Sexual assault and animal cruelty charges filed in Marquette County today

(Marquette, MI) – The son of that couple critically burned almost two weeks ago in that suspicious camp explosion was arrested today on an animal cruelty charge – while this morning a Marquette man was charged with sexual assault.

24-year-old Taylor Wing of Ishpeming, MI was booked into the Marquette County Jail (MCJ) at 11:39 a.m. on Wed., Jan. 31, 2018.

Wing is charged with three counts of third degree criminal sexual conduct (CSC).

Wing was arraigned Friday, Feb. 2, 2018 on three counts of third degree CSC, 15-year felonies.

Wing was arrested by Ishpeming Police after an investigation into allegations made on January 28, 2018 at 501 N. Third St.

Bond is set at $150,000.

 Third-degree CSC involves victims between 13 years of age and under 16 years of age. In addition, if the victim is coerced, helpless and/or is related to the suspect.

An animal cruelty charge was filed today against the son of the couple who were critically burned almost two weeks ago in that camp explosion in south Marquette County.

23-year-old David Anderson of Gwinn, MI was booked into the MCJ at 11:09 a.m. today, Wed., Jan. 31, 2018.

Anderson is charged with cruelty to animals by abandoning. Anderson’s bond has not been set.

Sadly, Anderson’s Facebook page may shed light on the charge.

“We have 6 dogs at home my mom and her husband are currently in the burn unit and house is condemned,” Anderson wrote on January 19, 2018 at 11:37 a.m. “We need to find homes because I can’t watch my puppies go to the pound right now.”

On Anderson’s Facebook page he received a passionate note today from family and friends telling him to be strong.

He is the son of burn victims 36-year-old James Mallon and his wife 40-year old Danica Mallon, both of Little Lake, MI.

They were critically burned in that explosion at a camp in Wells Township on Thurs., Jan.18, 2018 that is suspected to be a meth-related blast.

A combined funeral service for Janet and her husband Don will be held at noon on Tuesday, February 6, 2018 at Fundamental Baptist Church.
The Cooks 2Donald Gerald Cook, age 69, of Kincheloe, Michigan passed away unexpectedly Wednesday afternoon, January 31, 2018 near Dafter, Michigan due to a car accident.
Don was born on March 7, 1948 in Vincennes, Indiana the son of the late Nobel and Crystal (Land) Cook. He graduated from Lincoln High School in Vincennes with the class of 1967. He married Janet Akre on November 7, 1970 at the First Baptist Church in Sault Ste. Marie, Michigan. Don served his county in the United States Air Force during the Vietnam War, attaining the rank of Sergeant. He worked as an Aircraft Hydraulic Mechanic in Tuyhoa, Vietnam. He was honorably discharged from Kincheloe Air Base in 1971. Later, he worked as a corrections officer at Kinross Correctional Facility and Lakeland Correctional Facility. Don was a member of Fundamental Baptist Church. He enjoyed hunting and shooting guns. He was an all-around outdoorsman, who loved spending time with his grandchildren and family. Don loved pies and peach cobbler.
Don is survived by a son: James (Carla) Cook of Coldwater, MI; a daughter: Kelly Barnes of Louisville, KY; and four grandchildren: Nathan and Jacob Barnes, and Keegan and Nolan Cook. He is also survived by his sisters: Donna Neighbors and Cindy (Dan) Wood both of Indiana.
Don was preceded in death by his parents; a sister: Susie Bennett; and a grandchild: Janene Cook.
A combined funeral service for Don and his wife Janet will be held at noon on Tuesday, February 6, 2018 at Fundamental Baptist Church with Pastor Tim Rader officiating. Friends may call at the church from 10 a.m. until the time of the service. Burial will be at Oaklawn Chapel Gardens later this spring.

Killed in the crash were Kincheloe, MI residents – 69-year-old Donald Gerald Cook and passenger 69-year-old Janet Gayle Cook.
A westbound car was being driven by Mr. Cook on S. Mackinaw Trail and it collided with a north bound commercial vehicle that had a snowmobile trailer.

That commercial pickup truck – pulling the snowmobile – belongs to the Cloverland Electric Cooperative.
The two vehicles ended up on the shoulder along the northbound lane.
Then two other vehicles – each coming from a different direction on Mackinaw Trail – could not stop and hit each other close to the original crash.
Commercial vehicle driver Daniel Brady received minor injuries. The drivers of the two vehicles that could not stop – Larry Tasker, Jr. and Emily Stork – were not hurt.
Mackinac Trail was closed for about three hours and re-opened about 2:30 p.m.
Drugs and alcohol are not a factor, however the crash is still being investigated.
MSP Troopers from the Sault Ste. Marie Post are investigating the fatal crash – and others helping on the scene included the Chippewa County Sheriff’s Department, U.S. Border Patrol, MSP Commercial Vehicle Enforcement, and Kinross and Dafter Township EMS.

(Dafter Township, MI) – A horrific double fatal accident scene is expected to have South Mackinac Trail closed on both sides of 1-75 in Chippewa County.

The crash was reported about 11:45 a.m. today, Wed., Jan. 31, 2018 on South Mackinaw Trail between the intersections of West 11 Mile Road and West 12 Mile Road – at overpass to 1-75.

The accident is just east (aka north because it curves) of the location where S. Mackinaw Trail crosses over the top of I-75.

Two people were pronounced dead on the scene. When asked by the Chippewa County 911 dispatcher how many vehicles were involved, an official stated four – spread over a relatively small area. The larger scene involves four vehicles, said one official at incident command. Its not clear how many people were involved or if there were other serious injuries.

Among those responding were Kinross EMS and the Dafter Township Volunteer Fire Department (though most of its trucks were canceled).

Those working the scene and helping to block intersections (mainly between west 11 and 12 Mile roads) on S. Mackinaw Trail include the Chippewa County Sheriff’s Department, Michigan State Police and the U.S. Border Patrol.

An official “accident investigator” or “AI” has been summoned to the scene – in this case he is also the K-9 handler. Not sure which law enforcement agency is the lead, but sounds like the county.
Expected delays and re-routing of traffic in the area for several hours – if not more.

A big fire has been burning this morning fire at an asphalt plant in Marinette County, WI.

The blaze is at the Dun-Rite Asphalt Maintenance Company at the W752 County Road B in Peshtigo, Wisconsin – not too far from the Marinette County Jail.

As large lames shot in the air, numerous fire departments were called as mutual aid by the Peshtigo Fire department.

The fire was reported at about 3 a.m. CT today, Wed., Jan. 31, 2018

The cause of the inferno is under investigation. An ambulance/paramedics called to the scene on standby, however no injures were reported.

John Alexander in June 2015 – Could not outrun the law

29-year-old John Patrick Alexander of Marquette County was wanted for violating several parts of the Michigan Sex Offender Registration Act.
Alexander was booked into the Marquette County Jail at 6:48 p.m. Tuesday night, Jan. 30, 2018.

He was booked on two non-compliant sex offender charges – one charge has a $5,000 bond and the other charge a $500 bond.

His most recent Facebook address was Big Bay, MI.

Alexander had been a wanted absconder for over a year and a half.

His Last verification date was June 6, 2016.

Alexander is accused of an address violation, failure to verify and fee violations.

Alexander was convicted of sexual assault on July 27, 2001 in Marquette County 25th Circuit Court. He was convicted of “criminal sexual conduct: assault with intent to commit sexual penetration.” Details of the case were unavailable.

However, since his release from state prison, Alexander has been in trouble with the law for the same failure to register charge.

On Jan 4, 2016, Alexander, then 37, of 201 South Schneider Street in Big Bay was sentenced to 300 days jail on one count sex offenders/failure to register. Alexander was sentenced by Marquette County Circuit Court Judge Jennifer Mazzuchi. He was released from jail and skipped about five months later (given credit for time served). Judge Mazzuchi is going to love to see him again.

34-year-old Kristen Gill Cevigney of Michigamme, MI was booked into the Marquette County Jail at 4:28 a.m. today, Wed., Jan. 31, 2018.
Cevigney is charged with domestic assault.
Both she and her husband called 911 early today to report an assault. She says he kicked-in bedroom door where she was hiding with teen children – and at some point she had to hold him off with a knife.
However, her husband said she put a knife to his throat.
Bond has not been set.

52-year-old Brian Scott Anderson of Republic, MI was booked into the Marquette County Jail (MCJ) at 11:17 p.m. Tuesday night, Jan. 30, 2018 and remains behind bars.

Anderson is charged with felony aggravated domestic violence/assault. Anderson has dark criminal history involving threats to burn his children during a stalking domestic dispute nearly 20 years ago.

The Tuesday night incident included alcohol.

The 49 -year-old victim ran to a neighbor’s house.

Paramedics rushed her to U.P. Health System-Marquette suffering serious “trauma.” The woman was “struck multiple times to the face,” the paramedics radioed doctors in Marquette.

The victim is suffering from bruising and hematomas to the forehead, the orbital area, and in the center of her face. The victim blacked out several times.

Brian Scott Anderson has past address in the Menominee/Marinette area, Green Bay and Skandia, MI.

In fact, the state fought Anderson’s 1999 appeal of a habitual offender conviction in Menominee County Circuit Court in the southern U.P.
Anderson was convicted by jury of aggravated stalking and sentenced as a second-offense habitual offender to a prison term of 4 to 7 1/2 years.
Anderson claimed that his suicidal state during the stalking of his then wife should have been a mitigating factor.

However the Michigan Court of Appeals ruled that Anderson was not acknowledging the “effect of the crime on his children, whom he threatened to set on fire while brandishing a gas can.”

38-year-old Keith Michael Roberts of Ishpeming, MI was booked into the Marquette County Jail at 10:04 p.m. Tuesday night, Jan. 30, 2018.
Roberts is charged with felony aggravated domestic violence/assault
Roberts is being held without bond.

Details of the case against Roberts have not been released. However if its not a new charge – it could be connected to his case about 12 months ago.

In August 2017, Roberts, then of Ishpeming, was sentenced to 180 days in jail and 12 months probation for aggravated assault/domestic violence and attempted interfere with electronic communications. He was also order to pay over $1,600 in fines/fees in connection with the assault on Feb 12, 2017.

32-year-old Michael Nuckols of Gwinn, MI was booked into the MCJ at 2:54 p.m. on Tuesday afternoon, Jan. 30, 2018.

Meanwhile two co-defendants in a 2017 credit card crime were caught hanging out with each other apparently during a traffic stop. They had been told to stay away from each other.

25-year-old Kelley Liane Hansen of Escanaba, MI was booked into the Delta County Detention Center at 3:30 p.m.Tuesday afternoon.
Hansen is charged with a no contact violation.
In August 2017, Hansen was sentenced to six months in jail after pleading guilty to attempted illegal sale/use of a financial transaction device.
She had to pay over $1,700 total in restitution/fines.
In June 2016, Hansen, then 23, was sentenced to 8 months in jail for providing material to manufacture and distribute meth. The meth case received a lot of U.P. media attention.

39-year-old Jamie Rose of Escanaba was booked into the DCDC at 3:12 p.m. Tuesday afternoon.
Rose is charged with violating a no contact order.
No bond has been set for Rose.

In September 2017, Rose was sentenced to five months in jail for second-degree retail fraud.

In Aug. 2017, was sentenced six months in the DCDC for attempted illegal sale/use of a financial transaction device.

She had to pay over $1,700 total in restitution/fines.

Arrested were alleged Lansing area scumbags Charles Joseph Miller and his brother, 40-year-old Kian Maliak Miller – who are accused of running a dog fighting ring in western Michigan for at least a year.

They face animal cruelty related charges, while Charles Miller is also charged with being a felon in possession of a gun – and distributing lots of cocaine.
The federal charge is possession of an animal for participation in an animal-fighting venture.

The charges against the Miller brothers could land the men in state and federal prison for decades. Federal charges carry a minimum sentence of five years in prison, and the feds to not allow early parole.

(Keshena, WI) – Federal prosecutors last Tuesday quietly dropped charges against a Keshena teen accused of aggravated sexual assault – saying with the current evidence they “cannot prove the case beyond a reasonable doubt.”

Federal prosecutors on MITW aggravated rape case: “Cannot prove the case beyond a reasonable doubt.”

On Jan 23, 2018, Chief United States District Judge William C. Griesbach approved “an order granting the government’s motion for leave to dismiss indictment” against 19-year-old Justin A. Schneider of Keshena, WI. Schneider faced life in prison if convicted.

Its not clear if the dismissal of the charges was with or without prejudice – which determines whether the charges can be refiled in the future. Scroll down to read or download the federal paperwork

Federal prosecutors last Monday, Jan. 22, 2018 requested the judge dismiss the charges in a “motion for leave to dismiss indictment.”

“As grounds for, the government carefully reevaluated the available and admissible evidence in the case and determined that it cannot prove the case beyond a reasonable doubt,” states the dismissal motion from federal prosecutors.

Keshena Shocker: Federal prosecutors drop MITW aggravated rape charges against Justine A. Schneider of Keshena, WI

Schneider was indicted on June 6, 2017 on one felony charge of “aggravated sexual assault” charging that that he brutally raped another member of the Menominee Indian Tribe of Wisconsin.

Schneider was released on personal recognizance bond on June 14, 2017 about a week after his arrest – with no objection by federal prosecutors.

The victim was identified only as Jane Doe – an adult female. The indictment charged that Schneider “held Jane Doe down by grabbing her arms and placing his hand on her chest” during the alleged rape.

The case was investigated by the Menominee Tribal Police Department and Federal Bureau of Investigation (FBI).

Keshena Man Indicted for Sexual Assault on Menominee Indian Reservation

Gregory J. Haanstad, U.S. Attorney for the Eastern District of Wisconsin, announced that on June 6, 2017, a federal grand jury returned a one-count indictment against a man allegedly involved in a sexual assault on the Menominee Indian Reservation. The indictment named Justin A. Schneider (age: 18) of Keshena, which is located on the Menominee Indian Reservation. The indictment charges Schneider with Aggravated Sexual Abuse in violation of 18 United States Code, Section 2241(a)(1). Schneider faces a maximum sentence of life in prison, up to a $250,000 fine, and between 5 years and a lifetime of Supervised Release.

According to the indictment, on May 15, 2017, while at the defendant’s Keshena residence, the defendant engaged in a sexual act with an adult female by the use of force. According to the indictment, the defendant held down the victim’s arms and placed his hand on her chest during the sex act.

The Menominee Tribal Police Department and Federal Bureau of Investigation investigated the case. The case is being prosecuted by Assistant United States Attorney Andrew J. Maier.

An indictment is only a charge and not evidence of guilt. The defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.

66-year-old Herbert Raymond Watson of Escanaba, MI was booked late Sunday night, Jan 28, 2018 into the Delta County Detention Center (DCDC).
Watson is charged with domestic violence.
Bond for Watson is set at $1,000.
He has lived in Gladstone, Menominee, Stephenson, and Ingalls, MI.

37-year-old Jamie Eugene Kolinske of Manistique, MI was booked into the DCDC at 11:14 a.m. today , Mon., Jan. 29, 2018 on a felony drug dealing charge.

His brother was sentenced today on a reduced marijuana charge.

Jamie Kolinske is charged with felony delivery/manufacture of marijuana. Both men are being held without bond. Past addresses include the cities of Escanaba, Cooks, Iron Mountain, and Altamont, MI

Kolinske was less than a year from getting off parole/probation set for Dec. 16, 2018. The convicted felon was on parole and is required to check in with the Schoolcraft County Parole/Probation Office.

He has a lengthy criminal record (see info below or click on link).

Past convictions dating back to 2006 include car theft, third offense impaired driving, and possession of a firearm by a convicted felon.

He was paroled by the MDOC in February 2016 after serving a little over two years in prison for a May 2013 offense of selling, furnishing and possessing a cellphone by a prisoner in the Schoolcraft County Jail. He was sent to prison in Dec. 2013.

Kolinske’s brother was arrested 10 days ago on marijuana charges.

38-year-old Joseph Martin Kolinske of Cooks, MI was booked into the DCDC about 8 p.m. Saturday night, Jan. 20, 2018. Kolinske was charged with felony possession of marijuana. Bond is not set.

Joseph Kolinske pleaded guilty today to a reduced charge of misdemeanor possession of marijuana and was sentenced to 90 days in jail plus received a small fine and driver’s license suspension followed by restrictions.

(Marquette, MI) – Its the federal court version of who will blink.

In Marquette federal court, prosecutors have just filed a gigantic amount of information about two unrelated heroin distribution cases – one suspect in Marquette County and the other from Chippewa County.

Its either on the brink of blink – or both go to trial.

Those set federal court trial beginning next week are 42-year-old Derrick “Bam” Garrel Samuels of Gwinn, MI and followed by the trial of 30-year-old Jessica Tobias of Sault Ste. Marie, MI.

In the past week, federal prosecutors flexed their muscles by filing hundreds of pages of information including cell phone records, wire recordings and much more in the cases.

In the Tobias case, the prosecutors have released a “voluminous” amount of information including heroin drug deal telephone records. The various motions against Samuels and Tobias to show they are serious – and ready to go to trial.

Both cases are slated for jury selection next week – followed by separate trials in Marquette, MI during the first week or two of February 2018.

In fact, a co-defendant in the Tobias case just pleaded guilty – and that ups the prosecution hand. Just last week guilty plea from 27-year-old Joseph Gideon Gravelle of Colorado Springs, Colorado – and Sault Ste. Marie, MI. Gravelle will testify against Tobias.

One reason its a who will “blink” first situation is both suspects face likely harsh sentences if convicted – and federal time is hard time – no early parole. Prosecutors are likely open to plea deals – but will go to trial if required.

Prosecutor prefer plea deals for many reasons including the huge costs of a trial. Trials are very expensive and involve many witnesses and lawyers on both sides – so that’s why so many plea bargains are reached with prosecutors.

Time is running out for an early resolution – because the selection two juries in the separate trials are set to start on (a week from today) Mon., Feb. 5, 2018 at U.S. District Court in Marquette, MI.

The potential jury pool for both trials have been told to show up at 9 a.m. on Mon., Feb. 5, 2018.

Tobias is accused of one count of dealing heroin in Chippewa County from October 2011 to November 2012.

Samuels is charged with five heroin distribution related-charges in Marquette County.

In fact, the only record we are not releasing includes lot of secret undercover information (do not want to put cops lives in jeopardy. That record names all the people who helped him deal heroin in Marquette County. Additional federal indictments are expect against those named and soon more arrests.

The Gravelle/Tobias indictment accuses the pair of “knowingly and intentionally combined, conspired, confederated, and agreed with each other, and others, known and unknown to the Grand Jury, to distribute and possess with intent to distribute heroin.”

The pair were indicted by a federal grand jury on June 2017 on one count of conspiracy to distribute heroin in Chippewa County. Gravelle pleaded guilty last week and is set to be sentenced in April – and faces up to 30 years in prison and a one million dollar ($1,000,000) fine.

Of the gigantic amount of information released prosecutors said:

“In this case, law enforcement officers obtained telephone records as part of their investigation. These telephone records are voluminous, consisting of hundreds of pages. Government agents have reviewed these records and produced summaries based on these records.”
Both Tobias and Samuels cases have numerous federal witnesses testifying for the government.

On January 18, 2018, the government filed a notice of intent to call an opinion (expert) witness against Tobias on drug distribution methods and organizations, to help explain the records. The defense objected, but the judge ruled for the prosecution.

U.P. Breaking News has since learned the name of the victim – who lives at the home – is 25-year-old Daniel Niemi of Gwinn.

Niemi is the suspect’s ex-boyfriend and the couple reportedly have a child.

Witness Jessica Takalo states she did not videotape the incident. Its was dispatched that way – but the phone call was made by one of the victims and her message apparently got confused.
Remember the is a lot of confusion going on during the actual incident.

(Gwinn, MI) – A Gwinn woman is accused of breaking through a bathroom window and allegedly assaulting his ex-boyfriend and his female friend.

The incident was reported about 3:35 a.m. ET on Sunday morning at a home on N. High Street in Austin Location (named for mine) near Gwinn.

One victim was punched in the throat, plus a bloody lip was reported. One of the victims, was ex-boyfriend Daniel (last name not confirmed) .- who was assaulted in the bathroom when the suspect allegedly broke the window and climbed inside.

21-year-old Rachel Elizabeth Kurian of Gwinn, MI was booked into the Marquette County Jail at 5:05 a.m. today, Sunday, Jan. 28, 2018.

Kurian is charged with three felonies – assault and battery, first degree home invasion and domestic assault.

Kurian allegedly assaulted “her boyfriend and another female,” the dispatcher told the numerous officers reporting to the call.

A witness, 20-year-old Jessica Takalo of Gwinn, Mi, reportedly told police she videotaped the incident.

Takalo reportedly said she and Kurian were in Palmer, MI – when Kurian asked for a ride to Gwinn.

***Takalo is now denying she has video – unclear why this is what was stated dispatcher:

Takalo took “video of her breaking the window,” the dispatcher said, adding an assaultive argument was underway involving numerous people.

Intoxicants were believed to be involved in the incident. The motive has not been released – whether it be revenge, anger or unrequited love – or a combination.

Bond for Kurian on two of the charges totals $12,500. Kurian is effectively being held without bond because no bail has been set on the assault and battery charge.
