specifically, in the following ways, including but not limited to

a. MDOC’s failure to staff the jail with competent medical personnel so that a mental health professional;

b. MDOC’s failure to monitor their correctional officers and medical personnel to ensure that they adequately monitor and supervise inmates who have serious medical needs;
c. MDOC’s failure to have proper policies and procedures, and training to deal with inmates in the observation cell and ensure that the policies andor procedures are followed, which include serial examinations by competent and licensed medical and mental health personnel like RNs , Psychologists andor Doctors as well as its failure to ensure the correctional officers conduct timely and adequate rounds and record their observations of the inmates every 15 minutes as required by their own policies andor procedures;
d. MDOC’s failure to require that an RN, Doctor or Mental Health Professional perform a full and complete examination of a prison held in a medical observation cell, at least once per day;
e. MDOC’s failure to have proper policies and procedures in place to deal with jail overcrowding in the high observation units of the facility;
f. MDOC’s failure to fully investigate and discipline its correctional officers andor medicalmental health personnel who do not abide by its policies and procedures relative to providing medical care for serious conditions; and,
g. All other breaches learned through the course of discovery.
41. That Defendant MDOC trained their officials andor employees and agents in such a reckless and grossly negligent matter, that it was inevitable that the officials would place a suicidal prisoner in a cell where she would not be supervised when it was obvious that such a prisoner needed constant supervision. Notwithstanding GARZA’s contemplation of suicide, Defendant repeated and acquiesced in the continued practice of not placing potentially suicidal prisoners, such as GARZA, under close supervision and acquiesced in the repeated and continued practice of not adequately treating suicidal inmates in obvious need of treatment.

42. The failure of the Defendant to provide training and supervision regarding the prevention of suicides amounts to deliberate indifference to the safety and lives of the inmates of the Marquette Branch Prison and particularly GARZA.

43. Defendant MDOC is a supervisory official who knew or in the exercise of reasonable care should have known that individual prison officials had engaged in misconduct and other violations of the constitutional rights of prison inmates at the Marquette Branch Prison, more specifically of GARZA.
44. Despite knowledge of its aforesaid pattern and practice, the Defendant failed to properly investigate the improper practices and to supervise and train the prison officials at the MDOC.

45. Defendant MDOC developed a “hands off” policy or custom with regard to the omissions of individual prison officials which encouraged the individual officials to believe they could violate the constitutional rights of GARZA with the explicit or tacit approval of the Defendant herein.
46. As a direct and proximate result of the above cited violations of GARZA’s civil rights by Defendant, GARZA died and thus his estate, through Darren Findling, has and will continue to suffer damages in the future, including, but not limited to

a. Reasonable medical, hospital, funeral and burial expenses;
b. Reasonable compensation for the pain and suffering undergone by GARZA while he was conscious during the time between his first psychiatric symptoms and his death;
c. Loss of financial support;
d. Loss of service;
e. Loss of gifts or other valuable gratuities;
f. Loss of comfort, society and companionship;
g. Compensatory and punitive damages; and
h. Any and all other damages otherwise recoverable under USC Section 1983
and Section 1988.
WHEREFORE, Plaintiff respectfully requests that this Honorable Court enter judgment in his favor and against Defendant, including punitive damages under 42 U.S.C. § 42, in excess of $75,000.00 together with interest, costs and attorney’s fees.

COUNT III NEGLIGENCE AND GROSS NEGLIGENCE

47. Plaintiff hereby re-alleges each and every allegation contained in paragraphs 1 through 46 of this Complaint as if fully stated herein.
48. That acts and conduct of Defendants alleged in the above stated cause of action when considered under the laws of the State of Michigan, constitute gross negligence and the Defendants are not entitled to the immunity of MCL 600.1407(2) because they were grossly negligent.
49. That the conduct of the Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, exhibited a deliberate indifference by intentional acts andor omissions amounting to gross negligence.

50. At all relevant times, Defendants, were grossly negligent in one or more of the following ways

a. Failure to properly prescribe and monitor the appropriate medications for a mentally ill prisoner;
b. Failure to render the proper medical attention to a prisoner who was mentally ill;
c. Failure to properly train correction officers in the evaluation of whether a inmate needs medical treatment;
d. Failure to transfer Plaintiff’s decedent to a hospital to receive the necessary medical care;
e. A reasonable correction officer in Defendants’ position at the time of this incident prior to the decedent’s death, would have known that in light of the pre-existing law, that the unlawfulness of ignoring Plaintiff’s suicidal ideation statement was apparent and to ignore it under those circumstances would be a violation of that clearly established law.
e. Any and all other acts of gross negligence as they become known throughout the course of this litigation.

51. That as a direct and proximate result of the aforementioned conduct and omissions of Defendants, MDOC, NAPEL, ALEXANDER, PLACE, WAGNER, VITALA, WHITNEY, CO ROBERT LAFOREST, CO CUCCHI, and SGT. BUSH, individually, andor as agents of the State of Michigan, Plaintiff’s decedent, GARZA, suffered pain, anguish, and ultimately, death.

WHEREFORE, Plaintiff, Darren Findling, as Personal Representative of the Estate of Jeremy Alan Garza, deceased, respectfully requests this Honorable Court enter Judgment in their favor and against Defendants jointly and severally, an amount in excess of $75,000, pursuant to 42 U.S.C. § 1983, exclusive of costs, interest, attorney fees, and punitive damages.

General  

 Marquette Branch Prison  was authorized by the Michigan State Legislature in 1885. The prison was subsequently built on the shores of Lake Superior on property that was a gift to the State from the Marquette Businessmen’s Association. The prison was completed in 1889 at a cost of less than $200,000.
The Level V portion of the prison has three General Population housing units and three Administrative Segregation housing units. There are four Level I housing units which are located just outside the Level V portion of the facility. 

Programming


 Adult Basic Education and General Education Development completion are offered.  Other programs include substance abuse treatment and religious services.  Available activities include law library, general library and hobbycraft.  Many program resources are expanded through participation by community volunteers, such as local clergy and lay people, which gives prisoners increased opportunities to participate in programs.
Prisoners are provided with on-site routine medical and dental care. Serious problems are treated at the department’s Duane L. Waters Health Care in Jackson. Emergencies can be referred to a local hospital.

 The Level V perimeter is protected with a concrete wall, razor-ribbon wire, electronic detection systems, and eight gun towers. Level I is surrounded by two chain link fences and an electronic detection system.

The trio were arrested this morning after a high-speed chase in downstate Cheboygan County, MI reaching speeds of more than 100 miles per hour and then jumping into a freezing lake.

Cops confiscated seven stolen guns and drug paraphernalia.

The suspects fled the pickup and one tried to cross Mullet Lake.

Two stopped and were arrested; and the third busted after deputies used a hovercraft chasing the man ashore at a home on the other side of the lake at a home.

The trio remains in the Cheboygan County Jail.

(Ewen, MI) – A trio of drug-fueled meth and burglary suspects described as armed and dangerous are wanted tonight in numerous camp and home break-ins involving rifles, shotguns, and more

“The suspects are known to use and manufacture methamphetamines and are believed to be armed at this time.”

The two-state crime spree began yesterday in the Ashland, WI area – about 40 minutes from the border with the western U.P.

“Be-on-the-lookout for a stolen vehicle from Ashland County, Wisconsin involved in multiple B and E’s,” said one of several dispatchers across the U.P. who read the bulletin to all officers late this afternoon.

At 10 a.m. today (Wed., Jan. 25, 2017), witnesses placed the suspects at a camp break-in in Ewen, Michigan – in Ontonagon County. In that U.P. break-in guns were also stolen.

The suspects are known meth users, according to a U.P.-wide police broadcast this afternoon.

“Multiple long guns were taken” in home and camp burglaries in NE Wisconsin and the U.P. of Michigan.

Police across the U.P. are searching for the stolen pickup the three suspects are believed to be riding and pulling off burglaries.

It is a late model white Chevrolet Avalanche four-door pickup truck with Wisconsin license plates: FT9824

The vehicle was stolen 5:25 p.m. Central Time on Tuesday in Mellen, Wisconsin in Ashland County.

The vehicle has been tied “to multiple B and E’s involving long-guns (shotguns, rifles) in Wisconsin and possibly one in Ewen,” the broadcast stated.

They are suspects in the larceny of a hunting camp in Ewen, MI:

“If located use caution due to the larceny of the weapons”

“Suspect vehicle in the larceny of a hunting camp in Ewen in Ontonagon County”

“Three long guns and miscellaneous other items were stolen from the camp in Ewen. Any eyewitness puts the vehicle at the camp today at approximately 10 a.m. Eastern Time.”

(Upper Peninsula of Michigan/NE Wisconsin) – The constant drizzle of rain over the western Upper Peninsula is causing black ice issues and now snow falling off home and business roofs.

Black ice and fog will making driving hazardous across the U.P. and northeast Wisconsin into the afternoon Saturday, Jan. 21, 2017.

U.P. Breaking News has monitored at least three calls about snow sliding off roofs in the western U.P. taking down power lines and cable lines.

The latest location was at a  “First National Bank” in Gogebic County. We only found one on the map. Not sure if it bank in Bessemer or Wakefield.

The road at the bank was reported to be blocked by a huge snow slide. Roofs are snow melt – refreezing on roofs – makes the chance of a slide over roofs with lots of snow.

A cell phone tow was reported down in Bessemer – we think that means service – not literal – not sure.

Also tonight it appears paramedics in western U.P. shocked an elderly man in cardiac arrest at a local business and his heart restarted – and they rushed him to Portage hospital.

There was also an ugrent premature baby ca;ll at a western U.P. motel – all in a short time span.

A major alert from the Houghton County Sheriff’s Department tonight about that missing man who goes by his middle name: “Ryan.”

In fact, in recent months U.P. Breaking News has been contacted by so many people who have unsolved murder cases, suspicious deaths and people not likely to go missing who vanish. U.P. Some names released in Iron River, MI fatal crash

(Iron River, MI) – Officials have released the names of some of those involved in that tragic predawn fatal accident near Iron River, MI involving a huge snow grader that was rear-ended by an SUV loaded with family and killing the teenage son of the driver.

The accident happened around 8 a.m. Central Time Wednesday as an Iron River Road Commission Grader that was scraping the shoulder of the highway.

The accident on Wed., Jan. 18, 2017 closed U.S.-2 for seven hours near Iron River, MI.

The driver of the SUV was 35-year-old Angela Esbrook of Iron River, MI.

Esbrook and two other passengers, a 12-year-old female and a 17-year-old male, were seriously injured and transported to Aspirus hospital.

The driver of the grader, who is among three people police have not identified publicly, sought his own treatment for minor injuries

The accident remains under investigation and has shocked the community of iron county – where the word spread quickly Wednesday that an Iron River woman had suffered an unspeakable tragedy – the death of her son while she was driving . The name of the victim appeared on the internet after family was notified but before officially released by police.

Fatal Crash update and Black Ice Bulletin 1-18-17 7:07 p.m. ET 6:07 p.m. Central Time:

Beware if you drive over next 12 hours – weather won’t seem too bad for January but watch out for the black ice that triggered many accidents last night and this morning.

Warmer temps caused snow to melt today just like Tuesday – and that means black ice tonight.

Roads will refreeze across the U.P. tonight – and triggered an onslaught of traffic and snowmobile accidents.

One person was killed and others badly injured in a fatal accident on U.S.-2 west of Iron River that involved an SUV slamming into the rear of a large snow grader before dawn this morning.

The Iron County Road Commission grader was clearing the side of the highway when the accident happened – and the driver received his own treatment for minor injuries.

No names have been released. Three victims from an SUV were rushed to Aspirus Iron River Hospital – and one passenger was killed at the scene. After being closed for over seven hours, the highway was reopened.

The crash remains under investigation – and those helping are: The Iron County Sheriff’s Department, Iron County 911 Central Dispatch, West Iron County Fire Department, Iron County Search and Rescue, Michigan State Police Accident Investigator, paramedics and ambulances from Aspirus EMS and the Iron River Police Department.

Morning Turns Into Mourning in Iron County, MI after Snow Grader and Car Crash

(Iron River and Upper Peninsula of Michigan) – A least one person was killed this morning and others injured in a horrible accident involving a car and a large snow grader.

The accident was reported about 8 a.m. Central Time on U.S. Highway 2 – just west of Iron River.

A Michigan State Police Accident Investigator was called to the scene as were the Iron County Sheriff’s Department, Iron River police, Iron County Search and Rescue, firefighters and other agencies. One vehicle was reported on fire or smoking – and all the victims in the car were said to be trapped.

It was the latest in numerous serious accidents have been reported in past 24 hours across the U.P. along with hundreds of vehicles of all kinds into snowbanks in past few days.

Slippery roads are being reported in many areas.

The crash was on U.S. 2 just west of Iron River, MI in Iron County and one report said a child was involved

U.S.-2 has been closed for hours after the crash – detouring traffic onto the Gibbs City Road and local roads back out on the highway.

Detours include Gibb City Road to AMVETs on highway coming from Iron River

About the same time this morning, a 35-year-old male driver possible received a broken leg and was taken to the hospital after his four-door car crashed into a tree along M-35 near County Road MI – south of Palmer, MI. The victim reportedly crashed into maple trees about 20 feet off M-35 and reportedly traveling about 45 miles per hour.


And reports of a major crash on U.S. 2 overnight in Schoolcraft County – no information available

There must have been a terrible accident in the Baraga County area Tuesday afternoon or last night (1-17-17) – because at least one seriously injured patient has been rushed to Marquette hospital.
Its not clear if this was a snowmobile or car accident – or what caused trauma.
Baraga County Memorial Hospital transferred a badly injured trauma victim last night to emergency room intensive care at the U.P. Health System – Marquette hospital.
Transported by the Bay Ambulance Service, 31-year-old female had multiple trauma fractures but was alert and oriented (times three) and had good vitals
Injuries included compression fractures to the spine, and right collar bone fracture, and serious internal injuries (we are not listing those) – but vitals and more sounded strong.


Meanwhile about 7:15 Tuesday night in Marquette County – a vehicle rammed into a home after hitting two parked vehicles about a mile from Teall’s 581 Market at 29907 County Road 581 south of Ishpeming, Michigan. The wreck happened near Tony’s Lane.

A press release indicates the driver may have suffered medical issues and blacked out. The victim was driving his 2008 Chevy Silverado pickup when it struck a parked pickup truck – and that pickup truck was pushed into a mobile home and into a corvette owned by Terry Mattila
The driver who blacked out is 29-year-old David Schneider of Ishpeming – who was not injured. Both pickup trucks were totaled and the Corvette received moderate damage.

(L’Anse, MI) – Dozens of SEMCO employees who traveled from downstate to help warm and relight the Christmas celebration in a small Upper Peninsula community – found love expressed the Yooper way – as all involved tried to cope with the unexpected 2016 L’Anse Christmas Heat Crisis.

harleywakeham-1Meanwhile the driver – 18-year-old Harley Wakeham of Chassell – charged with causing the wreck allegedly falling asleep at the wheel – and is lucky to have received only minor injuries because the natural gas lines exploded instantly – sending flames 60 feet or high into the air.

The three-day crisis was effectively done in a day and a half – and began about 3:40 a.m. on Friday morning, Dec. 23, 2016 when a crashed into a vital substation causing an explosion and huge flames to shoot up into the cold Upper Peninsula morning. The fire was videotaped by several residents – three of which have shared their videos and photos with U.P. Breaking News. They are Trevor Uren, Bob Gustafson and  Jerry Fish, Jr.

The tiny Lake Superior community of L’Anse, Michigan didn’t have to wait long for more fun as an overnight storm left ice in its wake in the western U.P. with power outages and hundreds of big downed trees.

As of 1:30 p.m. today, less than 10 homes out of 1,200 customers were not turned back on and only because the occupants are apparently out of town for the holidays, said Baraga County Sheriff Rick Johnson.

Wakeham was northbound – headed toward Chassell – when his 2003 Pontiac Grand Am left the road and crashed into natural gas piping and a substation, Sheriff Johnson said.

Wakeham managed to get himself out of the burning car very quickly, Sheriff Johnson said.

The flames shot “pretty high” into the air, the sheriff said, adding he was told by deputies that flames “were shooting 60 feet high.”

Wakeham “apparently fell asleep” at the wheel and was ticketed for “careless driving,” Sheriff Johnson said.

Wakeham is “very lucky” to be alive, as the car was quickly engulfed.

The Baraga High School was opened as a warming center, but was not needed because the relatively mild temperatures reached the mid to upper 30s.

We heard local radio stations did a great job keeping the public up to date, since the newspapers were not printing for holiday

Michigan State Police and generators from private companies in Marquette, MI apparently assisted a local nursing home until heat returned.

Its not clear if Wakeham will have to pay for a portion of the damages – and a total bill has not been tallied.

Wakeham sought his own medical treatment – and “did not” flee the scene, as witnesses first indicated.

“It was instant – it happened very quickly,” said Baraga County Sheriff Rick Johnson. “The car burned in the fire.”

Speed and alcohol were not a factor in the crash and the roads were clear and dry, Sheriff Johnson said.

The Baraga County Sheriff’s department was assisted by the KBIC Tribal Police – and the L’Anse Fire Department put out the flames that caused U.S.-41 to be closed for about an hour.

The sheriff said all the agencies worked together closely and he agreed that SEMCO “pulled out all the stops.”

That’s just what happened.

“We mobilized several crews from downstate,” said Timothy Lubbers, SEMCO Director of Business Development.

I found out early this morning that all of our crews made it back to their homes safely” most in time to spend a small portion of Christmas with their eagerly waiting families, said Timothy Lubbers, SEMCO Director of Business Development.

Officials from emergency management, and many other sources will tally up the crisis bills in the near future, but the number one goal was achieved.

We’ll get the costs of everything later – our goal was – everyone back on – and everybody safe,” Lubber said.

As impressed as L’Anse residents were with the courtesy and quick action of SEMCO employees, these folks traveled back to their homes with tales of kind, generous Yoopers – who brought soup, beverages, Christmas cookies and baked goods – to where the SEMCO crews were gathered for quick response.

30-year SEMCO employee Steve Mudd says the L’Anse trip was one of his best:

“As a SemcoEnergy employee for over 30 years and worked in outage’s all over including Hurricane Sandy in New York.

I just want to say how moved I was by the kindness of all the people I was able to relite after driving 11 hours from the bottom of the state of MI “Niles” my first night in you GREAT town, I have never been so moved in all my years and will never forget this trip.”

“And on Christmas morning myself and the other employee that came your way to help left at 5am to head home to our family for Christmas, low on gas we made it into Wisconsin to a Shell gas station that was open 2hours from your town,fueled up and a pop in are hands a lady came in the store to thank us again on her way to spend Christmas with her family.

We’ve had over 45 people from the Lower Peninsula” traveled on Friday, Christmas Eve morning 2016 to the Upper Peninsula to help re-light the 1,200 homes of L’Anse, MI. For some of the SEMCO employees responding to the emergency “it took eight or 10 hours to get there” to L’Anse.

In addition SEMCO had “10 to 15 (employees) already in the Upper Peninsula that we sent there to manage” the early repairs and help re-lighting of homes. We had to go individually and shut down everyone” and make repairs to the pipes, electronics and other destroyed items at the substation that went up in flames Lubbers said.

By the time the crews from downstate got up there we were ready to re-pressurize the system and then relight everyone” in the village of L’Anse, that is nestled on the east side of the bottom of the Keweenaw Bay on the shores of Lake Superior.

“The vehicle actually went through our fence” and struck the SEMCO “city gate station” – basically a substation small building with electronics and pipes, he said. The vehicle hit “some piping” where SEMCO brings in gas from other sources.

The piping involves the location where SEMCO “that we take gas from the interstate pipeline and then we measure and regulate it down to a lower pressure and distribute it to customers – and in this case it is the community of L’Anse,” Lubbers said. The car “went through our fence at the city gate station – knocked off some gas – and there was flowing gas,” Lubbers said. “I do not know what ignited the gas.”

Then, once emergency officials responded to the accident – U.S. 41 was closed down for more than an hour – as crews “shut off the gas.” The SEMCO employees “are from different parts of Michigan” including “The Port Huron and Chesterfield areas, and the Battle Creek and Niles areas, and the Holland area.”

All these employees were able to drive back across the Mackinac Bridge heading south – to be with their families downstate late Christmas Day- and all arrived safely home.

(L’Anse, MI) – The heat is back on in L’Anse, Michigan even before the end of Day Two of the 2016 L’Anse Christmas Heating Crisis.

Official Day Three of the Crisis would be 3 a.m. Christmas Day. But it appears except for a handful of homes, everyone has been re-lit thanks to round the clock love, attention and care of natural gas workers from around the state.

Thank you to SEMCO and their employees,” said L’Anse resident Renee Eliason. “Some of these workers came from Niles, MI.”

“I know they are getting paid and all – but the 2 guys who came to my house – pretty close to 2 a.m. were nice, friendly and got the job done,” Eliason said on Facebook. “Thank goodness we do not have sub zero temps!!”

Also, if anyone needs transportation to the warming center in Baraga, please call 353-6664 and it’ll be arranged for you. The Baraga Area Schools Facebook page and website have updates on the situation as well.

The Tribe will have space heaters available for KBIC elderly members and households with children first and any remaining units will be provided to residents of the KBIC Housing. The heaters will be available for pick up at the Zeba Hall beginning at 4 pm until 6 pm today. One heater per home will be available. SEMCO crews worked through Friday night and Saturday to re-establish customer gas service. As of 7 p.m. Christmas Eve, all but approximately 86 customers have been restored. (L’Anse, MI) – Officially into the second day of the 2016 L’Anse Christmas Heating Crisis – there is good news on many fronts.

A little more than 22 percent of the L’Anse homes have had natural gas restored by 6 a.m. At least 340 homes out of 1,500 homes had natural gas by 5:45 a.m. – thus heat and gas for cooking.

L’Anse residents have been impressed with the dedication of the natural gas workers – and others involved in returning the community to normal.

SEMCO workers knocked on my sister’s door at 2:30 this morning to put her heat back on. They have been working round the clock!,” said Leona Rowe today.

“They deserve much credit and praise for this, Rowe said.

Early today L’Anse resident Meghan Maki posted a photo of the natural gas repairs crews and thanked them for helping on Christmas Eve:

U.S.-41 following fiery crash and blaze reported just east of L’Anse, MI

The incident began about 4 a.m. on Fri, Dec. 23, 2016 – when the driver of a car lost control – possibly fell asleep – and ran off U.S.-41 and struck a major natural gas main that exploded.

Baraga County Emergency management officials and the county board are expected to seek disaster funding from the state and federal government and are preparing a declaration to submit to Lansing, MI.

A warming Center was set up at the L’Anse Area High school.

Other reported warming centers include the Ojibwa Community College and the Big Bucks Bingo Hall.

The crisis is expected to cost into the millions for repairs and other assets devoted to keeping people safe. A local nursing facility has received extra special attention to make sure residents are comfortable and fed. The Baraga Memorial Hospital never had issue as it operates off oil. Baraga County Emergency Operations found its main HQ without natural gas.

U.P. Breaking News has been receiving reports through the night from our readers that gas and heat has been restored to some of those closest to the disaster 0- as it began with that crash – that caused a two-hour closure of U.S.-Highway 41 west of the Falls River Bridge.

The first phase of restoration of gas service to L’Anse has been accomplished, SEMCO has completed the shutdown of each customer valve in the outage area. SEMCO is now in the process of restoring the pressure in the system and, once that is complete, SEMCO crews will begin going to each individual customer to reestablish service. The relight process is expected to begin within the hour.

It is important to remember that someone must be home to allow SEMCO into the home so that crews can ensure appliances are operating properly. In addition, SEMCO is asking customers to turn on porch or front room lights where possible.

L’Anse Outage Update 12/23/2016 8:00am
Early this morning a vehicle accident in L’Anse Michigan resulted in a natural gas service disruption to SEMCO’s customers in the L’Anse area.

We understand that a natural gas service disruption is challenging, particularly in the cold winter months and SEMCO crews are working to reestablish service as soon as possible.

Emergency Management officials are working to establish a warming center in the area.

Because natural gas outages are very infrequent, customers may not be aware of the process involved in restoring service. The first step is that gas company personnel will manually shut off the valve at each individual residential and commercial gas meter. The pressure in the gas system will be restored and service to all customers will be restored individually. SEMCO employees will need access to each home in order to reestablish service and ensure all natural gas equipment is operating properly. Please do not try to restore service yourself.

Currently the Mackinac Bridge is closed to all traffic. We are experiencing falling ice from the cables and towers on the bridge.

Motorists are advised to reduce their speed to 20 miles per hour as they approach the bridge and be prepared to stop. Bridge personnel are stationed at both ends of the structure to provide instructions.

The Mackinac Bridge Authority is monitoring the conditions at various points along the structure. When conditions improve, the bridge will be reopened to traffic. If you are planning to travel to the Straits area, please tune to AM 530 or 1610.

Update 7:25 a.m. CT/8:25 a.m. ET – URGENT IRONWOOD TOWNSHIP, MICHIGAN – AND WATERSMEET, MI US-2 CRASH

Officials are at the scene of a rollover accident on U.S. Highway 2 just – one mile west of Highway 45 – just outside of Watersmeet, MI.

One male (a big gentleman) and one female with a head injury were able to get out of the overturned vehicle.
The roads in Gogebic County and elsewhere “are terrible,” according to a dispatcher sending Watersmeet Rescue units

There is a big icy mess everywhere across the U.P. now – as trees fall and powerlines droop.
There is lots of police traffic about trees and powerlines down on Sunset Dr.
“There are lots of police, ambulance and fire trucks around, and they are sliding all over the place,” said a snowplow driver attempting to help at one of the aftermath locations in Gogebic County.

Flooding of low lying areas also said to be an issue.

The storm has moved to the eastern U.P. – However driving is still very dangerous – now occasional snow as storm moves east – and the clean up.

Currently we are experiencing winds of sufficient force in the Straits area to issue a warning to all motorists preparing to cross the Mackinac Bridge.

Examples of vehicles especially vulnerable to high winds are pickup trucks with campers, motor homes, vehicles pulling trailers and enclosed semi-truck trailers. Motorists must reduce their speed to a maximum of 20 miles per hour, turn on their four way flashers, and utilize the outside lane. Motorists are asked to exercise appropriate caution.

Winter Weather Slams Upper Peninsula of Michigan – driving deadly

(Upper Peninsula of Michigan) – After Christmas traffic accidents – and vehicles sliding into snowbanks – were being reported as a deadly wintry mix of ice, sleet and snow was slamming the highways and roads across the Upper Peninsula of Michigan.

Plus – the storm behind this storm – and the one behind that – are on their way here. All are winter storms that will eventually reach the U.P.

Just as snowplow drivers were reporting heavy blowing snow – minutes later it was turning to rain – then ice.

Snowplows were reporting heavy snow in some areas – while in others it is sleeting a deadly ice/rain mix. Ice is covering trees, roads and everything in some areas. Delay all travel. Don’t drive.

But – law enforcement, snowplow drivers, EMTs, paramedics, firefighters and others have to drive to keep you safe – and incredibly a “transplant” team was reported leaving U.P. Health System –  Marquette via a plane. So even doctors, nurses and all support staff had to be there for the unknown transplant.

In fact, it appears the U.P. will get hit with several severe winter storms over next few days – what’s happening to the west – like Minnesota and Wisconsin – is headed to the U.P.

But the immediate threat is the roads are too slippery for travel. Period. Additional plows are being called-in to help, but the driving is treacherous.

A two-vehicle accident involving an off-duty Northern Michigan University police officer was reported about 10:30 p.m. Christmas night at the intersection of 7th Street and College Street in Marquette, MI.

Fortunately no injuries, and the complete identity of the NMU Public Safety Officer was not known to U.P. Breaking News, we are told that due to holiday – and for another reason – his friend’s will understand why we call him “St. Nick.”

Non-compliant sex offender among two suspects cops nab for allegedly stealing a car at the Bonifas Art Center in Escanaba, MI and bringing it north to Harvey, MI – nabbed by Michigan State Police, Marquette Police and OnStar

(Escanaba, MI) – Jailed this morning are a non-compliant Michigan Sex Offender Against Children with a lengthy criminal record and another young man arrested in Harvey, MI late last night by Michigan State Police with  on-the-spot Marquette Police assisting.

With help from the car tracking system OnStar, marked and unmarked units swarmed the vehicle as it slowed by entering Harvey on U.S.-41 south – after being tracked since at least Limestone Township in Alger County.

Police carefully set the trap with OnStar to ensure no body was injured and had over an hour to coordinate the stop – although the actual arrival time had to be played by ear – and as numerous other medical and police calls were already keeping police very busy  including in Chocolay Township. In recent months alleged dangerous fugitives have been nabbed through mutual aid by police agencies  – and caught by Marquette Police and MSP in Chocolay Township including this summer’s hotel robbery.

OnStar made the car slow and flash it lights. Troopers and police officers sprang the trap and stopped  the alleged stolen car at 11 p.m. (last night, Thurs., Dec. 23, 2016) as it coasted into a strip mall parking lot on M-28 at U.S.-41 South.

The incident began three hours earlier Thursday night when the owner of the car noticed while walking to her spot after dark – there was recent snow instead of her vehicle that had been parked at the Bonifas Fine Arts Center in Escanaba. Her Silver Sonic was gone – and snow had filled the space indicating it had been gone for some time – maybe hours. The cart had a valid Michigan prestige license plate: FOZART

That car was towed to a Marquette wrecker service to be held for the owner or if police need evidence.

A few weeks ago, U.P. Breaking News revealed that dozens of U.P. sex offenders are roaming free even though declared non-compliant. Since then – several have been picked up.

Lodged in the Marquette County Jail on suspicion of auto theft (UDAA – Unlawfully Driving Away and Automobile) are:

Kyle McDaniel, 20, of the Gladstone/Escanaba, MI area

McDaniel has a long criminal history

Thomas Andrew Harris, 19, Delta County address unknown


In Aug. 2015, McDaniel, age 19, of  Escanaba, served 77 days in jail and fine over $900 after he pleaded guilty to attempted property theft for receiving/concealing motor vehicle.

In another case at the time, McDaniel pleaded guilty to accosting a teenage girl for immoral purposes during an April 2015 incident in Escanaba that involved a 13 to 15 female victim. Bond was $100,000. McDaniel has been ordered to have no contact with any minor child. He was sentenced on April, 22, 2015 to five years in state prison and had to register as a sex offender. Its not clear why McDaniel was free. There is a police officer safety caution and a sex offender’s alert in his file.

In Nov. 2013, while a 17-year-old in Wells Township, McDaniel was sentenced to nine months in jail for seriously assaulting a relative in the spring of 2012. He pleaded guilty to assault with a dangerous weapon/felonious assault. McDaniel reportedly told a judge he understood the terribleness of his actions.

The male relative was attacked with a mop handle at their home and was hospitalized for numerous serious and life threatening injuries including broken ribs and a collapsed lung.

Other charges were dropped involving arson and assaulting or resisting a police officer. MSP has to force their way into the the barricaded home, putting out a small fire McDaniel allegedly set, arrested him and rescued the victim. A judge has reportedly said McDaniel suffers from mental illness.
