Federal Judge Robert Holmes Bell sent many heavily armed and murderous drug dealers, gangs, gun-runners and just plain bad people to prison  – from the Upper Peninsula and down to Grand Rapids, Kalamazoo and Benton Harbor.

In the federal system there is no parole, so when he sentences someone 20 or 30 years – that is what they serve.

Grand Rapids Man To Spend Five Years In Prison For Trafficking Firearms

GRAND RAPIDS, MICHIGAN – Donte Timothy Bacon, 31, of Grand Rapids, was sentenced to 60 months’ imprisonment, Acting U.S. Attorney Andrew Birge announced today.

In August, Bacon pled guilty to selling a firearm to a prohibited person and possession of a firearm with an obliterated serial number. Charles Lee Samuels, 28, earlier was sentenced to 18 months in prison for his lesser role in the crimes.

On five different occasions in August and September 2014, Bacon sold a firearm to a person who was not permitted to possess it under federal law. One of the firearms was sold with a high-capacity magazine. Two of those firearms had been purchased by Bacon and Samuels and were sold after Bacon removed the serial numbers. During the final transaction, Bacon and Samuels used a hand-grinder to remove the serial number at the time of sale.

In his final sentencing before retiring from the bench, U.S. District Judge Robert Holmes Bell observed the seriousness of trafficking firearms. Judge Bell ordered Bacon to serve three years of supervised release following his term of custody and expressed his hope that Bacon will return as a productive member to his community.

“The diversion of firearms for unlawful purposes or to those who cannot legally possess them endangers each and every member of our society,” said Acting U.S. Attorney Birge. “The U.S. Attorney’s Office will prosecute those who willfully circumvent federal firearms laws designed to protect the public.”

“Selling firearms to prohibited individuals contributes to the cycle of gun violence plaguing our neighborhoods,” said Special Agent in Charge Robin Shoemaker of the Bureau of Alcohol, Tobacco, Firearms, and Explosives. “ATF will continue to use all available resources to put a stop to illegal gun sales. Let this conviction stand as a warning to others willing to put profit before public safety.”

The ATF conducted the investigation, with assistance from the Grand Rapids Police Department. Assistant U.S. Attorneys Justin M. Presant and Alexis M. Sanford prosecuted the case.

(Marquette, MI) – A couple who founded a now-closed emergency medical services business in Schoolcraft County have filed Chapter 13 bankruptcy plans to repay up to $1 million dollars to creditors – this after their company closed earlier this year.

Tracy Alan Keskimaki, 50, and his wife Dr. Shelly Diane Baker-Keskimaki, 48, started Rapid Response One EMS, Inc. in Jan. 2014 – and two years later the business “left the area.” The couple signed a plan to repay creditors on Nov. 22, 2016 after filing for Chapter 13 in U.S. Bankruptcy Court in Marquette, MI.

The couple reported they owe approximately $142,000 to the feds for unpaid employment taxes. On his Facebook page, Tracy Keskimaki lists himself as the Former CEO & Founder at Rapid Response One EMS, Inc.

Keskimaki currently lists himself as an over-the-road Truck Driver at Roehl Transport and owner of Tracy’s Cleaning Services LLC. Meanwhile, Dr. Shelly D. Baker-Keskimaki, O.D. PC apparently owns the The Vision & Learning Center in Manistique.

When Rapid Response One EMS stopped serving Schoolcraft County in January 2016 – the emergency services were turned over to Manistique EMS. Operated by Manistique Department of Public Safety, Manistique EMS filled the community’s medical needs with assistance from Inwood and Doyle townships, officials have said.

In a 10-page plan to repay creditors, the Keskimakis outline how payments will be structured. However, no matter who they pay – they still owe a huge employment tax bills to the feds – and that will not go away.

The couple lists their home, several vehicles, a camper and a tractor among their assets. They owe money to a wide list of creditors including mBank in Manistique, MI; BMO Harris Bank and Kubota Credit Corporation – both located in Carol Stream, IL; and U.S. Bank in Egan, MN.

The couple owe more than $142,000 to the U.S. Treasury Department for unpaid employment taxes. It’s unclear – for which of the couple’s businesses – they owe “employment taxes.”

In the bankruptcy forms, the couple answered “yes” to the question: “Are your debts primarily business debts? Business debts are debts that you incurred to obtain money for a business or investment or through the operation of the business or investment.”

The Keskimakis estimate they have up to 49 creditors. The couple’s assets and liabilities were both each estimated at between $500,000 to $1 million.

The couple signed the Chapter 13 filing on Oct. 25, 2016. The case has been assigned to U.S. District Court Judge Scott W. Dales of the United States Bankruptcy Court Western District of Michigan.

The Keskimakis are represented by Sault Ste. Marie, MI attorney David E. Bulson of David E. Bulson, LLC. Under U.S. Bankruptcy laws, filing under Chapter 13 is a “voluntary repayment plan for individuals with regular income.”

Manistique EMS now sole provider within city limits

MANISTIQUE – Just short of two years serving Schoolcraft County, Rapid Response One EMS, Inc. has left the area. Manistique EMS, operated by the Manistique Department of Public Safety, will now be the primary provider of EMS services within the city, with assistance from Inwood and Doyle townships in the county.

According to MPS Director Ken Golat, his department received a phone call on Jan. 13, stating that Rapid Response would no longer be serving the area, beginning that day. Despite the abrupt notice, Golat said his team has had a “seamless” transition into once again being the primary provider of area EMS services.

With 35 medical technicians on staff, including 17 paramedics, 11 EMT Specialists, and seven EMTs, Golat explained Manistique Public Safety will be prepared to address any of the citizen’s emergency or medical transport needs. The department also boasts four ambulances, along with rescue gear such as snowmobile and ORV equipment.

Manistique EMS will serve as primary responder

MANISTIQUE – A controversial city ordinance passed Monday, amid a crowd rarely seen during regular Manistique City Council meetings. Although public comments were few, residents filled council chambers, even lining the hallway of Manistique City Hall, to learn the fate of a regulation deeming Manistique EMS the primary responder within city limits.

The ordinance came to light two weeks ago, introduced during a city council meeting as a method to “protect” the city’s interest in the EMS realm. The introduction came on the heels of the announcement of a new business – Rapid Response One, Inc. – establishing itself in Manistique.

The public is going to lose faith in the federal prosecutors office if you do not bring serious charges against our Governor Rick Snyder – and for that matter all the state, federal and locals involved in allowing crimes to happen (often under pressure) or indifference.

While maybe it is needed due to serious crimes – buts it is easy to throw a low-income Native American in federal prison. It is not easy to go after white collar crime especially white white-collar crime.

This comes from a big fan of the federal prosecutors and all the hard work they do across the Upper Peninsula and the state. But Michigan’s budget cuts have gone beyond the bone – and now U.P. ground blood-stained with the innocent.

U.P. Michigan State Police and other law enforcement budget cuts has forced the cops to be psychiatrists – and the mental health system is collapsing – suicides grow – and now retired Yoopers are being shot and killed in their bedrooms by cops who are punished if they follow protocol.
Modern police training dictates handling a suicidal person with the proper patience and care – not rushing into a man’s home. If I were the state troopers and the other cops I would be demanding to stop this before U.P. cops get killed. They normally have many other calls to go to and most of the time barging in doesn’t result in a death – its a budget issue red pen vs red blood.

You folks spend a lot of time throwing Native Americans in federal prison – most rightfully so – but when it comes to white collar corruption in the U.P. you are failing. Period. Your hard-working U.P. staff can barely handle the Native American related caseload – I know because I follow hundreds of cases.

Preferably it should be federal RICO charges against the Governor and his department heads and other minions – under the Racketeering Influenced and Corrupt Organizations (RICO) Act.

In fact, as was done in the “ongoing crime spree” by the feds to the Illinois governor – you should act immediately to remove him from office – or take he and his top staff out of power.

In the Upper Peninsula cops this year have shot and killed two men in their own homes – during incredibly a “well-being check.” The Upper Peninsula prisons are so understaffed that another inmate riot like Kinross – is all but certain especially with under-staffing and angry inmates.

The U.P. state prison meals lines are a huge issue for under-staffing – dangerously riot prone – plus entrenched supervisors who just do not care about inmate rights (We are not sympathetic for those who commit violent crimes – but remember folks we are trying to run a society here).

We can prove – give you places to probe – that the state lied publicly about the U.P. prison riot before and after it happened – but all you have to do is read the Sunday U.P. Papers to get it. U.P. Breaking News was the lone wolf.

These are not minor issues – even if we put aside the poisoning of a generation of low-income Flint children.

We have proof the state lied about environmental crimes in the U.P. including the destruction statewide of the deer herd – and the lie about the reason for the wolf hunt – that federal taxpayers paid a millions to reintroduce to have them killed for pennies a piece.

Plus if a grand jury probed the connection between the Marquette County Road Commission (notorious for pitiful record keeping) – and Kennecott and even the current mine owners over the superhighway that has replaced the once fabled two-rut/dirt Triple A Road for the Acid Mine – all those crimes from unrepentant local elected officials to state officials (we can prove it) – and both mine owners is rife with special treatment, sweetheart deals and luxury travel. Kennecott’s worldwide crime spree has been widely documented and they brought their dirty ways to the U.P. – then fled. No coincidence.

The problem is we can not trust the Michigan Attorney General’s Office to properly investigate its own boss. Remember it is called a conflict of interest.

So – white collar crime in Michigan should be just as important in the Upper Peninsula for the feds as throwing impoverished Native Americans in prison – which many deserve and we love the domestic violence and other initiatives.

(Bay City, MI) – A northern Michigan man – who was allegedly running an unlicensed gun dealing operation – entered into a plea agreement today with federal prosecutors after being charged with selling firearms without a license and now federal prosecutors are going to get the many other guns seized during their probe.

He was busted during an ongoing extensive undercover operation to snag illegal gun dealers across Michigan. The man made sales to undercover federal agents who are working guns shows in Michigan – and made numerous purchases that led to numerous cash sales – then the finding of 66 weapons – plus receipts from guns sales.

In exchange for his guilty plea, Schwartz is expected to receive three-years probation in exchange for his cooperation and admissions.

Northern Michigan Gun Shows Dealer Plea Agreement 10-14-16

Benjamin Carl Schwartz, 31, Linwood/Bay City, MI will lose approximately 50 guns of all types from many countries plus lots of ammunition in the forfeiture proceedings – especially since it appears he is in plea negotiations with federal prosecutors. Scroll down to read the list of weapons and ammo. A plea agreement was entered today in which Schwartz agrees to plead guilty to the one felony in exchange for no other charges being filed. He must also give up all the guns and ammo.

Schwartz sold the guns on GunBroker.com used Eagle Valley Outfitters to make the sales transfers. Schwartz primarily used the Birch Run Gun Show to make sales but visited similar Michigan guns shows between 2012 and 2015 in Lansing, Grands Rapids and Houghton Lake.

Last week on Oct. 6, 2016 a “forfeiture of particulars” was filed by federal prosecutors that specific what weapons and ammunition the government plans to keep as fruits of the illegal guns sales. Plus a felony conviction would bar Schwartz from possessing a firearm. This is includes a vast array for handguns, shotguns, and rifles including assault weapons and military grade firearms.

On September 26, 2016, a federal document was signed by all parties that allows Schwartz “to enter a guilty plea” before U.S. Magistrate Judge Patricia T. Morris in Bay City, MI. If the guilty plea is entered, it would be accepted by Judge Schwartz and then need to be approved by U.S. District Court Judge Thomas L. Ludington, a routine way of handling guilty pleas.

A fourth federal prosecutor was added to the lineup last week on October 6, 2016 – Asst. U.S. Attorney Philip A. Ross of Detroit. The other federal prosecutors in the case are Asst. U.S. Attorney Nancy A. Abraham in Flint, Asst. U.S. Attorney Craig F. Wininger (branch offices chief) and Eastern District of Michigan U.S. Attorney Barbara L. McQuade.

In a three-page federal felony information filed Sept. 16, 2016, Schwartz is accused of “dealing firearms without a license” on Nov. 5, 2013 and allegedly “willfully engaged in the business of dealing firearms without being license to do so” under federal law.

The information includes a forfeiture allegation that his plea agreement enforces – as Schwartz has forfeited all firearms and ammo.

(Bay City, MI) – A northern Michigan federal grand jury has indicted a member of the Saginaw Chippewa Indian Tribe of Michigan on charges that over the past three years he allegedly beat, abused, choked and in several other ways otherwise injured a young female child and is accused of allegedly abusing his girlfriend over a long period of time as an habitual offender – and a deadline has been set for a plea agreement.

Federal charges were brought because Cyr has three previous family violence convictions in Saginaw Chippewa Tribal Court in March 2000, October 2002, and January 2005. Cyr remains jailed pending a trial or plea on the 8-count, 6-page federal felony indictment.

Cyr is accused in a federal indictment of several counts of child abuse for allegedly injuring a young female child. The following child abuse against the girl was alleged in the indictment: Strangling, choking, hitting in the face, arm twisting, pushing and kicking down stairs, putting in headlock and more.

Last Friday – October 7, 2016, federal prosecutors filed a document about discovery issues that have been or will be given to the defense.

Cyr was also indicted on charges he was allegedly an habitual domestic violence offender allegedly tryng to strangle and otherwise abuse against his girlfriend/wife.

All the recent crimes were alleged to have occurred on the Isabella Reservation over the past three years.

A federal grand jury sitting in Bay City, MI returned the 8-count felony indictment on September 14, 2016 in the United States District Court for the Eastern District of Michigan Northern Division.

The federal prosecutors in the case are Asst. U.S. Attorney Roy R. Kranz in Bay City, Asst. U.S. Attorney Craig F. Wininger (branch offices chief) and Eastern District of Michigan U.S. Attorney Barbara L. McQuade. Cyr is being represented by the U.S. Public Defenders Office.

The federal judges involved in the case are U.S. Magistrate Judge Patricia T. Morris and U.S. District Court Judge Thomas L. Ludington.

Judge Ludington on Sept. 29, 2016 set several crucial dates including a Feb. 14, 2017 deadline for a plea agreement and a trial date of March 7, 2017 at 8:30 a.m. Any plea deal can be held before Magistrate Judge Morris, under an agreement between the defense and prosecutors.

Cyr is a member of the Saginaw Chippewa Indian Tribe of Michigan (SCIT)

(K.I. Sawyer, MI) – Few details are known about a dramatic highly visible state, federal and local raid on Friday at least one K.I. Sawyer residence in Marquette County, Michigan – a raid that even frightened local children because of its drama but pleased parents because of its size, execution and message.

State and federal agents – including members of UPSET – wore tactical gear and were heavily armed when they conducted the daylight raid in a Sawyer neighborhood. Numerous K.I. sawyers residents contacted U.P. Breaking News after witnessing the raid.

Its unclear the reason for the raid although its known that Sawyer has been the subject of numerous investigations into a drug pipeline from Midwestern cities like Detroit, Chicago and several in Wisconsin and Minnesota. Drugs like heroin, crack cocaine, suboxone, painkillers, meth and others have become a huge problem across the U.P. That is the fight cops battled daily.

upset-logoDEA, ATF, FBI, and other federal agents have teamed up with UPSET and other regional drug team to make numerous raids across the U.P. in recent months.

One difference in this raid is how visible it was as U.P. Breaking News has received numerous reports including how it shocked local kids – and was a welcome message from parents who know the issues involving drugs and guns on the former Air Force Base.

U.P Breaking News has reached out to authorities for information but so far nothing has been released publicly.

It’s unclear whether state of federal charges were at stake in this raid.

U.P. Breaking News has confirmed that a federal grand jury sitting in Marquette this past week returned numerous indictments – and its not unusual for indictments to remain sealed until the suspects are in custody.

U.P. Breaking News has examined federal search warrants over the past few years that indicate the drug problem has not escaped the noticed of authorities and future arrests are certain.

We are not sure if other locations were taken down by authorities Friday or today.

(Marquette, MI) – It’s not nice to toy with federal judges, federal prosecutors, and the ATF.

Especially when these folks have lots of evidence that you are a veteran meth distributor and have many guns including an assault type rifle – despite several felony convictions- and if you have no respect for law and order

joe-holm-mugshot-1A Gwinn man, who a long criminal history and who thumbs his nose at the law, will spend the next five years in federal prison following a December 12, 2015 crystal meth and guns raid by a team of federal and state agents at the man’s heavily armed home in Gwinn.

That fateful day nine months earlier state and federal drug and guns agents came through his door executing a search warrant – including from the U.S. Bureau of Alcohol, Tobacco, and Firearms (ATF) and from the Upper Peninsula Substance Enforcement Team (UPSET).

On Friday, Sept. 9, 2016, 38-year-old Joseph John Holm, Jr. of Gwinn was sentenced to 50 months in prison by U.S. District Court Judge Robert Holmes Bell in Marquette federal court.

Prior to the June 5, 2016 change of plea hearing, Holm “was arrested for driving without a valid driver’s license” and what cops found in the car was another can of worms.

“The car in which he was driving was found to contain numerous items that are consistent with drug manufacturing, trafficking and usage,” the federal sentencing memorandum pointed out.

Federal prosecutors appeared to run out of patience for Holm’s legal games – first admitting information about gun possession by a felon and firearms dealing – then changing his statements – and that was not impressive to prosecutors.

Holm denied being a druggy but failed tests and one witness told police that Holm (allegedly) cooked meth every other day and another told police Holm was deep into the meth distribution business.

One of the headlines in the sentencing memorandum prepared by federal prosecutors noted Holm’s erratic decisions and anti-social behavior:

“Holm’s lack of respect for the law and high risk of recidivism support a sentence at the high end of the Guidelines range or an upward variance”

Holm however, tried to blame others for his latest brush in the law while out on bond on federal gun charges – and claimed to be clean But a test proved different.

“An analysis of a urine sample he provided revealed that Holm had, in fact, been using methamphetamine” while out on bond,” federal prosecutors stated – this despite Holm’s claim that he was (in) compliance with the court’s (bond) directives.

After federal prosecutors decided they wanted Holm in jail pending sentencing, “Holm made an extended statement to the court in which he denied any wrongdoing” in his most recent arrest “and asked to be released,” the memorandum states.

Federal prosecutors said that Holm illegally possessed weapons for a decade despite numerous felony convictions and possess an assault rifle that could have been easily converted into an automatic.

In a strongly worded document, federal prosecutors argued that Holm lies and is drug-addled – and has no shame in lying to a federal judge – with no respect for law and order.

This is what was stated and filed by a federal prosecutor in northern Michigan frustrated by Holm’s shenanigans:

“In this case, Holm completed KPEP in mid-April 2016, and soon thereafter had returned to using methamphetamine.

That part of his course of conduct, although disturbing, is not the worst part.

The worst part of Holm’s conduct is his decision to walk into court prior to the return of the laboratory analysis of his urine sample and vehemently state – while under oath and accompanied by his attorney – that he was rehabilitated, and that the traffic stop that led to his arrest was a simple mistake.

As later revealed by the laboratory analysis of Holm’s urine sample, these were false statements.

They reflect Holm’s lack of respect for the law and his high risk of recidivism. Given these facts, a sentence at the high end of the Guidelines range or even an upward variance would be appropriate.”

Holm possess a semi-automatic firearm that is capable of accepting a large capacity magazine,” federal prosecutors pointed out in a sentencing memorandum.

Four magazines capable of holding up to 30 rounds of .223 caliber ammunition (i.e. “high-capacity” magazines) were found in the gun cabinet in Holm’s bedroom,” prosecutors said.

Holm “agreed to the forfeiture of all the firearms listed in the indictment.” However, two of the weapons – a pair of shotguns – belong to Holm’s ex-wife who can “take custody of these two firearms at the conclusion of the case,” the agreement states.

These two firearms are:

  • Harrington & Richardson Model Pardner, 410 gauge shotgun
  • Rossi Model S201220YS, 20 gauge shotgun

Holm was investigated by U.S. Bureau of Alcohol, Tobacco, and Firearms (ATF) Special Agent James Petschke and prosecuted by Asst. U.S. Attorney Maarten Vermaat .

The transcript of the change of plea hearing conducted on June 14, 2016 before U.S. Magistrate Judge Greeley has not been approved for release to the public

“Found during the search were 10 firearms, many rounds of ammunition and a small quality of methamphetamine,” the criminal complaint states.

After being advised of – and understanding – his Miranda rights, the complain states, Holm agreed to answer agent’s questions.

“Holm admitted possessing approximately nine (9) firearms and the methamphetamine found inside his residence,” the complaint states.

The complaint was filed by ATF Special Agent James Petschke and signed by U.S. District Court Magistrate Judge Timothy P. Greeley.

Holm admitted possessing an Olympic Arms Model MFR (Multi Function Rifle), .223 Caliber Rifle, serial number TB8187 – apparently similar to a M-16. Holm said he “purchased the rifle” from his uncle Paul Kurian in 2009 for approximately $800,” the complaint reveals.

The ATF did a Computerized Criminal History (CCH) on Holm and found out his criminal background including sex crimes in Alger County.

Holm has:

  • 1998 conviction: Criminal sexual conduct in the second degree – a 15-year felony in Alger County 11th District Circuit Court in Munising, MI
  • 2005 conviction: Failure to register as a sex offender – a 4-year felony in Alger County 11th District Circuit Court in Munising, MI

“Each one of these offenses qualifies as a ‘crime punishable by imprisonment” for more than” one year,” the complaint states.

Holm was “convicted of one of more offenses punishable” by up to a year in prison – thus opening him up to new federal gun charges because the weapons can not be possessed by convicted felons, according to an ATF criminal complaint filed on Dec. 14, 2015 in the U.S. District Court for the Western District of Michigan Northern Division in Marquette. MI.

A background check determined “that there is no record of Holm ever having his gun rights restored,” the complaint states, adding a check was done by Michigan State Police Firearms Record Unit Jason Pierce.

Sentencing guidelines in the case included the fact “Holm began illegally possessing firearms in 2006,” according to the U.S. Government’s Sentencing Memorandum filed on August 231, 2016.

Holm was “released on bond on Jan. 15, 2016 subject to the condition that he ‘participate in and successfully complete substance abuse and anger management treatment at the Kalamazoo Probation Enhancement Program’ (KPEP) … a residential drug treatment program,” the memorandum states.

Holm was allowed to return home in mid-April 2016 after completing the KPEP,” the memorandum states.

Judge Bell also imposed three years of supervised release after Holm is release from prison, order him to pay a $100 special assessment; and was advised of right to appeal.

Holm is a “multi-convicted felon” who the feds say “knowingly possess a firearm that had traveled in or affected interstate commerce.”

Quarter Million Dollar Big Northern Michigan Railroad Ripoff: June Ann McClure gets probation in huge railroad child disability program three-decade scheme in which she stole nearly 250 thousand dollars

(Bay City, MI) – A Flint, MI woman has received a slap on the wrist from a federal judge after pleading guilty to “theft of government funds” in a northern Michigan courtroom as the mastermind of a three-decade scheme that federal prosecutors say ripped off about a quarter of a million dollars in disability annuity payments for children of railroad workers.

In a quiet sentencing that was not reported by the media, 58-year-old June Ann McClure of Flint, MI could have received up to 10 years in federal prison and sentencing guidelines put her estimated prison time at 12 to 18 months, but instead was given two-years probation under a plea agreement with federal prosecutors.

Oddly, the “date of imposition of judgment” was listed as July 14, 2016 by U.S. District Court Judge Terrence G. Berg but the federal paperwork on the “judgment” was not filed for public viewing until August 2, 2016. In fact, the sentencing apparently escaped the notice of all the Michigan media despite the amount of money stolen.

When a person admits their crime and takes full responsibility and cooperates with federal prosecutors the cases are often dealt with leniency.

Editors note about the otherwise tough judge in this case:

Judge Berg was shot in the leg outside his Detroit home in March 2015 during an armed robbery – however he was not able to positively identify the only suspect – a 23-year-old man who was found not guilty of shooting the judge in May of this year – but was convicted in connection with a related crime spree.

Under the “Rule 11” 24-page plea agreement, McClure waived indictment by a federal grand jury and pleaded guilty on March 17, 2016 to a one-count felony information.

McClure stole nearly $248,000 of benefit payments, according to the plea agreement. And while she must make restitution, court records indicate it will be at the molasses slow rate of $75 per month.

McClure can not “unlawfully possess a controlled substance” and “shall refrain from any unlawful use of a controlled substance,” the judge ruled as part of sentencing. The court suspended its order that McClure submit to drug tests because she “poses a low risk of future substance abuse.”

June Ann McClure is accused of theft of government money for stealing cash between June 13, 1986 through Oct. 31, 2014 involving “money from the U.S. Railroad Retirement Board (RRB), a department or agency of the United States,” according to federal charging and arrest related documents.

“Namely, the U.S. Railroad Retirement Board Child Disability Payments to which she knew she was not entitled,” the federal felony criminal complaint states.

On Nov. 26, 1984, McClure “applied for and started receiving Railroad Retirement Board Child Disability payments” from the U.S. RRB

“McClure had a continuous obligation to report if she married and if she performed any type of work or had any earnings,” the plea agreement states. “McClure was aware that if she married, or returned to work and held a job, and accurately reported it, her entitlement to child disability annuity payments would end.”

On June 13, 1986 McClure married “but she failed to report it to the RRB,” the plea agreement states. “Had she reported it, her child disability annuity payments would have stopped on the first day of the month during which she got married.”

“During the years of 1992 through 1998, 2005 through 2007, and 2012” McClure “performed work and obtained earnings, but she failed to report them to the RRB,” the plea agreement explains. Between June 1, 1986 when she got married until October 31, 2014, “when her crime was discovered and payments ceased” McClure “knowingly received and converted to her own use” and “deprive the RRB of $247,971.62 “worth of RRB child disability annuity benefits to which she knew she was not entitled.”

She was ordered to stay away from casinos.

Federal prosecutors noted that McClure fully cooperated with the investigation and the plea agreement forgoes the cost of an expensive trial in federal court.

Until the debt is repair, McClure “shall report promptly all windfalls, such as inheritances and lottery winnings of $500 or more” to her federal probation officer.

In June 2013, McClure received a 30-day jail sentence and a $275 fine for driving with a suspended license, the plea agreement notes.

The charges were filed on February 9, 2016 in the U.S. District Court for the Eastern District of Michigan, Southern Division.

McClure “knowingly and willingly stole and converted to her own use – or the use of another – money” of the U.S RRB headquartered in Chicago, federal prosecutors say.

(Marquette, MI) – A domestic violence assault this weekend on tribal lands in Menominee County has resulted in federal charges being filed against the suspect.

Bobby Lee Jones, Jr. was arrested after officials filed an “information” – one of the tools federal prosecutors use to file criminal charges.

The charge is a Class A misdemeanor – was filed with the federal clerk’s office on Mon., August 29, 2016 at the U.S. District Courthouse in Marquette, MI.

Jones, a non-native, is accused of assaulting a Native American female “with whom he had a dating relationship.”

The incident happened on Sunday, Aug. 28, 2016 “in Indian Country” in Menominee County, although further details were not released.

Its not clear whether the attack happened on lands claimed by the Hannahville Indian Community or the Menominee Indian Tribe of Wisconsin – that both have tribal lands inside Menominee County, MI.

The charge is “assault by striking, beating or wounding.”

(Marquette, MI) – A western Upper Peninsula man is jailed this morning (Tues., Aug. 30, 2016) on federal charges he seriously beat another man with a candle jar, fists and a kitchen chair in the victim’s apartment on Lac Vieux Desert treaty lands.

However, the feds are gathering evidence in what they call a PROBE “violent physical altercation.”

45-year-old David King Baldwin has been arrested by the FBI for allegedly brutally assaulting another man.

In addition to the victim’s injuries, the FBI investigated the incident because it happened on treaty lands and the three people involved in the incident – two men and a women – are Native American, according to the federal complaint.

The victim – identified only as male with the initials A.J.J. – was assaulted “with a dangerous weapon” that investigators identified as a chair. The victim was assaulted in his home in Watersmeet Township – shortly after a female – identified only as J.P.B. – dropped by his residence. Five minutes after the women arrived, the suspect – Baldwin – “banged on his (the victim’s) door.”

However – federal prosecutors seem to be deepening their probe into the incident as they requested a special search warrant covers DNA evidence like bodily fluids, blood, and hair. Federal prosecutors have not stated the reason but it appears they are looking evidence to prove whether there was an additional victim or victims.

The search warrant signed by U.S. Magistrate Judge Timothy P. Greeley.

The federal search warrant includes “items identified by witnesses” such as “improved weapons” allegedly used by Baldwin including “cellular telephoners, glass jars, knives, chairs, and club-like objects”

Damaged clothes and broken furniture were among the household items specified in the search warrant.

A.J.J. opened his door “and Baldwin struck him in the face,” the complaint states in explaining the victim’s account.

“A.J.J. tried to defend himself,” the complaint states, adding the suspect then attacked the victim with a candle jar “that had been atop the table.”

“Baldwin then hit A.J.J. on the side of the head with a glass candle jar,” the complaint states, adding the attack was not over.

“Baldwin next picked up a kitchen chair and hit A.J.J. with it,” the complaint states.

The victim was hit “upon his arms – as he tried to fend off the blows,” the FBI interview revealed.

David Baldwin MugshotThe victim managed to escape and at 3:13 a.m. arrived at the Lac View Desert Tribal Police Department to report the assault. Two minutes later LVD officers respond to the scene.

Baldwin and J.P.B. were found “seemingly unconscious” laying in the yard “outside the apartment building,” the officers reported. Baldwin “had what appeared to be blood on the upper right portion of his shorts, as well as, his gray t-shirt and legs,” the complaint states.

Baldwin “woke up” and asked the officers several questions before being placed in handcuffs.

“What’s going on,” Baldwin asked.

Where am I,” he said.

A.J.J. suffered numerous injuries including “a large lump on both of his forearms, a scratch on the left side of his neck, and a reddened cheek.” The victim was treated for arm injuries at the Ministry Eagle River Memorial Hospital, where medical records state he “suffered blunt trauma to the right forearm and had a deep tissue contusion.”

Citing a doctor’s addendum, the complaint states, “it was noted that the patient reportedly sustained the injury during an altercation with another person.”

The attack occurred at the victim’s apartment on Fri., Aug. 12, 2016 at E23905 Transfer Station Rd, Unit 2 in Watersmeet, MI “in Indian Country” inside Gogebic County “on land held in trust by the United States for the use of the Lac Vieux Desert Band of Lake Superior Chippewa Indians,” according to a criminal complaint filed in federal court at Marquette.

The charges are the result of an investigation by two FBI agents, Lac Vieux Desert Tribal Police and the LVD tribal prosecutor. The complaint was presented to a federal judge by Federal Bureau of Investigation (FBI) Special Agent Mark Hoff, who investigated the assault.

The complaint alleges Baldwin committed the attack “with the intent to do bodily harm without just cause or excuse,” according to the criminal complaint filed in U.S. District Court in the Western Division of Michigan

The felony criminal complaint was signed on Fri., Aug. 26 by U.S. Magistrate Judge Timothy P. Greeley in Marquette, MI.

“This affidavit does not set forth all matters discovered during the course of this investigation,” Agent Hoff stated in the complaint.
