Federal prosecutors on MITW aggravated rape case: “Cannot prove the case beyond a reasonable doubt.”

On Jan 23, 2018, Chief United States District Judge William C. Griesbach approved “an order granting the government’s motion for leave to dismiss indictment” against 19-year-old Justin A. Schneider of Keshena, WI. Schneider faced life in prison if convicted.

Its not clear if the dismissal of the charges was with or without prejudice – which determines whether the charges can be refiled in the future. Scroll down to read or download the federal paperwork

Federal prosecutors last Monday, Jan. 22, 2018 requested the judge dismiss the charges in a “motion for leave to dismiss indictment.”

Keshena Shocker: Federal prosecutors drop MITW aggravated rape charges against Justine A. Schneider of Keshena, WI

Schneider was indicted on June 6, 2017 on one felony charge of “aggravated sexual assault” charging that that he brutally raped another member of the Menominee Indian Tribe of Wisconsin.

Schneider was released on personal recognizance bond on June 14, 2017 about a week after his arrest – with no objection by federal prosecutors.

Keshena Man Indicted for Sexual Assault on Menominee Indian Reservation

Gregory J. Haanstad, U.S. Attorney for the Eastern District of Wisconsin, announced that on June 6, 2017, a federal grand jury returned a one-count indictment against a man allegedly involved in a sexual assault on the Menominee Indian Reservation. The indictment named Justin A. Schneider (age: 18) of Keshena, which is located on the Menominee Indian Reservation. The indictment charges Schneider with Aggravated Sexual Abuse in violation of 18 United States Code, Section 2241(a)(1). Schneider faces a maximum sentence of life in prison, up to a $250,000 fine, and between 5 years and a lifetime of Supervised Release.

(Upper Peninsula of Michigan) – You don’t often hear the police call for firefighters at the cop HQ or 911 – but it happened twice almost simultaneously this morning in the U.P. of Michigan.

Marquette firefighters are on the scene of an apparent electrical fire at the Marquette Police Headquarters.

Meanwhile – same thing was just reported at the Enhanced 911 Dickinson County Dispatch Center – located in the county building in Iron Mountain, MI.

A dispatcher in Iron Mountain said their entire system went down. Dickinson County 911 was filled with smoke – plus electronics are fried from computers to LEIN.

Marquette PD reported its problem about two minutes before Iron Mountain PD but could have been simultaneously.

Are they related due to timing and/or weather. If they are not related to either – then its a coincidence involving lotto type odds.

“The fire department is headed your way,” said a 911 dispatcher to a police official at the Marquette Police Headquarters.

The problem is “smoke coming out of their main frame computer room,” a dispatcher told firefighters in Marquette.

Not clear if its weather-related. No injuries reported.

Only two days ago firefighters rushed to a U.P. hospital hecause of an active electrical fire.

Iron Mountain firefighters were called Saturday night to the Dickinson County Memorial Hospital.
An “active electrical fire” was found in the rear of the hospital. No Injuries reported.

Meanwhile – the raging snowstorm has made driving inadvisable through at least tomorrow (Tuesday) afternoon. The storm has already caused several rollovers/accidents. Plus power outages reported in some areas.

Tribal man sent to federal prison for shooting a bullet next to a woman in his MITW home

(Green Bay, WI) – A member of the Menominee tribal nation was sent to federal prison this week for attacking a woman on the reservation – and shooting a .22 bullet from a handgun into a couch on which she was sitting – while stating he wanted to kill her.

The attack occurred during the early summer of 2017 on the grounds of the Menominee Indian tribe of Wisconsin (MITW) nation.
30-year-old Dillon J. Peters, Sr. of Neopit, WI was sentenced this past week to almost six and a half years (77 months) in prison by a federal judge. He could have received 10 years. There is no parole in the federal prison system.

“I should kill you,” Peters told his terrified victim – firing a shot next to where she was seated.

Peters was sentenced at the federal courthouse in Green Bay by U.S. District Court Judge William C. Griesbach, the chief judge serving the Eastern District of Wisconsin. Peterson was sentenced on Mon., Jan 8, 2018 – and the judgment was officially entered on Thurs., Jan. 11.

Dillon Peters felony information 2

Peters admitted assaulting a female victim identified only as “Jane Doe.” In a plea agreement with federal prosecutors, Peters admitted he threatened “Jane Doe” with a firearm while attacking the woman at his residence. The terror the woman suffered occurred during the weekend of May 5-7, 2017.

Peters fired a shot into a couch that the victim was sitting on and told Jane Doe he wanted to kill her.

“I should kill you,” Peters told his terrified victim – firing a shot next to where she was seated.

The bullet was recovered lodged in the wall of Peters home. Detectives also found a bullet hole in the couch.

Both Peters and the victim are enrolled members of the MITW.

In the plea agreement, federal prosecutors dismissed a two-count indictment – and charged Peters with a one count felony information, a charging tool other than going to the grand jury.

He pleaded guilty to brandishing a firearm in the furtherance of a violent crime. The second felony charge – assault with a dangerous weapon – was dismissed although Peters admitted he committed that crime.

Under the agreement, federal prosecutors stated they would ask the judge to sentence Peters to 10 years in federal prison – and that Peters “must argue for at least 96 months in prison.”

The federal prosecutors in the case are U.S. Attorney for the Eastern District of Wisconsin Gregory J. Haanstad and Assistant U.S. Attorney Andrew J. Maier.
Peters is represented by defense attorney Gary S. Dodge, Sr. of Shawno.
